KNOX COUNTY, TN - DEEDS - James Sumpter to William Brown, Trustee ----¤¤¤---- On Beaver Creek This indenture made this 2nd day of December 1824 with James Sumpter of the first part and Robert Smith of the 2nd part and William Brown the 3rd part, all of Knox County and the state of Tennessee, wherefor the said James Sumpter being indebted to the said Robert Smith in the sum of $302.50 in current bank notes of Tennessee and James Sumpter being desirous to secure the said Robert Smith and for and in consideration of the sum of $1 to him in hand paid by the said William Brown the receipt hereby acknowledged hath once by these presents doth bargain, sell and deliver unto the said William Brown in trust the following described property viz. one undivided moiety (half) of a tract of land on which the said Sumpter now lives or the part thereof which shall fall to the said Sumpter when the same tract be divided being a part of the tract of land that Joseph Geren? now lives on, lying and being in the county of Knox on Beaver Dam Creek being _______ of a 3000 acre survey of Stockley Donelson. Now if the said James Sumpter shall well and duly satisfy and pay the said Robert Smith the above sum of $302.50 in current bank notes on or before the 1st day of December 1825 thereby indemnify the said Robert Smith then the above obligation to be void but should the said James Sumpter fail to pay and satisfy said debt then it shall be lawful and also the duty of the said William Brown on giving 10 days notice in the Knoxville Register whence the said land shall be sold at the premises of the said land for ready money to the highest bidder and the overage of said sale if any there be to be refunded to the said Sumpter after paying cost of advertising above sale. Each of the parties covenants well and truly to perform his covenant and the trustee covenants with the parties faithfully to meet the trust in him reposed.
