I Henry Bare of the County of Jefferson in the State of Tennessee, being sick and weak in body, but of sound and disposing mind and memory, and knowing that it is appointed for all men once to die, do make ordain publish and declare this instrument of writing to be my last Will and Testament, and as to such worldly estate as it hath pleased God to bless me with in this life I do hereby give and dispose of the same in the following [manner] to wit: First, I recommend my soul to God who gave it, and my body to be buried in a decent Christian manner at the discretion of my Executor to be hereinafter mentioned. Second I do hereby direct that my just debts and funeral expenses be first paid. Third I give and bequeath to my daughter Betsy and my son Andrew Bare my tract of land that I purchased of Saml Gilbreath containing one hundred and sixty acres, also so much of my old tract as lies East of Coons Creek to be equally divided between them in quality and quantity and in such a manner as they may enjoy their present possessions, and as the improvement of my said son Andrew lies South of the creek, I give him five acres of land to be run around and to include his said improvements and to be run in such a manner as not to interfere too much with the lands that I intend giving to my two sons Jacob and Henry Bare, to be theirs and their heir’s forever. Fourth I give and bequeath to my two sons Jacob Bare and Henry Bare the plantation whereon I now live, excepting what has been already given to my daughter Betsey and my son Andrew. Also my Donelson tract containing one hundred and sixty acres to be equally divided between them in quality and in quantity and to be divided in such a manner that my dwelling house, barn, and other buildings may be included in the lott that is given to my son Jacob Bare to be theirs and their heirs forever. Fifth I have heretofore given to my two sons John Bare and Adam Bare a tract of land each and have executed to them a Deed of Conveyance for the same which I think a fair proportion of my estate and which must suffice for their part. Sixth It is my will and desire that my daughter Catharine have five hundred dollars which I wish to be retained and laid out by my executors within three years after my decease in a good piece or tract of land with a good spring on it, which tract of land when purchased, I wish conveyed to my daughter and her heirs in such a manner that the same cannot be sold or disposed of in any manner whatever but the same to be expressly kept for her use and the use of her children. Seventh To my daughter Anna I give and bequeath unto her the sum of five hundred dollars to be paid to her in four years after my decease to be paid her by my executors. Eighth I do hereby give and bequeath to my two daughters Sally and Hannah a legacy which is to be fully equal to the value of the legacies given to my four other children to wit: Andrew, Betsey, Henry and Jacob and which is to be paid to them in cash in four years after my decease and in order to ascertain the amount that is hereby intended to be given to them, I wish my executors to appoint two honest and intelligent men for the purpose of valuing the legacies which I have given to Andrew, Betsey, Henry and Jacob at cash price, and when said valuation is made I wish my executors to pay to my two daughters above mentioned, Sally and Hannah, a legacy equal to said valuation. Ninth It is my wish and desire that my executors after my death sell and dispose of all my personal property on a credit of twelve months having the amount well secured, reserving a sufficient amount out of the crop on hand to support my family and out of sale of the personal property belonging to my estate and the debts that are due and owing to me I wish my executors to pay the Legacies which is herein bequeathed, and should my personal property and debts be not sufficient to pay the above legacies, it is my wish and desire that my son Andrew, Betsey, Henry and Jacob pay to my two daughters Sally and Hannah a sum each in proportion to the valuation of their legacy to make them share and share alike. And in order that I may not be misunderstood it is my will and desire that my son Andrew, Betsey, Henry, Jacob, Sally and Hannah all share alike, and that their legacies be made as near equal as my executors can make them. Lastly I do hereby constitute and appoint my friend Alexander Hays and my son Henry Bare Executors of this my last Will and Testament, and I do hereby revoke, annul and disallow all former wills and testaments made and executed. James Dickey Jacob Moyers State of Tennessee Jefferson County December Sessions 1831 The last Will and Testament of Henry Bare Deceased was presented in open court for probate and thereupon came James Dickey and Jacob Moyers the subscribing witnesses to the same who being duly sworn deposeth and saith that they saw Henry Bare make his mark to said Will and acknowledge the same to be his last Will and Testament for the purposes therein expressed, who in his presence and at his request and also in the presence of each signed our names as subscribing witnesses to the same, it is therefore considered by the court that said will be admitted to record and thereupon came Alexander Hays and Henry Bare, Jr. the Executors named in said Will and took upon themselves the execution of the same, and entered into bond with security for the faithful discharge of their duty therein and was qualified.
