Will of Champness Madden 23rd Oct 1838 Madison County, Tennessee registered 17, July 1839. Champness Madden, Senior. In the name of God, Amen. I, Champness Madden of the County of Madison and state of Tennesssee believing that is is appointed for all men to die, and being weak in body but of sound mind and disposing memory do make this my last will and testament (to wit, 1st - It is my will and desire that all my just debts and funeral expenses shall be paid and to enable my Executors hereinafter appointed to do the same it is my will that they shall sell either at private or public sale as they may think proper. One negro boy named Peter, one boy ? slave ? named Marshall. My one sorrell mare and about one hundred acres of land which I purchased of Neal Campbell. 2nd - It is my will and desire that all the remaining part of my property both real and personal shall remain in possession of my beloved wife Frances during her natural life for her support and maintenance. 3rd - I give and bequeath to my daughter, polly Haynie, a negro girl named Rhonda and a Negro boy named Richard which she has now in her possession and at the death of my wife one negro woman named ? Linda? and her child together ?? ?? that is to say she is to have the use and benefit of them during her natural life and at her death to be equally divided between her children. 4th - I give and bequeath unto my granddaughter Mary E. D ?? (at the death of my wife) one negro boy named Zacharah at which time she shall pay upon ?? of said boy one hundred dollars for the use of Daniel Maddens Children. I give and bequeath to said Mary E. D. one negro girl named Carolina at ?? time. 5th - At the death of my wife I leave to my daughter Margaret White during her natural life my negro boy David and at her death or sooner if she chooses to give him up, I give and bequeath said boy to my granddaughter Mary E.D? 6th - I give and bequeath to my son Franklin Madden and my son-in-law Joseph Fogg all my land not disposed of except such part as I have attested for the use of my wife during her life ?? to them at her death to be equally divided between them according to the number of acres beginning at the North east end of the little field on which the old barn stands and running thense a Northwest direction so as to make an equal division according to the number of acres. Franklin Madden to have the South and Joseph Fogg to have the north end. ? 7th - I give and bequeath to Franklin Madden a negro girl named Rachell and her increase at the death of my wife. 8th - I give and bequeath unto my son-in-law Joseph Fogg at my wife's death my negro boy Bill and when he receives him he is to pay two hundred dollars for the use of Daniel Madden's children. 9th - At the death of my wife I give and bequeath my negro boy edward to my grandson CHAMPION MADDEN. 10th - I give one feather bed and ? furniture ? to each of my children now living at the death of my wife. 11th - It is my will and desire that whatever property may be left at the death of my wife and not been disposed of shall be for the use of Daniel Madden's children. 11th - (duplicate number of above) - I give unto my grandson Daniel Madden one bay colt. 12th - I do herby appoint my two sons ? Daniel Madden ? and Franklin Madden trustees to receive ?? as I have given to Daniel Madden's children for their support and education. 13th - I do hereby appoint my wife Frances, my son Franklin Madden and my son-in-law Joseph Fogg executor to this my last will and testament on this 23rd Oct 1838.
