Claiborne, Extr. & Tr. To) Deed Martha Ann Russell Filed April 11th, 1942 At 9:30 A. M. Know all men by these presents, that I, Lewis T. Claiborne executor, and trustee, of the estate of Mrs. Irene Claiborne Russell, deceased, by virtue of the authority in me vested, by the last will and testament of the said Mrs. Irene Claiborne deceased, as the same appears of probate record in the office of the Clerk of the county court of Madison County, Tennessee, and as sole residuary legatee and devisee under said will, and for no consideration other than a knowledge of and a desire to do as my sister, the said Mrs. Irene Claiborne had in the premises, I do hereby bargain, sell, transfer and alienate and forever convey unto Martha Ann (Patsy) Russell, all of the right, title claim interest and estate of every kind and character which the said Irene Claiborne Russell had in and to that certain tract or parcel of land lying and being situated in the City of Jackson, Madison County, Tennessee, and which is more particularly bounded and described as follows: Beginning at a stake the N. W. Corner of the Mark Dodds lot on east line of Stoddert Street, thence north 65 feet and 4 inches with Stoddert Street, thence east 104 feet and 8 inches to O'Connor's west line, thence south 65 feet and 4 inches to Dodd's N. E. Corner, thence west 104 feet and 11 inches to the beginning, being a lot of land, in which Charles T. Russell, had and owned several shares and which shares or interests, were devised in remainder to his wife the said Irene Claiborne Russell, by the last will and testament of the said Charles T. Russell, deceased, and who died prior to the death of the said Irene Claiborne Russell, and which will appears of record in the office of the Clerk of the County Court Madison County, Tennessee. To have and to hold said interest or shares in said lands unto the said Martha Ann Russell, forever. I covenant with the said Martha Ann Russell, her heirs and assigns, that I am lawfully seized with all and singular such right and title to said lands as passed to the said Irene Claiborne Russell under and by said last will and testament of Charles T. Russell, that the same has not been encumbered by me, and that I have a perfect right to convey the same. I further covenant and bind myself, my heirs and representatives, to forever warrant and defend the right and title to said land unto the said Martha Ann Russell, her heirs, and assigns, against the lawful claims of all persons, claiming the same by, under or through the said Irene Claiborne Russell, her heirs, assigns or representatives, but I do not warrant the title further or otherwise, and the said Martha Ann Russell is to pay all unpaid taxes and she takes the property subject to all unpaid taxes, and other encumbrances placed thereon by or under the said Charles T. Russell, or other persons than by or under the said Mrs. Irene Russell. In witness whereof, I have hereunto subscribed my name on this the 31st day of January, 1933. Lewis T. Matthews, a Notary Public duly qualified and acting, in and for said state and county aforesaid, Lewis T. Claiborne the foregoing named bargainer, with whom I am personally acquainted, and who acknowledged that he executed the foregoing instrument for the purposes there in contained, and I further certify that I am as such Notary Public authorized by the Laws of Arkansas to take acknowledgments to deeds, and that my commission as such Notary Public will expire on the 24 day of Jan. 1935.
