County & State was born according to his Fathers record on the 19th day of February 1764 was as he believes 69 years of age last Febey. Who being ?????? duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the Act of Congress passed the 7th June 1832. That he entered the service of the United States under the following named officers & served as here in stated. I first volunteered for 3 months under Capt. Absalom Cleveland in Wilks County North Carolina in 1799 or 80 in the fall of the year transferred from Capt. Cleveland to Capt. Henderson we were kept upon duty after the Tories. We were never stationed at any particular place for any length of time but generally kept scouting about over the Country in pursuit of Tories & to guard the Country against them. I served out my Three months without being in any battle or skirmish and was dismissed at the end of my time but got no written discharge. In the next spring or summer there was a volunteer company raised under Capt. Benjamin Henderson. I believe we volunteered for Three months but was not in service quite that long. This was another expedition against the Tories for we had to keep continually on the look out & keep men in readiness to protect the Country against them. There was no battle or skirmish during this term. I next volunteered under Capt. Joel Lewis in the latter end of the summer before the battle of Kings Mountain and was stationed at a place in Wilks County at one Cargiles house from which we made excursions out against the Tories & would then return after being sometime upon this service we were marched by Col. Cleveland & joined Col. Campbell ?????? & Shelly & marched on to Kings Mountain where we overtook & defeated Col. Ferguson I was under Col. Clevelands command in the battle & was one of the advance that brought on the battle, within half an hour after the commencement of the battle I was wounded by a ball passing through the flesh of my left arm & into my left side which ball remains in me to this day. I was unable to do any thing more in the fight. The next day after the battle I was placed on a horse with a bundle of bed cloths on the pummel of my saddle which I lent on & was able to travel by short journeys to my home in Wilks County North Carolina where I lay for a considerable time before I was able to do any business. This ended my service. He hereby relinquishes every claim whatever to a pension on ??????? except the present and declares that his name is not on the pension roll of the agency of any State or of any State. Reed both of the County of Burke and State of No. Ca. do hereby certify that we are and have been for the last 30 years acquainted with JOHN FOX who has signed and sworn to the foregoing decleration, that we believe him to be of the age set forth in his decleration (69 years) That he is respected and believed in the neighborhood where he resides to have been a soldier in the Revolutionary War and that we concur in the sworn opinion. Erwin Clk In addition to the foregoing Decleration made in open Court at October Term 1832 by JOHN FOX a soldier of the Revolution for the purpose of obtaining the benefit of the Act of Congress of the 7th June 1832, the sd. JOHN FOX has appeared before me the subscriber a Justice of the Peace in and for the County of Burke and State of North Carolina and after being sworn as the law directs makes the following statement of his services as a soldier of the Revolution. 1st I entered the service of the United States as a volunteer about the middle (say 15th) of Sept. 1779 under command of Capt. Absolum Cleveland and was soon after transferred to Capt. Henderson commanded by Col. Williams and served until about New Year 1st Jany. 1780-------(3 mos. Tour) 2nd I entered the service again as a volunteer in the spring of the year 1780 (I am able to say the precise day) but from every circumstance I can now call to mind think that it was in the month of March I commenced the service and was discharged in the month of May afterwards I intended to perform a three months tour but I was as above stated discharged before the termination of 3 months from the time I commenced. I am satisfied during this tour I served at least 2 months. It will appear by reference to my preceding Decleration that this service was performed under command of Capt. Benjamin Herrendon commanded by Maj. Joseph White. 3rd Soon after my discharge from the tour last above mentioned I volunteered again and served under command of Capt. Joel Lewis commanded by Col. Cleveland and Campbell. I entered the service this tour as well as I remember in the month of July 1780 and served constantly until after the Battle at Kings Mountain this Battle was in the month of October so that I am satisfied my service continued for at least three months. The foregoing remebrances? Only such services as I performed when called out by Regular Offiers. I was engaged off and on occasionally for at least 12 months but the above tours I certify to have performed as stated. Sworn to and subscribed before me this 25th day Feby. 1834. Pearson who hath attested the foregoing affidvate is an acting Justice of the Peace in and for sd. County and that the foregoing signature is genuine. In testimony whereof I have hereunto set my hand and seal caused my seal of office to be hereunto affixed done at Morganton this 25th Feby. 1834 J.J. Be it known that on this the 30th day of March A.D. 1853, before the subscriber and acting Justice of the Peace, in and for said County personaly appeared Mrs. VIRLINDIA FOX aged Seventy Two years past, a resident of said County, and made oath in due form of law, that she is the widow of JOHN FOX the identical person who was a Revolutionary Pensioner of the United States at rate of $26 66/100 dollars per annum and died on the 1st day of September A.D. 1840 that he was placed on the Pension Rolls of the Fayettville North Carolina Agency but moved prior to his death to this Knox County Tennessee, where he resided until the day of his death. Affiant further declares that she was married to said JOHN FOX in the month of November A.D. 1804 in the County of Burke and State of North Carolina by lience by Esqr. Stanley a Justice of the Peace and has not intermarried since the death of her Husband, said JOHN FOX, but continues a widow. Affiant makes this declaration in order to obtain the benefit of the Act of Congress of February the 3rd 1853, and for proof that she is the widow of said JOHN FOX she would refer the Pension Office to a Court certificate on file in the Third ?????? Offive and that which accompanies this declaration. VIRLINDIA FOX Her x mark Sworn to and subscribed the day and date above written before me and I would further certify that I believe the enclosed “Famely Record” no family record on file July 25, 1913 J.S. Chamberlin? Know all men by these presents that I VIRLINTIA FOX, of the county of Knox and State of Tennessee do hereby nominate constitute and appoint Taze. W. Newman of Knoxville Tennessee my true and lawfull Attorney in my name place and stead, to prosecute the General Government of the United States for a pension due me under the Act of Congress of February the 3rd 1853. Hereby giving my said attorney full power to examine all papers which may be on file in any of the Departments in Washington City or elsewhere, to file all additional evidences to receive all communications and to do any and all thing which I might do or cause to be done as were I personaly present at the doing thereof. Hereby ratifying and confirming all that my said attorney may lawfuly do in the premises by virtue thereof. In testimony whereof I have hereunto set my hand and seal this 30th day of March A.D. 1853. Be it known that on this the 30th day of March A.D. 1853 before the subscriber, an acting Justice of the Peace, in and or said County personaly appeared Mrs. VIRLINTIA FOX and acknowledged the forgoing Power of Attorney to be her act and deed for the purposes therein contained. Tains a faithful record of the ages of the children of JOHN and VIRLINTIA FOX; that I believe VALENTIA FOX who makes the foregoing declaration, to be the widow of JOHN FOX the identical person who was a Revolutionary Pensioner of the United States and is a woman in whom full faith and credit may be placed and her oath would be taken in any Court of Justice where she is known and from bodily infirmity cant go to Court Maxell Brown J.P. Cox Clerk of the County Court of said County do hereby certify that Maxell Brown Esq. before whom the foregoing papers were had, is an acting Justice of the Peace in and for said County, duly commissioned and sworn and the signatures purporting to be his are genuine. Witness my hand and official seal this 18th day of May A.D. 1853 Geo. W.C. Cox Clerk Of the County Court State of North Carolina Burke County I James Reed presiding Justice of the Court of Pleas and Quarter Sessions for the County and State aforesaid do hereby declare my opinion after the interrogation of the matter and after putting the interrogatories presented by the War Department that the above named applicant was a Revolutionary soldier and served as he states. And I further certify that Joseph L. McGerrsey? Esq. & Samuel Reed who has made the preceeding certificate are residents of the County of Burke and are person of credibility and that their statement is entitled to credit. Erwin Clk Pension Office 10th Sept. 1853 Sir: Mrs. VIRLINTIA FOX claimant of a pension under the Act of Feby. 3rd 1853, must file record evidence of marriage if any such exists, if there be no such record evidence, she must answer that fact in an affidavit where she must prove the same by at least two credible witnesses. She must file evidence of her widowhood & identity. Her claim is necessarily suspended. J. Hand Knoxville Tennessee July 10 1841 Hon. John Bell Sir: As the friend of Mrs. VALENERIE FOX I would respectfully beg leave to bring to your notice the enclosed pensions certificate of JOHN FOX Sr. accompanied with the County Court clerks certificate proving the death of the said JOHN FOX Sen. And that she the said VARLENERIE FOX is the widow of the identical ????? named in sd original certificate. All of which she humbly prays you may so arrange as to enable her to get the amt due her late Husband at his death, should their be any thing more nessary to be done by her please advise me.
