At a County Court begun and held for the County of Marshall at the house of Abner HOUSTON the place appointed by law for holding Courts in said county on the first Momday in September it being the 4th day of the month 1837. Present William McCLURE Chairman Thos. ROSS James ADAMS Ephraim HUNTER & Thos. HARDISON Gentlemen Justices of the peace. Proclimation &C. Ordered by the Court that James ADAMS Esqr received Eight dollars from the school Commissioners of Township No. 4 for Eight days services rendered by him as commissioner for said Twonship. Ordered by the court that John M. HOUSTON & Russell BRIANT, make use of the sledge hammer & Crow bare that belonged to the overseer that worked from Davis WILLIS's to James C. RECORD, and that Russell BRIANT repair sd. tools or have it done. Issued. Ordered by the court that Aaron BOYD George H. ALLEN and William NEIL be appointed Commissioners to Assign hands to work under the following overseers (to wit) John ROBINSON Marcellus COOK & John RAGSDALE. Issued. State of Tennessee ) vs ) S S Marshall County Court) September term 1837. Martin W. OAKLEY came into Court and testified to the satisfaction of the Court that they are will satisfied Sarah RANEY whose affidavit is hereunto annexed is now the widow of Isaac RAINEY deceased & that he died at the time alleged in said affidavit and the court further that George H. ALLEN & E. F. whose signature appears to said Certificate or affidavit are men of respect and Credibility. Whereupon it is ordered by the court that the Chairman sign the above Certificate officially. (56) James WILLIAMS presented a petition praying the Court to Grant him the liberty of raising his milldam across duck river higher. Whereupon it is ordered by the Court that the petitioner have the liberty of raising his dam Two feet and six inches higher than it now is, & keeping up the same for ninety nine years. Martin W. OAKLEY this day presented to this Court an account for makeing out a duplicate list of the taxable property and pools for the County of Marshall for the year 1837. And on motion the Ayes & noes were taken, Ayes, Asa HOLLAND, Thos. ROSS Andrew LARD James REED Thos. HARDIN, James L. EWING James ADAMS John CHANDLER, Ephram HUNTER & S. DUNNEGAN 10, Noes none, And it is further ordered by the Court that the County trustee of Marshall County pay to the said M. W. OAKLEY the sum of money that may be in his hands not otherwise appropriated. Issued. Ordered by the Court that Jessee STEGALL James EWING David McCLEARY James LIGGETT & John REED be appointed a Jury of review to review that part of the road that passes through David C. CRISWELLS Lot and turn said road if in their Judgement the public good require it & what of the individual and make report to the next term of this Court. Issued. Carey T. KELLY one of the administrators of the Estate of Christopher HOUSTON dcest this day Exhibited in open Court an amount of sales of said Estate whicch was received by the Court and ordered to be entered upon the records of this Court Thomas ROSS and James McCONNEL of John B. FOWLER Commissioners appointed at the August Term of this Court to set apart one years provisions for the widow of Christopher HOUSTON Dest. made the following report (57) Viz- we the undersigned Freeholders of the County of Marshall after being duly sworn have proceeded to set apart to Elizabeth HOUSTON widow of Christopher HOUSTON Dest. so much of the Crop and provisions on hand as will be sufficient in our opinion to support and her family one year from the death of her husband as set apart to her for said purpose the following articles to wit- We have 25 Barrels of Corn 400 Bundles of oats or fodder 9 Bushels Wheat 1 lb Pepper 150 lb. Bacon 1 lb Alspice 200 lb. Beef 1 lb ginger 700 lb Pork 40 lb. soap 15 lb Lard 10 lb. Tallow 25 lb. sugar 10 lb. wool Rolls 15 lb Coffee 25 lb. Ginned Cotton 150 lb. Agreeable to an order from the worshipful Court of said County to us directed to lay off or divide the hands on the roads of which John FISHER and Isaac W. WALKER is overseer to wit: To John FISHER to have Benjamin CHEEK and the hands on Co. ORRS Land on the West fork of Rock Creek the hands on J. L. EWINGS Land on the Hurricane place Wm. HELM Elihu W. HUNTER David H. MILLER Jno DENNY George CATHEYS Jonathan and Elias THOMAS and the hands on Geo. NEILLS old saw mill plantation to workon the Lewisburg road to the Fishing ford Road from Jas. EWINGS till it intersects the main Washville and Huntsville road and Isaac W. WALKER to have the following hands to work on the road from McMURRYS mill to Farminton (to wit) (58) the hands on Lile A. EWINGS Land near McMURRYS Mill J. EWINGS hands the hand which may be on Thos. HALLS land John ORRS and on BRANTLEYS plantation John REEDS the widow REEDS also the hands on Jessee STEGALLS Land and Garshow BILLS given under our hands this 4th of Septermber 1837. Jas. John ORR Ordered by the Court that Joseph McBRIDE Winn TWITTY Zachariah GARETT to be appointed Commissioners to assign hands to work under the following overseers of roads viz: Benjami n BINGAMAN Hiram TWITTY and Lewis SHAWS and make report to the next term of this ourt. Issued. Ordered by the Court that Martin EISENER, Henry BISHOP, Peter CARPENTER, Allen COFFEY and William WILLIAMS be appointed a Jury of review to review the road from the south end of Henry BISHOPS Lane to the north end of William WILLIAMS Lane west of his house and turn said road or establish the same if in their judgement the public good requires it and make report to the next term of this Court. Issued. Ordered by the Court that John ELLERSON be appointed Guardian for Elizabeth, George C. John E. Joseph, Mary, Thomas E. and Easther J. REED minor heris of Alexander B. REED deceased who gave bond with James L. EWING and James ADAMS his securities in the sum of Twenty five hundred Dollars. Issued. Ordered by the Court that John HARKNESS be appointed guardian for Nancy SMITH, Elizabeth Jane, Margaret Ann & John BUCHANAN minor heirs of William BUCHANAN deceased who gave bond with John RAMSEY and Ephraim HUNTER his securities in the sum of one thousand dolars. (59) Joab BAGLEY Exhibited in open Court his account as Guardian for the minor heirs of Patrick H. TALLEY deceased which was recieved by the Court & on motion was ordered to re recorded. It having been represented to the satisfaction of this Court that Arthur SHUFFIELD Jr late of this County hath departed this life leaving behind him no last will and testament and John SUFFIELD having applied to this Court for Letter s of administration of all and singular the goods and Chattels rights & credits of the aforesaid Arthur SHUFFIELD deceased and the Court being satisfied of his right to the same And he having entered into bond with securities approved of and accepted by the Court took the oath prescribed by law the same is granted. It having been represented to this Court that John N. STILWELL late of this County, hath departed this life leaving no last will & testament and William H. STILWELL having applied to this Court for Letters of administration of all and singular the goods Chattels rights & Credits of the aforesaid John M. STILWELL deceased and the Court being satisfied of his right to the same. And he having given bond and security approved of & accepted of by the court & took the oath prescribed by law the same is granted. Ordered by the Court that Martin W. OAKLEY be appointed to transcribe the minutes of this Court commenceing at the October term 1837 up to the March term 1837 and he is here by authorized to record all bonds that is by law directed to be recorded in a well bound book.
