Martin, Executor of the will of Samuel Dickens after his death. John D. Martin acknowledges promises [to pay the remaining amount of $163.80 plus interest?] the receipt of $151.20 paid to Samuel Dickens and releases the title for the land. This is the same land bonded to John Curlin by David Jeffrey, Agent for Samuel Dickens and recorded in Madison County Deed Book 7, p. 202, dated 27 June 1834. Martin, Executor of Samuel Dickens to John Curlin Deed This indenture made this fifth day of April A.D. one thousand eight hundred and forty one between John D Martin Executor of the last will and testament of Samuel Dickens, late of the County of Madison, and State of Tennessee deceased of the first part, and John Curlin of the County of Madison and State of Tennessee of the second part, witnesseth, that whereas the said testator in his life time by contract and obligation in writing sold to the said John Curlin the lands and tenaments hereinafter mentioned, and bound himself to make title thereunto, which said contract and obligation has been proved and recorded in the County of Madison and State of Tennessee where the land lies. Now in consideration of the promises and the sum of one hundred fifty one dollars and 20 cents [$151.20] paid to the said Samuel Dickens by the said Curlin in his lifetime the receipt whereof is hereby acknowledged, I have and do hereby convey release and confirm unto the said John Curlin his heirs and assigns forever in fee simple a certain piece or parcel of land situate, lying and being in the County of Madison and the State of Tennessee and bounded as follows to wit lying & being in Section seven Range three, beginning on the section line which divides the seventh & eighth sections on a black oak hickory thence (?) with said section line one hundred & ninety two poles [192 poles = 3168'] to a black oak & pointers thence south with Abel Brown's East boundary line eighty four poles [84 poles = 1386'] to a stake hickory, post oak & black oak pointers thence East one hundred & ninety two poles [192 poles = 3168'] to a poplar & gum pointers, thence North with Green"s line eighty four poles [84 poles = 1386'] to the beginning. Containing one hundred & 8/10 [100.8] acres more or less. And the said John D. Martin as Executor covents to and with the said John Curlin his heirs and assigns, that he will warrant and defend the rights and title to the before mentioned land to the said John Curlin his heirs and assigns, against the lawful claims of all persons whatsoever so far as he is authorized by law to charge the legatees of the said Samuel Dickens, deceased, and himself as Executor of aforesaid in case of eviction from said lands and no further.
