"The petition of John A Keagan, Thomas T Christian, John W Pollock and Alfred M Pollock, all citizens of said county of Lawrence that last two of whom are minors under the age of twenty years and who file their petition by their regular guardians, the said John W Pollock by his guardian, Elisha Pollock, and the said Alfred M Pollock by his guardian, T T Christian. "Your petitioners would respectfully state and show that about twelve years since, Daniel Pollock died intestate and leaving at the time of his death seven children to wit Caroline, Jane, Eliza A, George W, John W, Alfred M and James H Pollock, and since the death of said Daniel Pollock that Goerge W Pollock, one of said children has died without wife or child or children, and that his brothers and sisters are by law his heirs and distributees. "Your petitioners would further state that the said Caroline intermarried with Westley Fite, and that said Jane intermarried with John K Choat, and that said Eliza A intermarried with James Burns, that said James H Pollock is of full age, and said John W and Alfred M Pollock are minors as aforesaid. "Your petitioners further state that the said Daniel Pollock, at the time of his death was the owner of three slaves to wit, Mariah, Frank and John, and that your petitioners John A Keagan is now the owner by purchase of the shares of Westly Fite and his wife Caroline, and John K Choat and his wife Jane, making two share, in said three slaves, or 2/6 of the same. That your petitioner, Thomas T Christian, is the owner by purchase of the shares of James Burns and his wife Eliza and of the said James H Pollock, making him the owner also of two shares in said three slaves, or 2/6 of the same, and that your other petitioners, John W and Alfred M Pollock, are each the owner of one share in said three slaves, that the said slaves are now held in common, and cannton be divided between your petitioners without a sale of said slaves. "The premises considered your petitioners pray that said three slaves may be sold, on such time as the Court may direct for the proper distribution among your petitioners, that 2/6 of the proceeds be deemed to your petitioner, John A Keagan, and 2/6 to your petitioner, Thomas T Christian, and one share each to your other petitioners and such other relics as may seem right and proper in the premises. R H Ross, {seal}" Decree: Be it remembered that cause coming on this day before the County Court of Lawrence County, upon the petitioners of the relitives and the Reports of the Clerk thereon, which Report to Our Court is in the words and figures following to wit that Daniel Pollock died several years since, leaving seven children, one of whom has since died to wit George W Pollock without wife or children, and that their is now three Slaves to wit Mariah Frank and John belonging to the Estate of said Daniel Pollock deceased, and that John A Keagan is the owner by purchase of the slaves of Westley Fite and wife, and John K Choat and wife, making two slaves in said three slaves, that Thomas T Christian is the owner by purchase of the shares James Burns and wife and James H Pollock, making two shares in said slaves, and that John W Pollock and Alfred M Pollock, are each the owners of one share in said slaves, making in all six shares in said three slaves, and it also affirming that said slaves cannot be divided without a sale, and said exparte be except to this same is confirmed. It is thereupon ordered adjudged and decreed by the court, that after Ten days public notice at four or more public places in said county that T H Ross be appointed commissioner and as such will proceed and sell said three slaves, at public auction, on credit of six and twelve months, taken bonds and approved security of the purchases; and retraining a lien on said slaves until the purchase money is proved, and that he report to this court how he has executed this decree and that all other matters be reserved until the coming of said report.
