Elias ALEXANDER appeared in Court and was thereupon appointed Guardian of Elizabeth Thos J. and John ALEXANDER minor orphans of Arthur ALEXANDER decd who Executed his bond in the sum of Fifteen hundred dollars with John ALEXANDER & John B. FOWLER his securities which was accepted by the Court, Andrew LAIRD appeared in Court and was thereupon appinted Guardian of Joseph Alexander ROSSON minor orphans of Joseph ROSSON decd who Executed his bond in the sum of Fifteen hundred dollars with L. BULLOCK & Andrew COLE his securities which was accepted by the Court. It having been represented to the satisfaction if this Court that Joseph L. MARTIN a resident of Marshall County has died leaving no last will and testament and John F. MARTIN appeared in Court and made application for letters of Administration ofall and singular the goods and chattles rites and credits of him the said Joseph L. MARTIN and he having executed his bond in the sum of Two thousand dollars with Joseph W. WINSTON and Charles HARDISON his security the same is granted. It is therefore ordered by the court that Letters Issue accordingly, he takeing the oath prescribed by law. It having been represented to the satisfaction of this Court that Henry S. WILKS a resident of Marshall County has died leaving no last will and testament and George CAVENER appeared in Court and made application for letters of Administration of all and singular the goods and chattles rites and credits of him the said Henry S. WILKS and he having Executed his bond in the sum of six hundred dollars with William WILKS & Burwell WILKS has security the same is granted. It is therefore ordered by the Court that Letters Issue accordingly he takeing the oath prescribed by law. (298) October term 1839. It haveing been represented to the satisfaction of this Court that Abram PARRISH a resident of Marshall County has died leaving no last will and testament and Garland PARRISH appeared in Court and made application for Letters of administration of all and singular the goods and chattles rites and credits of him the said Abram PAARISH and he having Executed his bond in the sum of fifteen hundred dollars with Jesse MORTON and Jeremiah HOLT his securities which was accepted by the Court, it is therefore ordered by the Court that Letters Issue accordingly he takeing the oath prescribed by law. The last will and testament of William COWDEN deceased was this day proven in open Court by the oath of William L. McCLELLAND and Morgan CLAYTON subscribing witnesses there to and Humphrey N. COWDEN and John F. McCLELLAND appeared in open Court and executed their bond in the sum of Twelve thousand dollars with John B. COWDEN and William L. McCLELLAND securities, which was accepted by the Court it is therefore ordered by the Court that Letters testamentary Issued accordingly they takeing the oath prescribed by law. Martin W. OAKLEY clerk of this Court presented to this Court an account of a settlement made by him with William D. EWING and James L. WOOD Executors of the last will and testament of Allen N. WOODS decd. which report being seen and by the Court understood was in all things confirmed and ordered to be recorded. The last will and testament of William ALEXANDER decd. was this day presented in open Court and the execution there of was proven by the oath of Josiah ROBBINS one of the subscribing witnesses thereto which was ordered to be filed untill the next term of this Court. Martin W. OAKLEY clerk of this Court presented to this Court and account of a settlement made by him with Levi COCHRAN Guardian of Andrew BIVINS for the year ending the 11th day of September 1839 which report being seen and by the Court understood was in all things confirmed and ordered to be recorded. (299) October term 1839. Jane E. McINTYRE a minor was this day bound by the Court to John ORR untill she attains the age of eighteen years he Executing hos bond agreeable to law which was accepted by the Court. Joseph H. BRITTIAN administrator of the estate of George R. SCOTT decd appeared in court and presented an Inventory of the estate of said SCOTT deceased which was ordered to be recorded. Joseph H. BRITTIAN administrator of the estate of George R. SCOTT decd. appeared in Court and presented an account of sales of said estate which was ordered to be recorded, On motion it is ordered by the Court that Hugh RAY, Jas. GINGLES, Henry MORRIS, Gideon PARNEL, Ezekial CLEEK, M. P. HENLEY and C. HARBER be appointed a Jury of view to make a road commenceing at Hiram HARRIS’s by way of John T. HARRIS’s by way of James GINGLE’s and terminateing at CHANDLERS Mill on Duck river if in their judgement the good of the public require it and that if individuals not injured and report there on to the next January term of this Court. Issued. James McCONNEL and Archibald McCONNEL who was appointed administrator of Samuel McCONNEL decd at a former term of this Court and Executed this bond in the sum of seven thousand dollars with John WILKS their security which was accepted by the Court and Squire LARUE their former security was released from any further Liability. John MILLER appeared in Court and was thereupon appointed guardian of Margaret E. WOODS, Martha Rebecca WOODS, and William B. WOODS, minor orphans of Allen N. WOODS deceased who Executed his bond in the sum of fifteen hundred dollars which was accepted by the Court. Martin W. OAKLEY clerk of this Court presented to this Court an account (300) of a settlement made by him with R. M. DRYDEN guardian of Mary A. N. DRYDEN for the year ending the 7th day of August 7th day of August 1839 which report was seen by the Court understood and was in all things confirmed, and ordered to be recorded. Hosea ARCHER a minor of the age of Eleven years was this day bound as an apprentice to Gedeon McDOWELL untill he attains to the age of Twenty one years he having Executed his bond agreeable to law. James M. RIGGS appeared in Court and presented a commission from the Govorner of the State of Tennessee commissioning him as Justice if the peace for Marshall County whereupon the said RIGGS took the several oaths prescribed by law. James McCONNEL and Archibald McCONNEL administrators of the estate of Samuel McCONNEL deceased appeared in Court and returned an Inventory and account of sales of said estate which was ordered to be recorded. Alexander DYSART and Milton B. HUNTER administrators of the estate of Edwin C. HUNTER deceased appeared in Court and presented an Inventory & account of sales of said estate which was ordered to be recorded. On motion it is ordered by the Court that Richard McREE Joseph J. BROWN, Robert ELLIOTT, William McCORRY, John PORCH and James HARRIS be appointed a Jury of view to change the a part of the Fayetteville road that runs by the arm of William ROSSONS if in their opinion the good of the individuals require it and that of the public not injured and report thereon to the next January term of this Court. Issued. Thomas H. ALLISON administrator with the will annexed of the estate of James ALLISON deceased appeared in Court and presented an Inventory of said estate which was ordered to be recorded. Benjamin F. McINTYRE a minor of the age of seven years was this day bound as an apprentice unto Eunice CUMMINGS untill he attains the age of Twenty one years she having Executed her bond agreeable to law. A Jury of view appointed at a former term of this court to turn that part of the Lewisburg road that runs through Erwin McADAMS land report as follows to wit,Sept. 28th 1839, We the Jury of View after having duly sworn to let the road named in this order stand where it already Runs. Jonathan SMITH one of the Executors of Nathaniel SMITH decd appeared in Court and returned an Inventory of said Estate which was ordered to be recorded. On motion it is ordered by the Court that Jas. OLD John McDANIEL, William CARR, Charles HARDISON, Humphrey HARDISON, Henry MORRIS, Brevard HUGGINS be appointed a Jury of view to change the Franklin road so as to cross Duck river below HARDISONS & ALDRIDGES Mill if in their opinion the good of the individuals require it and that of the public not injured and report to the next January Term of this Court. Issued. The commissioners appointed at a former term of this Court to lay off and one years provision for the widow of B. JONES decd reports as follows to wit, Marshall County Tennessee. We the undersigned commissioners appointed by the county Court of Marshall County Court of July term 1839, do lay off and set apart to Winnyford JONES widow of Benton JONES deceased for one years provision one hundred and one dollars Sept, the 28th 1839. On motion it is ordered by the Court that William DAVIS be appointed overseer of the road in the room of James McKNIGHT and that he have all the hands on the McKnight Branch & the dividing ridge between Richland and Cane Creek so far south as will include the farms of James CAMPBELL and Squire WILLIAMS. Issued. The Jury of view appointed at a former term of this Court to change a part of the Cornersville and Fayetteville road that runs through John CAMPBELLS farm reports as follows to wit, We the undersigned Jury after having summoned & sworn according to law have proceeded to Examine sd road and has turned said road commenceing at a line tree Leaving sd. farm on the west and intersecting the old road at a beach. On motion it is ordered by the Court that Jackson SMITH be appointed overseer of the Halls ford road commenceing at Thos. N. BARHAM’s and terminateing at Halls ford and that he have the hands in the following bounds to wit, Col. John WEBS hands, Capt. SMITHS Robert WRIGHT thence with the river to Halls ford. Issued, On motion it is ordered by the Court that Jacob J. CALHOUN be appointed overseer of the road in the room of Charles NEAL andthat he have the hands in the following bounds, to wit, beginning at the corner of John ROBINSON’s field on (304) said- running west to John EPLEYS thence to John HARRIS thence to the widow HOGGS thence to Pinkney HOGG’s thence to Thomas McCALLS thence to Charles NEALS and that he have all the hands in said bounds. Issued. James HUNTER was appointed a special administrator of the estate of Christopher HOUSTON decd filed a bill against said James HOUSTON for the effects in his hands and it appearin his to the satisfaction of this Court that said secrt. was compromised and a great protion of said effects have come to the hands of said Executors it is therefore ordered that said James HOUSTON be released from any further responsibilities by virtue of sd. appointments. On motion it is ordered by the Court that Elisha GARRETT be appointed overseer of the road leading from Lewisburg and terminateing at the dividing line between the Lewisburg and Williams District and that he have the following hands to wit, Wesley A. GILES, Simeon GARRETT, Elisha GARRETT, John McDANIEL Avary MUSTEEN, Elizabeth DIVENS 2 hands Williams BATHEW Jas. A. DIVEN and all the hands in the above bounds. Issued. A jury of view appointed at a former term of this Court to change a part of the Nashville road, commenceing at CLEEKS field and terminateing at or near Hiram HARRIS reports as follows, to wit, The undersigned being appointed and sworn to view and determine on the propriety of Turning that part of the public road leading from the county line CHANDLERS Mill over which Lewis TAYLOR is overseer do report that in our opinion the said road ought to be changed as follows, to wit, beginning at the corner of William CLEEKS field runing north to the creek and intersecting the old road thence with said road tot the Corner of Hiram HARRIS Lot thence west with said lot to a dogwood thence north to a black and ash and Elm to the old road which is respectfully submitted to theconsideration of the Court this 18th day of Sept. 1839. This day came James HUGHES into open Court and acknowledged that a power of Attorney Executed toJoel S. HUGHES on the day of October 1839 whereby the said Joel S. HUGHES is empowered to review and receipt for my portion out of the estate of one Rebeca FLEMMING decd late of Pennsylvania Lancaster County is his act and deed for the purposes therein sontained. On motion it is ordered by the Court that Wynn TWITTY Robert BIGGERS James McGAHEY James WHITSETT William COOK Biggers ALEXANDER be appointed a Jury of view to change a part of the Richland road so as to enter Samuel S. RALSTON’s field at the lower Corner of his yard and run near South direction to the Creek if in their opinion the good of the individual require it and that of the public not injured and report thereon to the next January term of this Court. Issued. On motion it is ordered by the Court that Henry B. ERWIN Ebenezer NEWTON, Peter CARPENTER, Josiah BRECHEEN, Rpbert MONTGOMERY & Robert PATTERSON be appointed a Jury of view to assess damages to James ADAMS & Andrew DYSART in consequence of a road marked out from John CHRISTOPHERS old place to the County line near John PATTERSONS if in their Judgement they have sustained any damages or turn said road some other route if in their opinion the good of the public require it and report thereon to the next January term of this Court. Issued. The bond of Samuel WINSTEAD, Sherwood W. BEATY, A. M. MCLEAN and Stephen W. RAINY for their faithful performance for building a Bridge on Duck River was proved by George H. ALLEN and ordered to be filed. (306) The noncupative will of Nathan LUNN was brought into Court and duly proved according to law by Thomas HOPPER AND Nathaniel A. LUNN and ordered to be recorded. Poorhouse ) It is ordered by the Court that the Treasurer of the vs ) Poor house pay for the following articles for the Marshall County) Use of the poor house out of any money in his hands not otherwise appropriated to wit, for 1 doz chickens $1.00 for sugar & coffee 2.75 for cow & calf 12.00, sow and pigs 5.00 moving Mrs. MAYS 1.00, about 50 lb. Issued. B. WILLIAMS Chariman William WILKS (308) Wednesday Morning October 9th 1839 Court met according to adjournment present Benjamin WILLIAMS Chairman Burhess HARDEN Thos. WILSON, and Williams WILKS, Gentlemen Justices of peace proclamation &C. The following proceedings ware had Upon a former day of this Court James C. RECORD and John R. HILL Executors of the last will and Testament of Richard HILL decd came into Court and stated that they had wound up the said estate of Richard HILL deceased and prayed to be discharges and it appearing to the satisfaction of this Court that Amanda Jane HILL Mary Eliza WEBSTER Tally Harriet HILL, Martha Wilkins HILL and William Jasper hill, Children of Robert W. HILL are minors and devises and heirs under the will of said Richard HILL deceased and said Robert W. HILL the father of said minors being claaed to enter into the guardianship for said minors, and no other person coming forward to act a guardian. It is therefore considered by the Court that said RECORD and HILL be discharged form any other liabilities as Executors aforesaid and that the Clerk of our County Court Martin W. OAKLEY Esqr. proceed to perform the duties of guardian for the aforesaid Amanda Jame HILL, Mary Eliza WEBSTER Sally Harriet HILL Martha Wilkins HILL and William Jasper HILL A Jury of view appointed at a former term of this Court to make a road commenceing at John H. BRECHEEMS AND TO TERMINATE AT THE Lewisburg road, said order was returned to this Court with the following under indorsements thereon not attended to by order of the complaint. J. R. HILL shff It having been represented to the satisfaction of this Court that Joseph McKNIGHT a resident of Marshall County has dried leaving no last will and testament and Thos. McKNIGHT appeared in Court and made application for Letters of administration of all and singular the goods and Chattles rites and credits of him the said Joseph MCKNIGHT and he having Executed his bond in the sum of three thousand dollars with Russell BRIANT and E. McKNIGHT his securities which was accepted by the Court, the same is granted (309) It is therefore ordered by the court that letters Issue accordingly be takeing the oath prescribed by law and thereupon Court adjourned untill Court in Course.
