Then the last Will and Testament of BENJAMIN JORDAN,dec'd was produced in ope Court and proven by the oath of PASCAL W.SAUNDERS and JAMES SOWARD and was ordered to be recorded which said will is in the words and figures following,To Wit: In The Name of God Amen. I,BENJAMIN JORDAN of the county of Dyer and State of Tennessee now in low state of health do make and ordain and declare this to be my last will and testament over all others. FIRST to my dearly beloved wife,ELIZABETH JORDAN,I give and bequeath one hundred acres of land including the home plantation on which I now live and Mill.Also one yoke of oxen and a waggon,two cows and calves,one bed and furniture,Bible and hymn book,two ploughs,two hoes and one large sorrell mare,also five negroes Viz: GABE,GINNY, ___NDY, BEDFORD,and SARAH,to her use and benefit during her natural life or widowhood.After the death or widowhood of my wife,ELIZABETH JORDAN,Igive to my son,WILLIAM JORDAN,two negroes,that is GABE and GINNY,one hundred acres of land including the house,mill and plantation on that such of it on which I now live.Also one yoke of oxen and waggon two cows and calves,one bed and furniture,two ploughs,two hoes,and the sorrel. AT MY DEATH,I give my son,WILLIAM JORDAN,one negro man named RALPH,the negroes I leave to my wife with the exception of the two that I give my son,William,at her death or exception of her widowhood,them and their increase to be divided between my sons WILLIAM JORDAN, JEFFERSON JORDAN, ROBERT JORDAN,and my daughters MARY SOWARD and ELIZABETH SMITH. I give my daughter KITCY BLAIR all the right and title I have to the property belonging to sum that her husband JAMES BLAIR has in his possession and one dollar in money. I GIVE and bequeath to my son JEFFERSON JORDAN at my death a negro man named ISAAC.At by death I give and bequeath to my son BENJAMIN F.JORDAN one negro boy named AMBROSE and ___. AT MY DEATH I give and bequeath to my son ROBERT JORDAN one negro boy named ALBERT.At my death I give and bequeath to my daughter.MARY SOWARD one negro girl named CHARLOTTE,also fifty acres of Land bought of ISAAC CURRY lying North of my plantation,that and no more. I GIVE and bequeath to my daughter ELIZABETH SMITH and her husband,HUGH SMITH one negro girl named HARRIET.Also one hundred acres of Land luing South of my plantation and no more.With the death of my wife I give to my sons JEFFERSON JORDAN and ROBERT JORDAN one hundred acres of land lying west of my plantation and no more. To my son,JOHN JORDAN I give and bequeat one bay mare and one cow and calf which he has in his possession and no more forever.My__ __ stockings I want to be kept braiding and one of __ __ to be given to my grandson,PASCAL ? SMITH.One to my grandson WILLIAM SOWARD and another to my grandson THOMAS J.JORDAN--all the right title and claim that I have to property coming from my Father Estate I wish to have equally divided between the above named grandchildre. IT IS MY WILL and my___ that my sons,WILLIAM JORDAN, JEFFERSON JORDAN, BENJAMIN F.JORDAN anf ROBERT JORDAN and my sons-in-law HUGH SMITH & JAMES SOWARD should pay all the claims against my estate agreeable to their satisfaction___ ___ of this my last will and testament without (dyalcation ?). LASTLY I CONSTITUTE and appoint my son,WILLIAM JORDAN and my son-in-lae,HUGH SMITH my executors of this my last will and testament and I witness of these things herein contained.I have set my hand ans seal this 26 day of March 1836.
