Original will was in the York County Courthouse, PA, book B, pages 89-91; copied in 1995. Names in the will are: ANNE MARY - wife, ISAAC SCHAUN - son, ELIZABETH - daughter, LEONARD - son, NICHOLAS - son, witnesses - LUDWICK MILLER, JOHN HUBER, and PETER MILLER, SAMUEL JOHNSTON - Deputy Register, and ANNA MARY SCHAUN. The spelling and capitals were typed as they are in the original. WILL OF JOHN SCHAUN [SHOUN] 1762 In the Name of God, Amen. I John Schaun of Germany Township in the County of York in the Province of Pennsylvania Yeoman being in good bodily Health and of a Sound and well disposing mind Memory and Understanding Thanks be therefore humbly Offered unto the Lord and for all others his Mercies Haveing considered the Uncertainty of Life and certainty of Death throught fit to Settle my worldly Affairs and I do hereby make my Last Will and Testament in Manner following hereby Revoking all Wills and Testaments by me at any time heretofore made and I do Declare this and no other to be my Last Will and Testament, that is to say Principally and of all Things I do Recommend my Soul in the Hands of God who gave it and my Body to the Earth to be buried in a Decent Manner. And my mind and Will is that all my just Debts and Funeral Expenses be duly paid and Satisfied And I do give and bequeath unto my Dearly beloved Wife for and during all the Term of her natural Life all the use of my Personal Estate. And I do give unto my said Wife Anne Mary All my Real Estate whatsoever - To [page] 90 To hold to her for and During all the Term of her Natural Life and from and immediately after the Determination of that estate I do give and devise the Same Real Estate unto my Son Isaac Schaun in Fee Simple he my said Son Isaac Paying out of the Same to the Rest of my children the Sum of one hundred Pounds Lawful Money of Pennsylvania in Manner following that is to Say the Sum of Eighteen Pounds Six Shillings and eight Part thereof unto my Daughter Elizabeth on that Day come twelve Months next after my s. Wifes Decease and the Sum of Eighteen Pounds Six Shillings and Eight Pence more Part thereof unto my Son Leonard on that Day come two years next after my s. Wifes Decease And the Sum of Eighteen pounds Six Shillings & Eight Pence more thereof unto my Son Nicholas on that day come three Years next after my said Wife Decease And the Sum of fifteen Pounds more Part thereof unto my said Daughter Elizabeth on that Day come four Years next after my said Wifes Decease and the Sum of fifteen Pounds more part thereof unto my said Son Leonard on that day come five years next after my said Wifes decease . . . . . . . . . . . And the Sum of fifteen Pounds the Rest and residue thereof unto my said Son Nicholas on that Day come Six Years next after the Decease of my said Wife and as for and concerning all the Rest and Residue of my Personal Estate. I do give and bequeath the Same unto my said Children viz the said Isaac Elizabeth Leonard & Nicholas to be Equally divided after my said Wifes Decease between them part and Share a like And I do hereby nominate and appoint my said Wife and my said Son Isaac Executors of this my last Will and Testament. In Witness thereof I the said John Schaun have hereunto Set my hand and seal the ninth Day of April in the year of our Lord one thousand Seven hundred and Sixty two John Schaun {Seal} Signed Sealed Published and Declared by John Schaun the Testator in the foregoing named for and as his Last Will and Testament in the Presence of us who at his Request and in his Presence have Set our Hands as Witnesses hereunto the Words wifes Wifes said Wifes and y Words Son being first intert.. Ludwick Miller John Huber Peter Miller York County St Before me Samuel Johnston Esq. Deputy Register for the Probate of Wills and granting letters of Administration [page] 91 in and for the County of York in the Province of Pennsylvania Personally appeared Ludwick Miller and John Huber two of the Subscribers Witnesses to the foregoing Instrument of Writing and on their Solemn Oaths taken According to Law So say that they were Personally present and saw and heard the above Named John Schaun the Testator therein mentioned Sign Seal Publish and Declare the foregoing Instrument of Writing as and for his Last Will and Testament and that at the Doing thereof the said Testator was of Sound and dispossing Mind and Memory to the best of their knowledge and belief and Say that they Subscribed their Names as witnesses to the Same in the Presence of the Testator and at his Request and at the same time these Deponants did see Peter Miller the Other Subscribing witness to the Same Sign his Name as a Witness thereto likewise in the Presence of the Testator and at his request Ludwick Miller John Huber Sworn and Subscribed before me at York the 9th Day of December 1766 Sam Johnston Deputy Register. A true Copy Compeared with the Original Sam Johnston Deputy Reg. Memorandum That Letters Testamentary in Common Form were granted to Anna Mary Schaun and Isaac Schaun of the Estate of John Schaun Deceased Inventory to be Exhibited into the Registers Office at York on or before the ninth Day of February Next and an Accompt or Reckoning on or before the ninth Day of December next Given under my hand and Seal of Office at York the 9th Day of December.
