On motion it is ordered by the Court that James BROWN be and he is hereby required to procure a sledge hammer to keep that part of the Fishing pond road in repair from Lewisburg to Charity EWINGS- The commissioners appointed at a former term of this Court to lay off and set apart one years provision for the widow WALKER reports as follows to wit, State of Tennessee) May 16th 1840 Marshall County) We the commissioners appointed by the County Court of of said County at the April term to set apart one years provision to the widow WALKER and family Being 7 in number after being duly sworn have proceeded to set apart Eight hundred pounds of Bacon & Eighteen Barrels of corn fifty weight of shugar and forty five pounds of coffee & two bushels of salt & fifty pounds of hogs laird & all the Cotton on hands 2 pounds of pepper 1 pound of spices & 4 hundred pounds of flower All of which is respectfully submitted to the worshipful Court this 1th day of May 1840. A Jury of View appointed at a former term of this Court to turn the public road around Osman ROSSONS plantation reports as follows to wit, State of Tennessee) Marshall County) We the undersigned Jury apointed at a county Court of sd County at the January term 1840 to view that part of the road that runs from (390) RAINEYS store to HURTS Cross Roads so far as concerns that lands of Osman ROSSON & after Being Duly sworn to act in conformity with said order and do report that said road should be altered or changed Leaving the said road at the east end of the Lane that divides the lands of John ROSSON & Osmon ROSSONS Running with said land to the west corner of Osman ROSSONS farm thence runing north west through the Lane by said ROSSONS Dwelling house so as to intersect the said Road as marked out near the north Corner of said ROSSONS farm All of which is respectfully submitted to the Courthouse this 26th day of March 1840. The Jury appointed at a former term of this Court to lay off and mark out a road commenceing at or near Hiram HARRIS in the direction if CHANDLERS Mills reports as follows to wit, The undersigned being appointed and sworn to view and determine on the propriety of turning that part of the public road leading from Hannah’s gap to Nashville by way of CHANDLERS Mill and the fishing ford over which Lewis TAYLORS is over seer from the County line near John STATEON’s to CHANDLERS Mill do report that in our opinion the said road ought to be changed as follows, to wit, commenceing at Hiram HARRIS that the Fishing ford road run with the Mill road by John T. HARRIS S to the end of the said HARRIS Plantation thence in a direction to intersect the Fishing ford road at the dogwood Corner between J. T. HARRIS and James GINGLES thence with the line between the said GINGLES and Gideon PARNELL and Continue the same direction to the mouth of the lane at Kincheon PARNELS thence up the river to James DILLARS Lot thence through said Lot as marked to the mill, Also in our opinion the fishing ford road should leave the mill road at or (391) neat the branch and run as marked to Thos. On motion it is ordered by the court that the comissioners of the tone of Lewisburg proceed on to Collect the balance of the Money due for lots But should any Debt in their Judgement be doubtful on they should consider it to the Intrust of the County to give indulgence by makeing it more secure they may do so- 18 Justices of the peace being present. (396) On motion it is ordered by the Court that Hugh D. CUMMINGS be appointed overseer of the Fayetteville & Nashville road that lies between BAGLEYS mill and top of Elk ridge in place of Ezra COLLINS and that he have the former hands. Issued. On motion it is ordered by the Court that Elias PRUET be appointed overseer of the road in the room of William T. COOK and that he have the hands in the following bound s to wit, including all those living on the waters of Bradshaw to the top of the ridge east of Chesley SMITH and west of Thomas PARK to the County line. Issued. On motion it is ordered by the Court that William APPLEBY be appointed overseer of the fishing ford road Beginning at Farmington and terminateing at the middle of the hurricane near James SHAWS and that he have the hands in the following bounds, to wit, beginning at Farmington on the Columbia road then west with said road one mile thence north to the center of the hurricane including E. W. HUNTER thence east with the center of the Hurricane to the county line thence south with the County line to George GLASCOCKS thence west to Farmingtons Issued. On motion it is ordered by the Court that James SANDERS Jr. be appointed overseer of the road from Fayetteville to Columbia commencing at the Lincoln County line and terminateing at William CARUTHERS and that he have the former hands. Issued. On motion it is ordered by the Court that William G. CLALHAN be appointed overseer of the McColums Gap road commenceing at the South Corner of Clark HOPWOODS Lot and terminateing at William COLEMANS and that he hyave all the hands on the waters of Prestons fork of Richland creek north of the Cornersville road. Issued. On motion it is ordered by the Court that John RHEA be appointed overseer of the Halls ford road commencing at Hugh HOUSTONS and terminateing at Leander N. EWING and that he have the former hands. Issued. (397) July term A.D.1940. The commissioner appointed at a former term of said Court to set apart one years provision to the widow of John H. MOORE decd reports as follows to wit, We Ashley MOORE Tolbert ARTHUR & Joel GIFFORD having been appointed on the first Monday of Feb. 1838 by the County Court of Marshall county to lay off the years provision of Elizabeth I. MOORE widow of John H. MOORE Decd. did agree to allow her the following Viz, 600 lbs of Bacon 50 lbs of Flour, 25 lbs Coffee 2 lbs Tea, 50 lbs sugar, 7 ooaf sugar 1 lb pepper 1 lb ginger 1 lb 10 lb rice 25 lb salt. LARWOOD be appointed a Jury of View to lay off and mark out a Road Commencing and leaving the Nashville Road at the lane between the Orson GRAYS Land and Mrs. BEATYS along said line till it crosses the Creek, thence the line between LAVENDERS and MERRITS untill it comes to Mrs. DRIVERS also the line between said MERRITT and WELCH to the County line if in their opinion the good of the public require it and that of Individuals not injured and Report to the next October Term of this court. (398) The Jury of View appointed at a former term of this Court to change a part of the Lewisburg road commenceing at the South end of Martha DOWDYS Plantation reports as follows, to with, The undersigned being appointed and sworn to view and determine on the propriety of tuning that part of the public road Leading from Lewisburg to Nashville ov er which W. H. HOWARD is overseer do report that in our opinion the said road ought to be changed as follows, to wit, to commence at the south end of Martin DOWDYS field running south about 150 yards running thence westward about 100 yards so as to intersect the said road again all of which is respectfully submitted to the Court April 25th 1840. Agreeable to an order made at the April Term 1840 Directing us ti Change a part of the Lewisburg Road near Phillip V. DOSS and terminateing at saod rd we the undersigned after being summoned & duly qualified have proceeded to examine the said Road and change sd Road commenceing a Beech at the east corner of Phillips V. DOSS Grass Lot Running West with said Lot fence until it Intersects the old Road near a Large Oak Stump, given under our hands and seals this 29th June 1840. Joseph MORRIS Price W. The Jury of view appointed at the October term 1839 to change a part of the Richland road, reports a s follows to wit We the undersigned being duly summoned and sworn to view the public road ascontemplated by the within order do respectfully report that the prayer of the petitioner is reasonable and that the road should bechanged as contemplated. (400) July term 1840. It being suggested by A. F. LILLARD Esqr that Martha KIRK a resident of Marshall County is an Idiot or Lunatic, whereupon It is ordered by the Court that an order issue to the sherriff requiring him to summon a Jury of twelve freeholders to ascertain by inquisition such Idiocy or Lunacy and make return thereof to the present term of this Court, which order being turned into Court endorsed Executed by summoning the following Hurors, George NEIL, John RAMSEY, Leonard BULLOCK, James PATTERSON, James C. RECORD, William BILLS, John WEA VER James BROWN, Elisha GARRETT, Hugh A. HALL, Cary A DYSART, James P. DYSART S. W. BEATY with the following reprot, The undersigned freeholders of Marshall County having been duly summoned and sworn as agreeing to enquire into the mental condition of Martha KIRK after diligently investagation the matter do find that the said Martha KIRK is an Idiot and utterly incapable of manageing her own affairs with safety to herself and oather We also find that she owns five negroes the three following in the possession of her brother Edward P. KIRK in said County Agnes, Minda and Virgil one in the possession of Barnabus TERRENCE in the western district, named Mary and one in the North Carolina in the possession of said TERRENCE’s father named Allison. WILSON came into Court and was appointed guardian and executed his bond in the sum of seven thousand dollars with A. M. McLEAN & Sherwood W. BEATY which was accepted by the Court. The Jury of Inquest summoned by the Sherriff of Marshall County to inquire into the mental condition of Sally STEPHENS reports as follows to wit, The undersigned freeholders of Marshall County having been duly summoned and sworn as a Jury to inquire into the mental condition of Sally STEPHENS after dilligently investigating the matter do find that the said Sally STEPHENS is an Idiot and utterly incapable of taking care of ownself We also find that shw has neither Lands or other property (401) given under our hands this 30th day of April 1840. On motion it is ordered by the court that William F. ERWIN be appointed overseer to cut out the road as marked by the Jury of view from John CHRISTOPHERS old palce to John ERWINS and that he have the hands in the following bounds, to wit, Beginning at John DYSARTS Jr running west to John CHILTONS, George A. ARMSTRONG’s then with the road to Robert WILLIAMS thence with the road to the beginning and that he report to the next October term of this Court 2nd class. Issued. John ORR and James ADAMS commissioners of a tract of School Land in range No.2 Section No.5 appeared in Court and returned a report of said Land which was ordered to be recorded. On motion it is ordered by the Court that David YANCY Jermen WOODWARD, Thomas CUMMINGS, Milton ENDSLEY Newton ENDSLEY & Henry BLAKEMORE be appointed a Jury of View to change a part of the Lewisburg road, commenceing at or near the branch south of the mill and Intersect the old road northwest of James BLACKWELLS house if in their opinion the good of the individuals (402) require it and that of the Public not injured and report to the next term October of yhis Court. John WEAVER) Appropriation vs ) Poor Hous ) On motion it is ordered by the Court that the treasurer of the poorhouse of Marshall County pay unto John WEAVER the sum of Twenty five dollars out of any moneys in his hands not otherwise appropriated the following Justices of the peace being present & voting in the affirmative, to wit, CLIFT, COOK, MAULDIN, HUNTER, EWING, LAIRD, LILLARD, HARDISON FIELD, WILSON, POWELL, HATCHETT & B. DUNNEGAN decd which report being seen was in all things confirmed and ordered to be recorded. Martin W. MOORE dec which report being seen was in all things confirmed and ordered to be recorded. Martin W. WARREN adminstrator of Mack HARRIS dec which report being seen was in all things confirmed and ordered to be recorded. On motion it is ordered by the Court that Aaron BOYD and James F. WARREN administrators of Sherwood DUNNEGAN decd pay bto M. W. OAKLEY clerk of this Court seven dollars and fifty cents fir his services as clerk of said administration in addition to the fees heretofore paid. Paid by James F.
