This file was contributed for use in the USGenWeb by transcribed by Sarah Hutcherson <> ===================================================================== WILL OF J.A.WEBB STATE OF TENNESSEE COUNTY OF LAUDERDALE I, J.A.WEBB, a citizen of Lauderdale County,Tennessee,being of sound and disposing mind and memory,do hereby make and publish this as my last will and testament,hereby revoking any and all other wills made by me at anytime. ITEM 1. I hereby direct that all my just debts,including my funeral expenses be paid by my executor as soon after my death as possible not to sacrifice my estate. ITEM 2. I give to my wife ROXIE A.WEBB for the period of her natural life,as a homestead one thousand dollars worth of the real estate of which I die the owner,and also give to her for her natural life as dower one third in value of the remainder of my real estate of which I may die seized and possessed,and located in the State of Tennessee; said homestead and dower to be laid off and set apart to my said wife out of the tract of land of thirty five acres lying in the 6th Civil District of Lauderdale Co.Tenn.,being the land bought by me of W.M.BAKER some ten years ago,and where I now live; this thirty five acres being worth twenty five hundred dollars; the homestead to be first laid off and then the dower out of the said land of the value of one third my land after laying off the said homestead.This assignment of homestead and dower to be done by my executor and trustee and commissioners appointed by the County Court of Lauderdale County,Tenn. ITEM 3. I hereby give to my said wife, ROXIE A.WEBB for her years allowance and the exemptions just such out of my personal estate as the law would give her,but she is not to have any further share or childs part in my other personal property above the said exemptions and the years allowance,same to be laid off to her by my said executor and commissioners to be appointed by the County Court of Lauderdale County,Tennessee. ITEM 4. I hereby give and devise unto J.T.LANGLEY in trust for the use and benefit of my minor children who are: AUBREY WEBB, CATHERINE WEBB, EDMONIA WEBB,and of any other minor children I may have,all the real estate of which I die seixed and possessed,including therein the remainder or reversion in the homestead and dower tracts to be laid off to my said wife,ROXIE A.WEBB, and including the seventy five acres bought by me of JOE APPERSON some three years ago,and lying in the 6th Civil District of Lauderdale Co.Tenn.,said trustee to have,use and control the said real estate for the support,maintenance and education of my said minor children for the period until they have reached their majority or twenty one years,or until the girls shall have married prior to being twenty one years old; and as one of my children shall reach twenty one years,or a girl shall marry before twenty one years of age,then such one or ones shall have no further claim upon my real estate for support,maintenance and schooling by the said trustee or any successor,but said trustee shall hence forth use the proceeds and income from the realty in supporting and educating the remaining child or children who are minors and not married except that any son is not to be debarred by marriage before attaining his majority.Said trustee will manage said lands as his own to make the largest income and perserve the land and use the proceeds for my said minor children like a father would. ITEM 5. I hereby give and devise unto my children who are: AUBREY WEBB; CATHLEEN WEBB; EDMONIA WEBB; IDA VOSS,wife of R.R. VOSS; and NINA LANGLEY,wife of J.T.LANGLEY; and any other children I may have,all the real estate of which I die seized and possessed,where ever located,including the two tracts of land of thirty five acres and seventy acres above mentioned,said children to have the right to take charge of and use the said lands from the date that the youngest of my children becomes twenty one years of age; at which time my said trustee will turn the same over to them. ITEM 6. I hereby direct that my said trustee use all the personal property of which I die the owner,after paying my debts,and giving my wife the exemptions and the years allowance set out in item three of my will,in the support,maintenance and schooling of my children who are under the age of twenty one years,and of those children yet minors till of age and of the girls who have not married before being twenty one years old; and when they have married or are all twenty one years of age,if there is any of my personal property left,then the trustee is to pay all same over to my children then living or their bodily heirs; and said personalty of my estate is so vested in my said trustee. ITEM 7. I hereby authorize my said trustee to dispose of my personal property,by converting to solvent notes or money,and including my stock of merchandise,and in so doing he may sell the same to the trade in private and separate lots,so as not to sacrifice the property and for cash and secured notes. ITEM 8. I hereby appoint my son-in-law; J.T.LANGLEY,as executor of this my last will and testament,and as trustee hereunder,who is excused from giving bond,as I have great confidence in him; but should he decline to act,then I appoint my nephew,J.W.WEBB in whom I have full confidence,as the executor of my will and trustee hereunder,who is also excused from giving bond.
