Teague Trust Registered June 2nd 1858 I Abner Teague of Madison County Tennessee do bargain sell and convey to James R. Teague of said County the following property to wit Two Horses one a sorrel and one a black, also thirteen beds, bedsteads and bed clothes and furniture appertaining thereto-Also one Omnibus and harness; also one dray; also one set of blacksmith's tools; also six wash stands and four looking glasses; also one walnut dining table; all my carpets also 1 dozen cups and saucers, 1 doz plates; 1 dozen knives and forks; 2 dishes 3 sets of castors; 4 pitchers & bowls 1 centre Table, 1 dozen & a half of chairs 6 small stoves used for warming bed chamers; also the following lot or parcel of ground in the town of Jackson County of Madison and State of Tennessee Beginning at the North East corner of Robert H. Anderson's lot (called the Lee Lot) running East with the South Side of main Street one hundred and sixty one feet to a stake, Cartmell's Corner; thence South two hundred and seventy feet to a stake on another Street; thence West Eighty four feet to a stake; the South East Corner of the Gamewell lot, thence North one hundred and sixty three feet to a sake the North East corner of the same; thence West with its North boundary sixty seven feet to a stake its west corner; and then continuing west ten feet to a stake in the Anderson line; thence North one hundred and seven feet to the beginning To have and to hold the same to said James R. Teague his heirs and assigns forever and I covenant to warrant and defend the title to the same to him and heirs. But this conveyance is made for the following purposes and trust that is to say that whereas I am indebted as follows To James R. Teague by amt assumed for R. M. Teague dece 23th November 1857 for $44.80 To James R. Teague by note due 1st January 1858 for $369.49 To James R. Teague by note due 1st January 1858 for $211.94 To James R. Teague by note due 12 January 1858 for $115.33 To James R. Teague by note due 16 January 1858 for 51.00 To James R. Teague by note due 21 January 1858 $12.75 To James R. Teague by note due 1st February 1858 $70.00 To James R. Teague by note due 30th March 1858 for $125.00 To James R. Teague by assin ? for cash paid James M. Grier for $12.00 James R. Teague who is my security for the hire of Negro Jim (the property of Miss Moore of Spring Creek) for the year 1858 for $130.00 Also James R. Teague who is my surety for the hire of the Negro Charlott belonging to Thos Norvill for the year 1858 $120.00 And I am indebted also as follows to wit To John S. Miller by judgment before Stephen Sybert on the 7 November 1857 Stayed by James R. Teague for $258.03 To the same by judgment before the same on the 19 March 1858 stayed by the same for $59.05 To Person & Lancaster by judgment before the same on the 20th March 1858 & stayed by the same for $220.73 To John Tidewell by judgment before the same on the 12th October 1857, stayed by the same for $16.97 To A. S. Rogers by judgment before R. W. May on the 16 January 1858 stayed by the same for $40.21 To George H. Hunt by judgment before the same on the 16th January 1858 stayed by same for $21.24 To James Elrod by judgment before G. S. Christian ordered in May 1858 and stayed by the same for $128.00 To Wm H. Long by balance on note 1st January 57 for about $150.00 To John Irvin by note due January 1st 1857 for $60.00 And whereas I am desirous of securing the payment of said debts. Now if I should pay off and discharge all of said debts on or before the 20th day of June 1859 then this deed to be void; but if I should fail to do so then said James R. Teague as Trustee after giving four weeks notice in a news paper published at Jackson, shall expose said property to public sale for cash at the Court house door in Jackson and apply the proceed, after the expenses of executing this trust as follows First to the payment of the debts above set out as being due from to James R. Teague and the debts due Thos Norvill and Mers. Moore for the hire of Negroes and for which said James R. Teague is my security Secondly to the judgment pro ruta(?) of the judgments above set out & to the debts due Wm H. Long & John Irvin Thirdly: If any surplus remains the same to be applied to the following debts pro. Ruta due from me to wit Thomas M. Greer by note due the 1st January 1858 for $129.00 George N. Harris for notes & accounts due prior to 2nd January 1858 for $300.00 L. B. Shepard by open accounts for year 1857 $350.00 (?) J V T Murrell account for 1856 & 1857 $45.00 To Mrs. Hamilton by note due 15 June 1858 for $80.00 And it is agreed that I am to retain the possession of all of said property until called for by said trustee and an absolute title without redemption to be made to the purchaser of the real estate when sold Given under my hand and seal this 2nd day of June 1858 Abner Teague (seal) State of Tennessee Madison County Personally appeared before me Thos W Gamewll clerk of the county court of said county, the foregoing bargainer Abner Teague with whom I am personally acquainted, and acknowledged that he executed the foregoing Deed of Trust for the purposes therein contained Witness my hand at office this 2nd day of June 1858 (Tax paid) Thos.
