All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/tn/tnfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Julie Clayton solargenes@gmail.com November 2, 2008, 5:09 pm Written: March 21, 1841 Recorded: March 30, 1841 D428 ( in ink) I, ANN THOMPSON, have this day bargained and sold & do hereby convey to CHARLES HALEY for the sum of five dollars to me paid and the other considerations hereinafter mentioned, a tract or parcel of land in the State of Tennessee, Marion County, district the North east corner of Section 23 Fractional Township Ranges 7 East Quarter in the Ocae (sic) District adjoining Goodson McDaniel on the s.w. by a greater part entered and on the s.e. by RICHMOND HILL, and on the North by Tn river, I. A. bought the quarter Section of land on which the said ANN THOMPSON now lives and where WILLIAM THOMPSON DECEASED, and also 3 negroes (to wit) Eliza, Reuben, Rebecca slaves for life, the land containing by estimation ____...To have and to hold the said tract or parcel of land and the said 3 negroes to the said CHARLES HALEY, his heirs and assigns......But this deed is made for the following uses & Trusts and for no other purpose, that is to say, I have given a refunding bond to GEORGE R. RICE administrator of my husband estate for $4560 Dollars to secure him if any debts should come against said estate, given MILLER F. RICE and(?) JOHN C. HALEY of said Marion County my securities to make him secure if he should be injured. Now if no debt should come against the estate or that I should not have to refund to the said RICE or any body any part of the money I have received from him or when his his (sic) estate is freely wound up and all things settled, then, this deed to be void, but if I should comply with the said refunding bond and the said MILLER RICE & JOHN C. HALEY as Trustee, after giving to days notice in writing at the Court house door in the County of Marion, town of Jasper & State afsd. and at the election ground of the district in which the land lies and negroes live and three other public places in the neighborhood may expose the said land & negroes to public sale and sell it and them to the highest bidder for cash or on a credit if so agreed and appropriate the proceeds first to the payment of necessary expenses & costs, secondly, to the satisfying...of said damages that he, RICE, & HALEY may have heretofore sustained by the non-performance on my part of sd refundind (sic) bond, and thirdly to pay the balance if any there be, to me.
