Monday Morning November 5th 1838 Court met according to adjournment present Asa HOLLAND Thomas WILSON and James V. EWING Gentlement Justices of the peace Proclamation &C. On motion it is ordered by the Court tha the Court that Squire LARENCE be appointed overseer of the Columbia road in room of William BARRON, commencing at Saluel McCONNEL and terminating at Hiram WILSONS and that he have the former hands to work on said road. On motion it is ordered by the Court that Daniel DAVIS Jr. be appointed overseer of the road from the big lick to Stephen PORTERS. John SCOTT administrator of the estate of Elias SCOTT deceased appeared in open Court and returned an inventory and account of sales of said estate which was ordered to be recorded. (201) November term 1838. George R. PATTERSON administrator of the estate of Joseph M. STREET dec. appeared in Court and returned an additional account of sales of said estate which was ordered to e recorded. Henry B. ERWIN appeared in open Court and was thereupon appointed Guardian for Senah Elizabeth Porter ERWIN minor orphan of James P. ERWIN decd. He given his bond in the sum of one thousand dollars with John ELLERSON and Wm. F. ERWIN his securities which was accepted by the Court. Martin W. OAKLEY clerk of this Court Exhibited in open Court an account of a settlement made y him with Thomas H. HARDIN Guardian of Elizabeth Jane WOODLY for the year 1838 which report being seen and by the Court under stood was in all things confirmed and ordered to be recorded. Martin W. OAKLEY clerk of this Court y his deputy William WILLIAMS Exhibited in this Court an account of a settlement made by him with James P. DYSART guardian of the minor heirs of John DYSART decd for the year 1838- which report being seen and by the Court understood was in all things confirmed and ordered to e recorded. James BROWN and Daniel BIVENS administrators of the estate of John M. HOUSTON decd appeared in open Court and returned an additional account of salesof said estate which was ordered to be recorded. The commissioners appointed at a former term of this Court to lay off one years provision for Polly Ann SCOTT the widow od Elias SCOTT deceased reports as follows, top wit: State of Tennessee Marshall County. In pursuant to an order of the County Court of Marshall County August (202) term 1838 we the undersigned Commissioners after being duly sworn have commenced and laid off into Polly Ann SCOTT the widow of Elias SCOTT deceased as follows, to wit: Ten barrels of corn $10.00 Three hundred pounds of Pork 13.50 One hundred and fifty pounds Flower 3.75 Four dollars worth of sugar & Coffee 4.00 Fifty pounds of salt 1.25 Twelve pounds of soap 1.00 One pound of pepper .25 Given under our hands and seals this the 8th day September 1838 M. HENDRIX appeared in Court and was thereupon appointed Guardian of Edward WHOTWORTH & Sarah A. WHITWORTH minor orphans of Edward WHITWORTH deceased he having given bond in the sum of Four thousand dollars with B. F. WHITWORTH and John LAWS his securities which was accpted by the Court. John SHUFFIELD appeared in open Court and thereupon was appointed guardian for Samuel S. WHITWORTH minor orphan of Edward WHITWORTH deceased he given bond in the sum of Two thousand dollars with B. F. WHITWORTH & Elisha W. HENDRIX his securities which was accepted by the Court. Benjamin F. WHITWORTH appeared in open Court and thereupon was appointed guardian of Martha WHITWORTH Thomas B/ WHITWORTH and McEwen H. WHITWORTH minot orphans of Edward WHITWORTH decd be given bond in the sum of six thousand dollars with John SHUFFIELD and J.D.WARREN his securities which was accepted by the Court. James REED a minor orphan of the age of thirteen years was this day bound as an apprentice to James P. PARK untill he arrives at the age of Twenty one years. (203) November term 1838. Martin W. OAKLEY clerk of this Court Exhibited in open Court an account of a settlement made by him with William WILLIAMS Jr. Guardian of Robert J. BIGAMAN Isaac A. BIGAMAN Newton H. BIGAMAN minor heirs of Henry BINGAMAN dec for the year 1838. which report being seen and by the Court understood was in all things confirmed and ordered to be recorded. It having been represented to this Court that Benjamin ARTHURS has died leaving no will and Williams ARTHURS appeared in open Court and thereupon appointed Administrator, of all and singular the goods and chattles rights and credits of said deceased it is therefore ordered by the Court that Letters of administration Issue to the said ARTHURS he having given bond in the sum of one thousand dollars with Bluford ARTHURS his security which was accepted by the Court he taking the oath required by law. J. F. WARREN ad. of the estate of Mark HARRIS deceased appeared in open Court and Exhibited an account of sales of said estate which was ordered to be recorded. On motion it is ordered by the Court that James WILSON James SANDERS Sr., Enoch RUST Jarvis G. LOONEY James B. TALLY S. C. CHETWOOD & Squire WILLIAMS be appointed a Jury of View to turn the Cornersville & Fayetville road to intersect the Nashville road between Mrs. BEATYS and Arson GRAYS to takeing into consideration the goods of the public and that of individuals and report thereon to the next January term of this Court. James N. HUNTER appeared in open Court and resigned his commission as constable for district No.6 in Marshall county. (204) Thereupon Court adjourned untill nine o’clock tomorrow morning. WILLIAMS Gentlemen Justices of the peace proclamation &C. Thomas N. BARHAM administrator of the estate of Elizabeth CARR decd returned an account of sales of said estate to the clerk of this Court in vocation which report has this day been Exhibited by said clerk to this Court ratified & ordered to be recorded. The commissioners appointed at a former term of this Court to lay off and set apart one years provision for Martha BROOK the widow of Robert BROOKS decd reports as follows, to wit: Agreeable to an order of the honorable County Court of Sept. term 1838 Asa HOLLAND & S. C. CHETWOOD John R. BAGLEY appointed to lay off one years provision for Martha BROOKS widow of Robert BROOKS decd We have proceeded as follows to wit: all bacon on hand and beef, five shoats, twenty five bushels of wheat ten choice hogs one barrel of salt or money to by the salt seventy five barrels of corn two stacks of fodder & stack of oats one hundred pounds of shugar & fifty pounds of coffee or money to buy the same all Cotton on hands all the wool and rolls on hand one pound of pepper & one pound of spice or money to purchase it two sidees of upper Leather & one side of soal leather or money to by the same one pound of finger or money or money to buy it all the lard in the stand in the smoke house.
