That is First I give and bequeath to my beloved wife VIRLENTIA FOX all my real and personal estate during her natural life and to keep and on the same for her benefit during her widowhood but if she should marry then to take a childs part that is with her own children. Second I give to my Brother HAZY CONLY one dollar Third I give to my Daughter CINTHA PYATT one dollar Fourth I give to my Daughter LUCY CONLY one dollar Fifth I give to my Daughter NANCY WAKEFIELD one dollar Sixth I give to my Daughter MARY PIATT one dollar Seventh I give to my Daughter MATILDA WALKER one dollar Eighth I give to my Son WILLIAM FOX one dollar Ninth I give to my Son JAMES FOX one dollar Tenth I give to my Son JOSEPH FOX one dollar Eleventh I give to my Son AUSTIN FOX one dollar Twelth I give to my Son ALFRED FOX one dollar Thirteenth I give to my Son STEPHEN FOX a certain piece of land lying north east of branch runs near Jimmie Conners field known as the sixty acre tract that Daniel Varnell bought of Josiah Armstrong. Fourteenth & Fifteenth I give to my Two Sons CATTON and MATTHEW the tract of land known by the ARMSTRONG place to be equally divided between them Sixteenth & Seveteenth I give to my two Sons DANIEL and WESLEY the land where I now live on known by the DANIEL YARNELL farm to be equally divided between them the land as named above (p 109) to each son to be theirs at their Mothers death. Eighteenth I give to my Daughter CARY ELIZA EASTES one dollar what I leave to each child to be paid to them at their Mothers death I wish my Wife to give to each child as they marry and go to themselves to furnish them with cow, bed & c. as we have done before, and I further authorize my Wife VIRLENTIA if she remains a widow till her death to make such disposition of the negroes and personal estate that she may have on hands at her death as she choses by will or other wise. And Lastly I do hereby constitute and appoint my beloved wife VALENTIA FOX Executrix of this my Last Will and Testament hereby revoking all other or former wills or Testament by me heretofor made. In witness whereof I have hereunto set my hand and seal this the 2nd of November 1838. JOHN FOX seal His x mark Signed and acknowledged in presence of Nathan Alldridge Maxwell Brown The Last Will and Testament of JOHN FOX Deceased having been proved in open Court and admitted to record in which VIRLENTIA FOX was appointed Executrix and the said VIRLENTIA FOX having entered into bond with security as prescribed by law and Duly Qualified as such Letters Testamentary ware awarded & issued which letters are in the words & figures following to wit. State of Tennessee To all persons Greeting (P-110) Whereas at our County Court held for the County of Knox at the Court House in Knoxville on the First Monday of October 1840. It appeared to the Court that JOHN FOX Late of said County had died having first made his last will and Testament in which VERLENTIA FOX was appointed Executrix and the said will having been proved and admitted to record and the said VIRLENTIA FOX Qualified as Executrix It was ordered that Letters Testamentary Issue etc. We Therefore empower the said VIRLENTIA FOX to take into her possession all and singular the goods and chattles rights and credits of the said Testator wheresoever the same may be found and all just debts of said Testator and all legacies specified in said will well and truly to pay so far as the said good and chattles rights and credits may extend and in all things to administer the goods and chattles rights and credits according to the tenor of said will and the Law of the Land.
