May County Court 1855 I Robert Pierce of the County of Jefferson and the State of Tennessee, being of disposing mind and memory and calling to mind the uncertainty of life and certainty of death, do make and publish this my last Will and Testement, hereby revoking and making void all former Wills by me at any heretoforth made; 1st. It is my Will and desire that all my just debts (if any there be) and funeral expenses be paid as soon after my decease as possible out of any moneys that I may die possessed of or may first come into the hands of my Excecutor. 2. I Wil and bequeath unto my son Henry Pierce, all of the Estate of my son Arron Pierce (deceased) which according to the law of Indiana (the State wherein he deceased) fell back to me. 3. I Will and bequeath to my son George Pierce, all my land and plantation, being ninety acreas more or less with all the appurtenance thereunto belonging. 4. It is my Will that all the remaining part of my Estate not heretofore disposed of or Willed, be sold by my Executors to the highest bidder and the moneys arising from such sale, after the aforenamed bequest are settled, be equally divided between my son George Pierce, and my daughter Rachel Cates, and my daughter-in-law Elizabeth Pierce, widow and (wd?) of my son Robert Pierce, (dec.) and my daughter-in-law Nancy Pierce, widow and (wd?) of my son David Pierce, part and part alike that is one forth of this last bequest to my son George Pierce, one forth to my daughter Rachel Cate, one forth to my daughter-in-law Elizabeth Pierce, and one forth to my daughter-in-law Nancy Pierce, having given to my son Jonathan Pierce his portion and all that I expect him to have out of my estate heretofore. Lastly, I do hereby make and ordain and appoint my estemed neighbor and friend Isaac Jones, and my beloved son George Pierce, Excecutors of this my last Will written on one sheet of paper set my hand and seal this 27th day of 12th month in the year of uour Lord One Thousand eight hundred and fifty four. Signed, sealed and published in the presence of us who have subscribed in the presence of the testator and of each other. Signed, ROBERT PIERCE Jonathan Morgan Jacob Beals State of Tennessee Jefferson Co. May County Court 1855 The Last Will and Testement of Robert Peirce deceased was presented in open court for probate and there upon came Jonathan Morgan and Jacob B Beals, the two subscribing witnesses there to, who being first sworn depose and say that they were personally acqainted with Robert Pierce the testaton sign seal, and heard him acknowledge to be his last Will and Testement for the purposes therein expressed and at his request, and in the presence of each other sign their names as witnesses thereto, and at the time of Excuting said Will he was of sound mind and memory. It is therefore concidered by the Court that said be admitted to record. And there upon came George Pierce one of the excutioners named in said, and was qualified, and took upon himself the Excution of said Will and entered into Bond with Security for the faithful discharge of his duty therein, which was recieved by the Court.
