J. A. Ballenger & Wife to P. M. Ballenger Registered March 27. 1896. Know all men by these presents that whereas by descent from Wm. Ballenger Dec’d. Being same lands conveyed by Wm. Brazelton to Wm. Ballinger in the year 1855. Which Deed is registered in the Registers office at Dandridge Jefferson County Tennessee in Book No. 5 Page 570. We P. M. Ballenger, Sarah Barbee, H. D. Simpkins, & Wife Nancy J. Simpkins, Mary A. Sykes, J. L. Ballenger & wife M. J. Ballenger his wife, J. A. Ballenger & wife Elizabeth Ballenger, James Ballenger & wife Antha Ballenger, & D. A. Ballenger to W. H. Ballinger claimed a title to and now hold an equal and undivided title and interest in and to a certain piece or parcel of land. Containing 30 acres more or less. Situated in the 13th Civil District of Jefferson County Tenn. And known and described as follows, to wit. Beginning & cornering on a Walnut, thence East 120 poles to a Black Oak & Hickory, thence South 44. P. to a Post Oak a corner of the Kimbro survey, thence West 120 poles to a Stake & Pointer, thence North 8. East 44 poles to the Beginning. Now we having made partition of said lands between ourselves, by allotting the same in the following manner, to wit. Lot No. 1 to Sarah Barbee. Lot No. 2 to May A. Sykes. Lot No. 3 to W. H. Ballenger. Lot No. 4 to Elizabeth Ballinger, James Ballenger, and D. A. Ballinger heirs & children of E. M. Ballinger Dec’d. Lot No. 5 to Nancy J. Simpkins. Lot No. 6 to P. M. Ballinger. Lot No. 7 to J. L. Ballinger. We the said Sarah Barbee, Mary A. Sykes, J. A. Ballenger & wife, Elizabeth Ballenger, James Ballinger & wife Antha Ballinger, D. A. Ballinger, H. D. Simpkins & wife Nancy J. Simpkins & J. L. Ballinger & wife M. J. Ballenger hereby transferred and conveys to P. M. Ballinger to have and hold in severally to himself his heirs and assigns forever all our right title and interest to that part of said lands as Lot No. 6 described as follows. Beginning on a rock corner to Lot No. 5, thence E. 16 poles to rock corner of Lot No. 7, thence S. 8. W. 44 poles with line of Lot No. 7 to a rock, thence West 16 poles to a rock corner of Lot No. 5, thence N. 8. E. 44 poles to the beginning containing 4 ˝ acres. We hereby covenant to warrant and forever defend the title to the portion of said land. So conveyed to P. M. Ballenger his heirs and assigns against the lawful claims of all persons claiming under us. Now for the consideration of the sum of Seventy six dollars and fifty cents. Twenty seven dollars & forty five cents, paid to H. D. & Nancy J. Simpkins. Thirteen dollars and five cents payable to H. D. & Nancy J. Simpkins. Due twelve months after date of this conveyance and thirty six dollars due and payable to Elizabeth Ballinger, James Ballenger, & D. A. Ballenger twelve months from this date. With interest from date, have this day bargained and sold and do hereby convey unto the said P. M. Ballenger his heirs and assigns forever, all our right, title and interest, in and to Lot No. 4 & 5 containing 4 ˝ acres each and bounded as follows, to wit. Beginning on a rock beginning corner to Lot No. 6, thence S. 8. W. 44 poles to a rock in old line & corner of Lot No. 6, thence with old line 35 poles to a rock in said line, thence N. 8. E. 44 poles to a rock in old line, thence E. With old line 35 poles to the beginning. We also derived title by decent to an other piece or parcel of land containing 18. acres which Wm. Ballenger died seized and possessed of and now hold equal and undivided interest in. Situated in the 13th district of Jefferson County Tenn. & bounded as follows. Beginning on a rock, thence S. 50 poles to a rock, thence W. 59 poles to a rock and Pine, thence N. 5 ˝ W. 52 poles to a Stake, thence S. 84 ˝ E. 56 p. to the beginning & bounded by the lands of P. M. Ballinger on the North. East. Hawkins on West, P. M. Ballinger on the North. Acuff on the South. Being part of the same lands conveyed to Wm. & P. M. Ballinger by J. D. Galbraith and wife in the year 1870. Which Deed is Registered in the Registers office in Dandridge, Tenn. In Book No. 10, Page 696 & 697. We hereby made partition of said lands between ourselves by allotting it in the following manner, to wit. Lot No. 1. to P. M. Ballinger. Lot No. 2 to W. H. Ballenger. Lot No. 3 to Nancy J. Simpkins, Lot No. 4 Elizabeth, James & D. A. Ballinger heirs and the children of E. M. Ballinger Dec’d. Lot No. 5 to Mary A. Sykes. Lot No.6 to Sarah Barbra, Lot No. 7 to J. L. Ballinger. Now for and in consideration of the sum of Sixty two & 50/100 Dollars to be paid as follows. Twenty Two & 50/100 dollars due and payable to H. D. & Nancy J. Simpkins, twelve months from date of this conveyance. Twenty Dollars due and payable to Elizabeth, James & D. A. Ballenger, twelve months from this date, and Twenty dollars due and payable to Mary A. Sykes twelve months from this date. All with interest from date. We have this day Bargained and sold, and do hereby convey unto P. M. Ballinger his heirs and assigns forever all our right, Estate, Title and interest in an to Lot No. 1, Lot No. 2, Lot No. 3, Lot No. 4, Lot No. 5, containing Twelve acres & six sevenths of an acre more or less. & included in the following boundary, to wit. Beginning on a rock, thence S. 50 poles to a rock, S. 84 ˝ E. 40 poles to a rock, thence N. 51/2 W. 51 poles to a rock. S. 84 ˝ E. 40 poles to the beginning. & the said parties of the first part covenant to warrant & forever defend the title to the portion of said land so conveyed to P. M. J. Ballinger wife of the said J. L. Ballenger, Elizabeth Ballenger wife of the said J. A. Ballinger, Antha Ballinger wife of the said James N. Ballinger having appeared before me privately and apart from their said husbands. Acknowledged the execution of the said Deed to have been done by them freely voluntarily, and understandingly without compulsion or constraint from their said husbands.
