I.LANG vs G.W.HUTCHERSON. Motion for V.E. Came the plaintiff by Attorney and moved the Court for a condemnation of the land levied on therein and a writ of Venditious Expanas to sell same for the satisfaction of his debt and interest and cost,and it appearing to the Court that the papers are all regular,they are ordered to be filed and are in the words and figures following,To Wit: SUMMONS: STATE OF TENNESSEE,LAUDERDALE To any Lawful Officer within said County; you are hereby commanded to summon G.W.GUTCHERSON,to personally appear before me, or some other Juatice of the Peace for said County,to answer the Complainant of I.LANG in a plea of debt due by accounty under $500.00. Came to hand the same day issued and executed by reading the within Warrant to the Defendent January 17th 1896 and citing him to appear before J.B.CARSON,Esq.for teial the 18th day of January 1896,at 10 o'clock A.M. N.W.BARBOUR C.L.C. JUDGEMENT: I.LANG vs G.W.HUTCHERSON. Judgement for Plaintiff against Defendant for thirty seven dollars 55/100 and cost of suit and interest at the rate of 6% for which Execution may issue. J.B.CARSON J.P. EXECUTION: STATE OF TENNESSEE,LAUDERDALE COUNTY To any Lawful Officer of said County--Greeting: You are hereby commanded that the goods and chattels,lands and tenements of G.W.HUTCHERSON if found in Your County you cause to be made the sum of Thirty seven 55/100 dollars debt and costs herein endorsed,to satisfy judgement that I.LANG obtained against said G.W.HUTCHERSON before me on the 18th day of January A.D. 1896,and such moneys when made,pay over as the law directs. Came to hand February the 12th 1897 N.W.BARBOUR C.L.C. Bill of Cost-Warrant .25, Judgement .50, Docket .15, Fi Fa .25, Executing Summons .50. (am unsure of the costs as they are written the number over - with " under slash.) LEVY: There being no personalty of the Defendant,G.W.HUTCHERSON,to be found in my County on which to levy this execution,I have levied the same on all the right title claim and interest of G.W.HUTCHERSON in and to the following described tract being part of the 92 1/2 acres of land conveyed to A.H.WHITAMORE by EDWARD FISHER by his deed which is registered in the Registers' Office of Lauderdale County,Tenn.,in Book F.,Pages 243-244,and the part levied on is the part conveyed to G.W.HUTCHERSON and wife,SARAH E.HUTCHERSON by A.H.WHITAMORE by his deed which is registered in Book GG Pages 434 and 435 and is all that part of said 92 1/2 acres which lies on the Northwest side of a public road which was opened through said tract a few years ago,and is now treated and worked as a public road,Said road refered too leaves the old Dyersburg and Ripley road a little South of Old Dry Hill,and running thence in a South Westerly direction and after leaving said WHITAMORE tract runs by the CROCKER place where JAMES LEIRD now lives and then goes on in to the Ripley Dyersburg road near where WILL FERGUSON lives.The tract levied on is bounded on the South East side of said road,On the North by the North boundary of said 92 1/2 acre tract and on the West by the West boundary of said tract lying North of said road and contains 40 acres or less. Levied on to satisfy this Execution on this 12th day February 1897_10:57 o'clock A.M. N.W.BARBOUR,Constable of Lauderdale County,Tennessee. ALL said papers are marked filed 12th February 1897. IT IS THEREFORE considered by the Court that the land levied on herein be condemned and sold for the satisfaction of Plaintiff; debt with interest and costs and also the costs of these proceedings and the Clerk of the Court will issue a writ of Veuditiouri Expanas accordingly.
