Smith, of Knox County, Tennessee, being in sound mind and discretion, make and publish this my last will and testament, hereby revoking any and all wills heretofore by me made. I. I direct that after my death, that all my debts and funeral expenses be first paid. II. I direct that as soon after my death as practicable, the Executor of this will, to be hereafter named, shall proceed to sell all the real and personal property, that I may die seized and possessed of. Said Executor so named is hereby empowered to sell said real estate, either at public or private sale, and on such terms, as is his judgment may seem best to bring the most money. Said sale is to be made however, within one year after my death. And my Executor is hereby empowered to execute deeds for any and all real estate sold by him the personal property will be sold according to law. III. It is my will that my children share alike my estate and to that end I direct that out of any money on hand at my death, or from the sale of real or personal property, or from any notes or other chosen in actin, belonging to my estate, shall be divided equally among my children and grandchild, hereinafter named, to wit: My son HOMER S. SMITH; my son ADONIRAM JUDSON SMITH; my daughter, MARIAH SIMPSON; my daughter SARAH BUFFAT; my daughter ISABELLA JACKSON; my grandson, ARTHUR SIMPSON. But in the settlement of my estate, in order to equalize the same, I expressly charge as advancement against each of my children and grandchild, the following amounts: My son HOMER S. SMITH, I charge with the sum of $1500.00; my son ADONIRAM JUDSON SMITH, the sum of $685.00; my daughter MARIAH SIMPSON the sum of $20.00; my daughter SARAH BUFFAT, the sum of $243.45; my daughter ISABELLA JACKSON, the sum of $120.00; my grandson ANDREW SIMPSON the sum of $60.00. IV. I hereby nominate and appoint H. T. Cooper the sole Executor of this, my last will and testament. IN WITNESS THEREOF, I have signed, sealed and published this instrument and declare the same to be my last will and testament on this the 22nd day of December, 1905. Israel O.
