Justice present are John Clayton, Chairman, John P. Holmes, Paris Cooper and James McKool members of the quorum for the present year. William H. Flanigan Admr. of the estate of James Boshers, deceased this day suggested to the Court the insolvency of the said estate and thereupon the following preceedings were had. Do it be remembered that this cause came on to be heard this day before the Worshipful the County Court of Lewis County upon the petitioners, which is in the words and figures following (to wit)- To the Worshipful the County Court of Lewis County. The petitioner of William H. Flanigan, Adm of all and singular the goods and chattles, rights, credits of James Boshers deceased respectfully represents and shows to your Worships that James Boshers formerly of Lewis County departed this life intestate leaving Elizabeth Boshers his widow, James Boshers, Philil F. Boshers, Martin Anthony and wife, Catherine, Jonathan Prior & wife Lucinda, Nathan Henderson & wife Edite, Elisha Bell & wife Lydia, Elija Bell & wife Nancy, Craig Simmons & wife Sally, Joel Dyer & wife Martha, Levi Hollingsworth & wife Polly, Thomas Boshers, & Jason W. Boshers his only children and Mary Laudadale, William, John, Adaline, Margaret, Elijah & Lucinda Laudadale his grandchildren and children of Elizabeth Lawdadale formerly Elizabeth Boshers now deceased, his only heirs and distributees at law. That said James Boshers died possed of some real and personal estate that at the --Term of the County Court of Lewis County 1853 your petitioner was appointed Adm that he sold all the personal property belonging to said estate which amounting to $84.53 that of this sum some thirty or forty dollars has been appropriated to the widows yearly allowance that there are no debts due to said estate that he paid the funeral expense of said estate which amounted to about $18.00. That Dr. Hunters medical (p256) bill amounts to about $61.00 debt due to Emerson $4.10 and Attorneys fees were $35.00, besides the ordinary expence of Adm that there are no other personal property or assets to pay the debts except as above set forth that the insolveney of said estate has been duly suggested to the Clerk of the County Court of Lewis County petitioner further shows that said James Boshers died seized and possed of the following land situated in Lewis County in range 5 and section 3 on Pond Creek and bounded as follows- Beginning st a red oak that stands north 45 degrees last 71 poles from the North East corner of Entry No 134 running West 40 poles to a Chestnut on West bank of said Creek thence North with Adams line 30 poles to a stake thence West 134 poles to a stake thence South 186 poles to a white oak thence 50 poles to a suger tree to D. Sims corner thence south with Sims line 84 poles to his corner thence East 68 poles to a stake thence North 48 poles to a red oak poplar pointer thence last 54 poles to a stake Hickory & two black oaks and past oakes pointer thence North 156 poles to the beginning, containing 208 18/160 acres. That out of said land the Widow is entitled to dower which has been assigned her, that exclusive of the dower said land is worth but little that the dower covers the open and valuable land & taking in all the improvements that it will be necessary to sell of said land as well the protion no included in the dower as the remainder interest in order to pay the debts of said estate. The premise considered complainant prays that Martin Anthony & wife Christina and Elizabeth Boshers of Lewis County Tennessee, Mary Lauderdale, William, John, Adaline, Margaret, Elijah and Lucinda Lauderdale, Levi Hollingsworth & wife Polly, all citizens of Lincoln County, Tennessee, Thomas Boshers of Mississippim Craig Simmons & wife Sally, Elijah Bell & wife Nancy, James S. Boshers of the state of Missuori, Joel Dyer & wife Martha of Hardin Co., Tennessee, Jason W. Boshers, Jonathan Prior & wife Eather, Nathan Henderson & wife Eda of Maury County, Tennessee, Elisha Bell & wife Lydia, W. Prior & wife Lucinda and Phillip F, Boshers whose residence is in parts unknown be made parties defenants to this bill & subpoenas issue for the residents and publiontion be made as to the non residents, that they answer & that said land on the final hearing may be sold for the payment of the debts and for all such relief as he may be entitled to Hughs, Atty. for Complainant. p 257 And it appears to the Satis faction of the Court that the insolve of the estate of James Boshers, dec’d has been duly suggested to the Clerk of this Court, it is therefore ordered that copies of said petition and subpoenas issue by the Clerk of This court for the resideents and that publication be made in the Kaliodoscope newspaper published in the town of Columbia, Tenn for 4 succestive weeks for the non residents mentioned in said petition to appear and answer said petition on or before the 1st Monday in February 1855.
