County Court Minutes (1849-1857); Minute Book 6 Pg. 240--January Term 1851 A paper writing purporting to be the last will and testament of James Randolph, dec'd., late of Madison Co., was this day produced in open court and upon motion of M. Midyett and J.D. McClellan came into open court and swore that they were acquainted with said deceased and that he signed this will in their presence and that he was of sound mind and memory at the time of doing so. It is therefore ordered that the said paper writing be received as the last will and testament of deceased. Whereupon Albert G. McClellan, the executor named therein, qualified as executor and entered into a bond of $100,000.00 with J.D. McClellan and M. Deed Bk. 2; Pg.522-523 "...Whereas heretofore on May 1, 1829 a deed of trust was executed by Thomas Crutcher, William Crutcher, William Jones And Bird B. Smith, unto Micajah Midgett for the benefit and security of John McClellan of and upon a Negro fellow named Phillip about 45 years of age among other property in said deed of trust mentioned for the purpose of securing to said McClellan the payment of $250.00 which has been duly registered in book __, pg. 261 and whereas in pursuance thereof the said Micajah Midgett did sell said Negro on Nov. 3, 1830 at the courthouse in Jackson where John McClellan became the last highest bidder for the sum of $130.00 which money he then paid. Now therefore, I, the said Micajah Midgett, do hereby transfer unto the said John McClellan said Negro slave and all the title & interest that said Crutcher, Jones and Smith or either of them have or had, unto the said John McClellab and his heirs..." This bill of sale was made April 16, 1831. Wit: Edward Williams M. Midgett Exum L. Deed Book 2; Pg. 655-656 Micajah Midyett of Madison County sold to John H. Hicks of Madison County, for $1500.00, a tract of land in Madison County, Dist. #10, Range 1 & 2 and Section #10 and joining Thomas Short, containing 250 acres. This indenture was made April 29, 1831. Wit: Jesse Simms Allen W. Hicks M. Hicks was this day produced in open court, the execution acknowledged by the said Midgett and returned to be certified for registration. Pg. 277--Monday May 2, 1831 A bill of sale from Micajah Midgette to John McClellan was this day produced in open court, the execution thereof acknowledged by the said midgete to be his act and deed for the purposes therein mentioned and ordered by the court to be certified for registration. ________________________________________________________________________ Source for the following: Madison Co., Deed Bk. 3; Pg. 67-68 John McClellan made a deed of gift to Samuel C. McClellan, his son, on April 24, 1832, "for and in consideration of the natural love and affection and also for the better maintenance, support and livelihood" a tract of land lying in Madison Co., Dist. #10, Range #2, Section #9 bound by McIver's s.e. corner & , Benjamin M. Perry's n.w. corner and containing 106 acres & 25 poles, it being a part of a 640 acre tract granted by the state of Tennessee to Joseph B. Porter, Entry #710. Wit: B.M. Perry John McClellan M. Byrne to Micajah Midyett was this day produced in open court, the execution thereof proven by the oaths of Joel B. Harper and O. Byrne, witnesses, ordered to be certified for registration. Also the relinquishment of any and all claims which Celia Tyner and Josiah Midyett have in and to the property conveyed in the foregoing bill of sale acknowledged by the said Josiah Midyett as to his part and proven by the oaths of B.M. Perry and John McClellan as to the part of Celia Tyner. Ordered to be certified for registration. Pg. 465--Monday, February 4, 1833 A bill of sale from Micajah Midyett to Sugars Mclemore was this day produced in open court, the execution thereof acknowledged by the said Midyett and ordered to be certified for registration. Pg. 493--Monday, February 11, 1833 The guardianship of James S.B. Brooks and Frederick N. Brooks was this day granted to Joseph W. Brooks who entered into and acknowledged bond in the penalty of $1200.00 with M. Midyett and Benjamin S. Brooks as his securities. ________________________________________________________________________ Source for the following: Madison Co., Deed Bk. 3; Pg. 320 James Wright of Madison Co., Tn. sold to Sugars McLemore of Madison Co., Tn., for $254.32, a tract of land in Madison Co., Dist. #10, Range #2, Section #7 and founded on Entry #79 and containing 48 acres which is bound by the s.e. corner of Edward Williams' land which is part of Bird Smith's 500 acres tract and Entry #6, the west boundary of A. Ewens' 300 acre tract. This indenture was made July 2, 1833. Wit: G.W. Randolph James Wright James Van Pelt James S.B. Brooks M. Midgett Reg: July 4, 1833 ________________________________________________________________________ Source for the following: Madison Co., Deed Bk. 4; Pg. 60 William Cogburn & his wife Charlotte of Madison Co., sold to John McClellan of Madison Co., for $45.00, a tract of land containing 25 acres lying in Mdison C. on the north side of the Forked Deer River in Range #2, Section #9 and bound on the south boundary line of Entry #547 for 169 acres in the name of E. Crutcher. This indenture was made Jan. 5, 1835. Wit: M. Midgett William (x) Cogburn Erasmus R. Midgett Charlotte (x) Cogburn Reg: Jan. 8, 1835 ________________________________________________________________________ Source for the following: Madison Co., Tn. Deed Book 4; Pg. 224-225 A certain cause between Robert Matthews & others as complaintants and the heirs of John Mciver and other as defendants. Benjamin Litton, Clerk & Master Of Chauncery Court Of Rutherford, Davidson and Williamson Cos., Tn. held at Franklin, was ordered to sell all the land at public auction and Micajah Midyett became the higest bidder at $2.00 per acre or $130.00. Said land being in Madison County & known as Entry #534, Grant #17282 in Dist. #10, Range #2 and Section #9, containing 65 acres. This sale was made June 17, 1835. Benj.
