This file was contributed for use in the USGenWeb Archives by: Suzanne Haley nolefan1@mindspring.com ==================================================================== The last will and testament of Joseph Gallagher (sic)was produced to court for probate wherefore George Gallaher and James Gallaher, subscribing witnesses, thereto made oath that they saw the said Joseph Gallaher sign and seal said instrument of writing and heard him pronounce publish and declare the same to be his last will and testament and that he ever at the time of publishing the same of sound mind and memory to the best of their knowledge and belief which will is ordered to be recorded and is in the words and figures following to wit: Be it known that I, Joseph Gallaher, of Knox County and state of Tennessee, make and ordain this my last will and testament which is as follows: I do allow my wife and the children that now live with us, that is John, Robert, William, David, Sarah, Alexander, Amos, Rebekah, and Peggyann to have all my estate both real and personal and to remain in the hands of them, my heirs ,...,until the youngest comes of age and those to be divided equally amongst said heirs, above named, or as many as may then be living including my wife Peggy. I do hereby nominate and appoint my wife Peggy and son John to be the executors of this my last will and testament. Likewise, I allow all monies due to said estate to be collected by said executors and all just ....against said estate settled by them. I allow the above named executors to pay my daughter Elizabeth fifty dollars within two years from the date of this will and likewise $100 when the youngest of the above named has come of age, having made my son James a title to part of that tract of land I formerly lived on, on the north side of the Clinch River. I consider that he has got his part and allow the remainder to be divided as above stated . Given under my hand and seal the thirteenth of December, one thousand Eight hundred and twenty four.
