NELSON & WIFE TO A.F. KILPATRICK DEED, 4 1/2 ACRES. State of Tennessee,Lauderdale County. KNOW ALL MEN by these presents that we W.M.MORRISON and wife SARAH NELSON for and in consideration of the sum of Sixteen Hundred Dollars to be paid as follows by A.F.KILPATRICK,To Wit: Four Hundred Dollars,to us cash in hand paid by said A.F.KILPATRICK,the receipt of which is hereby acknowledged,and three notes this day executed to W.M.NELSON by said KILPATRICK for the sum of four hundred dollars each and bearing interest from date at rate of 6% per annum and due on the 1st days of December 1917, 1918, 1919,have this day bargained and sold and do hereby transfer and convey unto said A.K.KILPATRICK,his heirs and assigns two certain tracts of land which are situated,lying and being in the 5th Civil District of said County and the first tract was conveyed to said W.M.NELSON by MILLER and PARTEE by deed duly recorded in the register's office at Ripley,Tennessee in Deed Book D-3 Page 329 in which reference is made and said tract is bounded as follows: "Beginning at a stake in the center of Cane Slough,being the s.w.cor.of the BILLINGS tract-runs thence north 28 1/2 poles to a stake; thence east 18 3/4 poles to a stake; thence south 40 poles to a stake in the center of Cane Slough; thence with the meanders of Cane Slough to the beginning.Containing about 4 acres more or less." The second tract adjoins the first tract and was conveyed to said W.M.NELSON by said MILLER and PARTEE by deed duly recorded in the Register's Office of said county at Ripley,Tennessee in Deed Book E-3 Page 349 to which reference is expressly made and said tract of land is bounded and described as follows to wit: "Beginning in the center of Cane Slough the s.e.cor.,of a tract of 4 acres sold by W.R.MILLER and G.M.PARTEE to W.M.NELSON,thence running in an easterly direction down the center of Cane Slough 13 poles to a stake in the center of Cane Slough; thence north 47 1/2 poles to a small pecan,in the north boundary line of the BILLINGS tract,of which this is a part,thence west with said north boundary line 20 poles to a stake the n.e.cor. of the above 4 acres; thence south to the beginning.Containing 4 1/2 acres more or less. To have and to hold said two above described tracts of land to the said A.F.KILPATRICK his heirs and assigns forever in fee simple. And we covenent to and with him that we are well seized and possessed of said land, that we have a good right to sell and convey the same; that it is unencumbered and that we will warrant and forever defend the title to the same against the lawful claims or all persons whatever except the claim for the unpaid purchase money notes hereinbefore referred to. And an express lein is hereby retained on said two tracts of land to secure the payment of said three purchase money notes hereinbefore referred to and interest until the same are paid in full with interest hereinbefore provided. The said W.M.NELSON retains possession of said land,as tenent of said A.F.KILPATRICK,until the first day of December 1916 free of any rent,at which time he agrees to give immediate possession to said A.F.KILPATRICK. AND SARAH NELSON joins herein to convey all rights of homestead and all other rights she has to said land as wife of said W.M. NELSON or otherwise. This August 17,1916. W.M.NELSON. MRS.S.NELSON. STATE OF TENNESSEE COUNTY OF LAUDERDALE. This day personally appeared before me,HUGH DAVIS,a Notary Public in and for the state and county aforsaid W.M.NELSON and his wife SARAH NELSON,the within named bargainors,with whom I am personally acquainted,and who acknowledged that they executed the within instrument for the purposes therein contained. AND SARAH NELSON,wife of the said W.M.NELSON having appeared before me privately and apart from her said husband,the said SARAH NELSON acknowledged the execution of the above instrument to have been done freely,voluntarily and understandingly,without fear,complusion or constraint from her said husband,and for the purposes therein contained.WITNESS my hand and seal of office at Gold Dust,Tennessee,this 17th day of August 1916.
