ALLEN be appointed a Commissioner for the Bridge on Duck river in room & stead of Joesph ROSSON Deceased McLEAN & Aaron BOYD, two of the Commissioners appointed at a former term of this Court, to superintend the construction of a bridge across Duck River made the following report to wit: We the undersigned having been appointed Commissioners on the part of this Court to let out to the lowest bidder the building of a Bridge across Duck River near the mouth of Rock Creek report that they could not let the same out with double tracks at the amount specified in the order they ever advised that they should let the same out with a single track which they did- to the lowest bidder for the sum of $4982 to John CRAWFORD and Samuel WINSTEAD which is respectfully submitted & prayed to be confined by this Court- this contract does not include the covering of the bridge the one half of the bid is to be paid first Oct. 1839 and the othe r twelve months thereafter. McLEAN And the said commissioners further representing to the Courtthat they had made a conditional contract subject to the ratification of the Court to have said bridge covered for two thousand dollars more. It is therefore ordered by the Court that said commissioners proceed to close said contract to ha ve said bridge built for the total sum of six thousand dollars to be paid (six thousand nine hundred and eighty two dollars) to be paid one half on the first of October 1839 and the other half on the first of October 1840, so that the bridge will be substantially built and covered for six Thousand nine hundred and Eighty two dollars to be paid by the County of Marshall, as above. The Commissioners appointed at a former term of this Court to set apart one years provision for Jane L. HOUSTON widow of John M. HOUSTON Decd. reports as follows - Report of the commissioners- We the undersigned free holders of Marshall County after having been duly sworn have proceded to set apart to the widow of John M. HOUSTON Dec. so much of the crop and provisions as will support her family one year from the death of her said husband we set apart to her for said purposes the following articles (to wit) corn 30 Barrels wheat 3 Barrels Bacon 100 lbs. ROSSON and Andrew ROSSON minor orphans of Joseph ROSSON deceased and executed his bond in the sum of Eight thousand dollars with O. ROSSON and John ROSSON his s ecurities conditioned as the law directs. (188) Josiah BLACKWELL appeared in open Court and was thereupon appointed Guardian to Mary Orson BLACKWELL and Martha BLACKWELL and executed his bond in the sum of Twenty Thousand dollars with John BLACKWELL his security conditioned as the law directs. Thomas ROSS administrator of estate of Levi HILLIS deceased Presented in open Court an account of sale of the Personal propeety of said e state which was ordered by the Court to be entered on Record. Mary F. BILLS administratrix and Alfred F. BILLS deceased presented in open Court an inventory of goods and Chattles Rights and credits of said Estate which was ordered by the Court to be entered on Records. Daniel BIVINS and James BROWN administrators of John M. HOUSTON deceased presented an account of sale of the personal property of said estate which was ordered by the court to be entered on Record. Martin W. OAKLEY clerk of this Court by his deputy Wm. WILLIAMS presented an account of settlement made with Levi COCHRAN Guardian of Andrew BIVINS which was seen by the Court and in aal things confirmed and ordered to be entered on record. (189) William WILKS administrator of Janes WILKS deceased presented in open Court an account of sales of the personal property of said estate which was ordered by the court to be entered on Records. On motion it is ordered by the Court that Josiah BRECHEN John MILLER Vincent B. MARTI James DYSART Alexander DYSART and Thomas NOWLIN be appointed a Jury of view to lay out and mark a Road view commencing at or near John CHRISTOPHERS old place and running toward Shelbyville through the neighbor bour hood OF Wm. MARTIN John R. ERWIH so as to strike the Bedford County line between the Plantations of John NOWLIN and John LARENCE and maek report thereon at the next January term of this Court. Issued. DAVIS be appointed a Juror of view to lay off and mark out a road from Petersburg to Wm. CARUTHERS and report thereon at the next January term of this Court. Issued On motion it is ordered by the Court that Joseph McADAMS be appointed overseer of the Road commencing at the ridge west of RANKINS oldshop and terminating at the big Lick and that he have the hands that worked under James L. WOODS the former overseer. Issued On motion it is ordered by the Court that William ARTHUR to be appointed overswwe of the road from Wm. COLEMAN to Arter Lane and that he have the hands that that worked under Joseph HACKNEY the former overseer. Issued. (190) A juror of view appointed at a former term of this Court to cange a part of the Shelbyville and Pulaski Road which run through Benjaman Land reports as follow. We the undersigned Jurors summoned and sworn to change the within named road where it passes throught Benjamin BENGAMANS improvement do agree that the same be changed so as to include his stable in his gross Lot Beginning at the end of his corn crib and run thence to his fence twenty pannels from the S. BINGAMANS to David McGAHEY reports as follows- We the undersigned Jurors summoned and sworn to change a part of the publick road leading from Lewisburg to Fayetteville by Reeds gap at a certain place designated in the within order if the good of the individuals require it and the publick convenience not injured thereby have this day enamined the proposed rout and do agree that the propsed road be changed leaving the present road at the lane between David McGAHEY and Benj. BINGAMAN passing through James WHITSETT land and intersect the road at the north East corner of Alexander BIGGERS plantation it being the way now established and on nearly as good ground. SMITH Robrt WRIGHT thence with it River yo Halls ford and that Gideon FOX be appointed overseer of said road. Issued On motion it is ordered by the court that there be a Sledge Hammer and crowbar allowed for the road leading from berlin to the Murray County line and that the County Trustee pay for the same out of any money his hands not otherwise appropriated and that Henry S. WILSON contract fro the same. On motion it is ordered that Johh H. BRECHEN contract for a sledge for the use of the road from Lewisburg to John W. RECORD and that the County further pay for the same out any money in his hands not otherwise appropriated. Samuel RAMSEY presented the following petitions in open Court which was duly proven to be executed by Rebecca COLLINS by the oaths of Andrew DYSART and David RAMSEY subscribing witnesses thereto. To the worshipful Court of Marshall County whereas about June 1837 your petitioner being in a bad state of health and not able to provide for her children did request your worships to bind her daughter to Samuel RAMSEY until she arrives at the age of twenty one since that time my health is some what improved and I am desirous of having the company and assistance of my daughter and that said Sameul RAMSEY is willing to let her return and live with her as before I do therefore request of your worships that you will release said RAMSEY from the bond that he has gicen to your worships and that the same will be null and void and your petitioner as in duty bound will ever prayOct 1st 1838. her mark Test: Andrew DYSART Rebecca X COLLINS David RAMSEY (192) October Term 1838. Which petition was seen and duly considered by the Court and by the Court fully concured and ordered that Samuel RAMSEY be released from his said bond. Charles H. WOLFE a minor orphan was thus bound unto Robert DRYDEN as an apprentice until he arrives at the age of twenty one years. Martin W. OAKLEY clerk of this Court presented in open Court an account of a settlement made with Jason B. SHUFFIELD Guardian of Rebecca CARUTHERS minor heir of Robert CARUTHERS which was seen by the Court and fully understood and ordered by the Court to be entered on record. On motion it is ordered by the Court that M. C. JOSE John W. RECORD and B. WILLIAMS be appointed Trustee for the Lewisburg Academy to fill the vacancies occasioned by the resignation of Wm. Basil B. RANEY appeared in open Court and was thereupon appointed guardian of Emily J. CLIFTS and Sarah Ann CLIFT and executed his bond in the sum of Two thousand dollars with Isaac N. RAINEY and Grant J. ALLEN his securities which was accepted by the Court. On motion it is ordered by the Court that John HENLEY be appointed overseer of the road leading from Shelbyville to Columbia on the north side of Duck river Beginning at the Bedford County line runign west to where the Murfreesborough Road crosses the same. Issued. On motion it is ordered by the Court that John LUMSEY be appointed overseer of the Road from where the Murfreesborought road crosses to George CALHOONS land. Issued. (194) October Term 1838. On motion it is ordered by the Court that George R MAY be appointed overseer of the road from George CALHOONS Lane to Caney Springs. Issued. On motion of the Court it is ordered that James PATTERSON Esqr. H. O. GILLAM and Joshua WHITE be appointed Commissioners to assign hands to Joshua HENLY John LUMSEY and George R. MAY overseers of the Shelbyville road on the north side ofDuck River and report the same to the next January Term of this Court. Issued. The Juroy of view appointed at a former term of this Court to lay off and mark out a road from WILLIAMS Mills on Duck River to Lewisburg reports as follows (to wit) The undersigned freeholders having been duly sworn as a jury of view to lay out the road as described in the annexed order have proceded to purform the duty assigned them and do agree upon and make the following report, to wit: the said road shall begin at WILLIAMS Mill on Duck River running southward to learn all Fanning JONES Plantation to the west and cross Rock Creek at what is Known by the name of the fish trap Shole just below HUNTERS Mill thence a little east of south to John FISHERS leaving his plantation and house on the west to intersect and the fishing ford Road at Halls Camp ground near Jane EWINGS Esqr. We have thus layed out the road to the greatest advantage of the inhabitants and as little as may be to the prejudice of inclosures to the best of their Knowledge and skill all which the respectfully submitted to the consideration of the worshipful Court. APPLEBY be appointed overseer of the road from WILLIAMS Mills to Hall Camp ground and that he have the hands in the following bounds to wit: Beginning on the south bank of Duck Ri verat the mouth of Rock Creek thence running up the west fork of Rock Creek to McMURRY Mills thence east with the Columbia road to the cross road at James EWINGS thence with the fishing ford and Lewisburg road to Jonathan THOMAS Thence north so as to include John DERGNEYS old place thence to David CHRISWELLS so as to include said CHRISWELL thence north to Duck River so as to include all the improvements of John J. JONES thence down the river to the beginning. Issued On motion it is ordered by the Court that Wrught LUNA be appointed overseer of the Road that he have the hands in the following Bounds all the hands from John MURDOCKS up Swan Creek and Down Cave Creek to James BARNES. Issued. On motion it is ordered by the Court that Darel D. HOLT be appointed overseer of the Road beginning at the County line near Esqr. HOLTS Miles and terminating at the 16 mile post and that he have all the hands that worked under tha former overseer. Issued. (196) October term 1838. On motion the Court proceded by Ballot to Elect our Coroner and one Ranger for the County og Marshall for the two next ensueing years and after counting out the votes, Joseph McCORD was duly elected Coroner and Isaac H. WILLIAMS Ranger for the county of Marshall for the next ensueing years. ADAMS James REED James V, EWING Gent Justices Proclamation &C. On motion the Court adjourned to meet at the Courthouse. The Court met at the Court house present as before. The last will and testament of Joseph ROSON Esqr. was duly proven in open Court on Monday last by James PATTERSON one of the subscribing witnesses and upon suggestion to the other subscribing witnesses was sick but would be very likely to be in Court that wvening when his evidence could be taken, letters Testamentary were granted to John ROSSON and Osman ROSSON the executors named in the will who entered into bond with William ROSSON and Andrew LAIRD their securities who were approved by the Court and Leonard BULLOCK the other subscribing witness not appearing in Court to test, said will not bearing contested and the Court being of opinion that in such cases one witness is competent to prove a will it is therefore ordered by the Court that saud will be recorded. On motion it is ordered by the court that Michael ROBINSON Grant I. ALLEN and Aaron BOYD be appointed commissioners to lay off to Rebecca D. ROSSON widow of Joseph ROSSON deceased one years provision according to the will of Joseph ROSSON her late husband deceased and report to the November term of this Court. Issued. Joseph McCORD who was on yesterday elected coroner for Marshall County for the next two years ensueing appeared in open Court and executed his bond in the words and figures following to wit: Know all men by these present that we Joseph McCORD and John R. HILL & S.W. BEATTY are held and firmlybound unto Newton CANNON governor in and over the state of Tennessee and his successors in office in the sum of twenty five hundred dollars to be levied of our goods and chattles hands and tenements for the payment of which will and truly to be made we bind ourselves and our heirs executors administrators or assigns severally and jointly by these presents sealed with our seals and dated this 2nd day of October 1838. The condition of the above obligation bond is such that whereas the above bound Joseph McCORD has this day been elected Coroner for the County of Marshall for the next ensueing two years. Now if the said Joseph McCORD shall well and truly executor and perform all the duties imposed on him as coroner by law for the County of Marshall then this obligation to be void otherwise to remain in full force and virtue the day and date above written. BEATTY (seal) Which bond and securities are approved by the court and the said Joseph McCORD took all the oaths required by law for a coroner to take Isaac H. WILLIAMS who on yesterday elected rangers for the County of Marshall for the next ensueing two years, appeared in Court and brought with him his bond as Rangers which is in the words and figures following to wit: Know all men by these present that we Isaac H. WILLIAMS John R. HILL & Williamson SMITH are held and firmly bound unto John HATCHETT Chairman of the CountyCourt of Marshall County and his successors in office in the sum of five hundred dollars to be levied of our goods and chattles lands and tenements for the payment of which sum we bind ourselves our heirs executors and administrators firmly by these present Sealed with our seals and dated this 3rd day of October 1838 The condition of the above obligation is such that where as the above bound Isaac H. WILLIAMS hath been duly and constitutionally elected Ranger for the County of Marshall for the next two ensueing two years. Now if the said WILLIAMS (200) Shall well and truly Execute all the duties imposed on him by law as Ranger as aforesaid then this obligation to be void otherwise to remain in full force and virtue this day and date above written.
