Williams ROSS, SHUFFIELD & HOLLAND a committee for the purpose of comparing the votes polled for (B) clerks Sherriff Trustee & Register on the 30th day of September last recommending to the court suitable individuals to serve in the different offices above named the appointment whereof is constitutionally vested in this court-who by their chairman Asa HOLLAND Esqr. reported that John R. HILL was duly nominated for the Sherriffs appointment, Martin W. OAKLEY for County Court Clerk John W. OAKLEY presented his bond executed for five thousand dollars (D) payable to Newton CANNON Governer & his successors in office who with his securities Ephraim HUNTER, Lile A. EWING and Sherwood W. BATY appeared in open court & acknowledged the Execution thereof to be their act & deed which was accepted by the court & oaths of office administered by the chairman said bond is in the words and figures following viz: Know all men by these presents that we Martin W. OAKLEY- Ephraim HUNTER Lile A. EWING Sherwood W. BATEY are held & personally bound unto Newton CANNON Governer of the Sate of Tennessee & his successors in office in the pennel sum of Five Thousand Dollars & for the true payment of which we bind ourselves our heirs Executors & adminisrators Jointly & severly firmley by these presents sealed with our seals & dated this 3rd day of October 1836- The condition of the above obligation (E) is such that whereas the above bounden Martin W. OAKLEY has been this day constituted & appointed clerk of the county court of Marshall County. If the said Martin W. OAKLEY Shall safeley keep the records of said court pay over all the monies according to law that may come into his hands by virtue of his said office and do & perform all the duties of a clerk promptly according to law then this obligation to be void else to remain in full force & effect-In testimony whereof we have hereunto set our hands & affixed our seals the day & date above written- Martin W. RECORD appeared in open Court and acknowledged the Execution thereof to be their act & deed which was accepted by the court & oaths of office administered by the chairman-said bond is in the words and figures following viz. WILLIAMS held and personally bound unto Newton CANNON Governer of the State of Tennessee and his successor in office in the pennel sum of Twelve thousand Five hundred dollars and for the true payment of which we bind ourselves our heirs Executors & administrators. Jointly and severley firmley by these present sealed with our seals and dated this 3 day of October 1836- The condition of the above obligation is (G) such that whereas the above bounden John R. HILL is constituted and appointed Sherriff of Marshall by the county court of said County. If therefore the said John R. HILL shall well and truley Execute and due returns make of all process and precepts to him directed and pay and satisfy all fees & sums of money by him recieved or levyd by virtue of any process into the proper office, by which the same by the tenor thereof ought to be paid or to the person or persons to whom the same shall be due his her or their Executors administrators attornies or agents and in all other will truly and faithfully execute the said office of Sherriff during his continuance therein, then the above obligation to be void else to remain in full force and effect- In testimony whereof we have hereunto set our hands and affixed our seals the day and date above written. SHUFFIELD gentlemen Justices of the peace members after reading & assigning the minutes of Yesterday proceedings John ELIOTT register came into court and gave bond executed to the govorner H. for $12,000 and gave Abner HOUSTON William DAVIS and James ELLIOTT as securities who severly assigned their names in open court and who ware accepted by the court and oaths of office administered to him by William McCLURE Esqr. Chairman of our court according to law. John M. RECORD trustee came into court and executed his bond payable to Wm. McCLUR chairman for the county court of Marshall for $12,000 and gave James C. RECORD Joseph MORRIS and Jas. ADAMS as securities who severly gave their signatures for that purpose who ware excepted by the court and the oaths of office administered to him by Wm. McCLURE Chairman of Marshall County according to law. (3) The court proceeded to Elect a coroner for Marshall County and after counting out the votes it appeared that Joseph McCORD was duly and constitutionally elected coroner for 2 years for Marshall county who appeared in open court and executed their bond severly assigned Joseph McCLURE John R. HILL and Bery MOOR payable to Newton CANNON Govorner of the state of Tennessee for $1000 which was excepted by the court, the oath of office being administered according t law. The court proceeded to elect a ranger for Marshall County and after counting out the votes it appeared that Isaac H. WILLIAMS was duly and constitutionally elected ranger of Marshall county for two years who appeared in open Court and executed his bond to Wm. McCLUER chairman of Marshall County court for $500. severly assigned by himself John R. HILL and John W. RECORD as his securities which was excepted by the court, the oath of office being adminstered according to law The court proceeded to elect a surveyor for Marshall county and after counting out the vots it appeared that Hugh McCLELAN was duly and constitutionally elected Surveyor for Marshall county and after counting out the vots it appeared that Hugh McCLELAN was duly and constitutionally elected Surveyor for Marshall County for the term of four years- The court proceeded to elect an entry taker for said county and after counting out the votes it appeared that Abner HOUSTON was duly and constitutionally elected entry taker for sd. County for the Term of four years. (4) Ordered by the court that letters testamentary issu to John ELLERSON on the estate of James P. ERWIN deceased by he given bond and security for the sum of $2000 whereupon the sd. ELLERSON came into court and executed his bon sevarly assigned John ELLERSON & James L. EWING as security which was excepted by the court and took the oath prescribed by law Ordered by the court that John PUTMAN Wm. C. ALVES and Benjamin CUMMINS, be appointed commitioners to lay off one years provition for the widow of Jas. P. ERWIN Deceased. The las will and testament of John HILL Deceased was presented for recording and the execution thereof not being proven to the satisfaction of the court was not admited to record. Ordered by the court that letters testamentary issue to Jas. L. EWING on the Estate of Ezediel DANIEL Deceased by his giving bond and security in the sum of $600.00 whereupon the said James L. EWING came into court and executed his bond severally assigned james L. EWING and John ELLERSON as security which was accepted by the court and took the oath prescribed by Law. Ordered by the court that John R. JONES Sherwood W. BEATY & John CALD be appointed commissioners to lay off one years provision for the widow of Ezekiel DANIEL Deceased. (5) Ordered by the court that James OSBORNE William WILLIAMS Joel YOWEL Aaron BOYD and James C. RECORD be appointed commissioners to lay off and sell the Town Lots in the Town of Lewisburg and superintend the Erection of the public buildings and that they appear before the court on Thursday next by three o'clock P. M. and give bond and security as required by Law Ordered by the court that David McGAHEY and Asa HOLLAND be appointed commissioners to Lay off the fractional parts Districts in the fraction of Lincoln and make report to the next term of this court. Issue Ordered by the court that the fraction of the destricts No. 3 in the fraction of Maury compose one Destrict Ordered by the Court that Samuel VESS B. P. RAINEY and Andrew LAIRD be appointed commissioners to examine the situation of the fractional part Districts on the North side of Duck River and report to the next term of this court Issued Ordered by the court that Robert MARSH be appointed overseer of the Fayettville road commencing at Globe creek and terminating at Samuel M. CONNELY and that he have all the hands who worked under John B. CRAFTON former overseer-Order Issued (6) Ordered by the court that Henry BRAY be appointed overseer of the Columbia road commencing at Silver Creek and terminating at John W. RECORD and that he have the former hands, that worked on said road-order Issued-Ordered by the court that Thos. HILL and Thos. ROSS his securities who was accepted by the court, & took the oath required by law. William WILLIAMS appointed one of the comitioner to lay off and sell the lots in the town of Lewisburg & superintend the Erection of the public buidlings, came into open court and Executed his bond payable to William McCLURE chairman and his successors in office for ten thousand Dollars severly assigned William WILLIAMS Robert WILLIAMS and Robert McCRORY his securities who was accepted by the court and took the oath required by law. The court proceeded to Elect a chairman whereupon William McCLUER was duly and constitutionally Elected chairman for the present year 1837. It having been suggested to this court that the old counties from which Marshall County has been detached has expressed a disposition to refund unto Marshall County the amount of county taxes paid by the citizens of Marshall County in the respective fractions into the treasury of their respective counties. It is therefore ordered that Joseph ROSSON William McCLUER & James L. EWING Esqr of the Bedford fraction William WILKS John VINCUNT and Thos. WILSON Esqr. of the Maury fraction and Asa HOLLAND Robert JOHNSON and David McGAHEY Esqr. of the Lincoln fraction be appointed commissioners on the part of the county of Marshall to make such arangement with the county court respectively or such commissioners as they may appoint for that purpose and do all other things touching the premicas as will be calculated to affect the refunding of the said monies to which the county of Marshall conceives herself justly entitled. (59) It is made known to this court that Mary GRAVES of this county is an idiot whereupon it is ordered by the court that the Sherriff of Marshall County be required summon a Jury consisting of Twelve free holders to ascertain by inquisition such idiocy or lunacy and make return to the next term of this court & also such lands and chattles if any there be as the said idiot lunatic so found as aforesaid shall hold or possess at the time of takeing such inquisition. RECORD & Ezekiel McKNIGHT his securities which was accepted by the court. The committee appointed to draft a plan for the erection of the public building in the town of Lewisburg report as follows (to wit) To the Worshipful The County court of Marshall County, We a part of the committee appointed by your worships to digest and report a plan for a court house and Jail for Marshall County in obedience thereto report as follows Viz - After collecting all the information within our power with regard to the structure of such buildings both for the cheapness neatness convenience and dureability & after given the subject its due consideration in every other respect have come to the conclusion that the court house & Jail in Bedford County are the best Models we can select for said buildings in Marshall County and accordingly recommend them to your worships (62) as such with the following alterations therein Viz. We recommend that the court house shall be of the same width as the court house in the town of Shelbyville & two feet longer than said court house so as to admit a passage of ten feet between the clerks rooms and the court room - The partition between the court room & passage to be of plank & the partition between the clerks rooms & the passage to be of Brick-leading through the aforesaid passage into the court room at each end of which passages there shall be an arched door with folding Shutters All the rooms below to be as hear the same size of those in the Bedford Court house as practicable after allowing the passage of ten feet aforesaid & all the rooms above to be of the same dimensions as those in the Shelbyville court house as near as practicable the court housae to be finished off in the same manner in every other respect like the Shelbyville Court house or modified according to the tast or descretion of the commissioners the full and true dimensions of which we will be enabled to lay before your worships at the next term of your worshipful court as we have the promise of a Gentleman of Shelbyville who can be relied on that the same shall be forwarded so soon as General Robert CANNON shall return from Mississippi with all the costs & expences attached thereto we further recom- (63) mend that the Jail shall be constructed of the same materials & of the same dimensions as the Jail in as set fourth in paper marked A. and mad a part of this report in every respect except the dungeon windows which may be only twelve lights each eight by ten inch glass with four different sets of Iron grates in each window a little larger & Stronger than those in the Shelbyville Jail We cannot at present suggest or recommend any other alterations or additions to either the court house or Jail than those already offered unless it might be a picketing wall of Ceder logs around the Jail about fifteen feet high with one end sharpened & the other let into the ground and made fast which we leave as a matter altogether descetionary with the court and County commissioners All of which is respectfully submitted &c. 2 Jan. 1837 G. ROSS William WILLIAMS (64) A Draft of the Shelbyville Jail The full length to be fifty feet its full width twenty six feet to have a passage six feet wide in the clear in or near the middle of said building. The hous to stand east and west in its greatest length twenty six feet Square on the east and to be two bricks thick the balance of the house to be one and a half brick in thickness. The partition walls on each side of the passage to be brick and a door at the South end of the passage the other end to be closed one sash of ten by twelve inch lights above the door to extend across it secured by an iron grate of the same size three doors and two windows in the ground room of the Jailers room & four windows in the upper room of the Jailers part a plain pare of stairs to lead from the ground floor to the upper room in the Jailers house the windows in this part eighteen lights of eitht by ten lights a chimney with two fire places in the west end or the Jailers part Viz. One below & one above said room to be plastered and have chair & wash boards & to have a plain chimney place to each fire place thee floors in this part to be of yellow poplar & the whole to be finished in a plain grooved the cornice of the whole house to be made of brick in the usual manner of such cornice the Dungen or lower room in the east end of the house is to have two windows opposite to each other one on the north and the (65) other on the south side three grates in each and a sash on the outside of fifteen lights eight by ten inch glass two walls of logs on the inside of the brick wall with the space of eight inches between the said walls to be made of hewn timber laid close the logs to be ten inches Square the space between the walls of logs to be filled with large rocks made square and put up edge wise the iner wall to be good sound oak logs & to be sealed all over & around with good seasoned oak plank two inches thick to be the length of the highth of the room & to be well pened to the wall to be put on before the floor is laid & extend from the top of the room to the sleepers to be Jointed and laid down close the floor to be laid of sills twelve inches square & hewed & laid close upon which two inch oak planks wee seasoned are to be Jointed & laid close & well pened to every sill the Joists of Dungeon to be of the same materials and kinds as the floor planks on sides and floor to be of the same kind and well pened & not exceed ten inches in width the pens to be driven not less than six inches deep in each log or sleeper the grates to be the size of twelve light glass sash eight by ten inches the room above the dungeon to be finished in the same way as the dungeon except is to be but one wall of logs & but one grate in each window also the ceiling above may be fastened to the Joists with nails or pins at the option of the undertakers The pins to be oak & well seasoned & not less than one and a quarter inches in diameter one pare of stairs or (66) steps To run from ground floor to the upper floor at the closed end of the passage floors to be laid above & below & in the passage the doors in the Jailers part to be common pannel doors & of the usual size the doors or Shutters for Dungeon & locks for the same to be of such dimension & description as the commissioners may direct or the doors or Shutters of the dungeon to be composed of Sheet Iron one half inch thick with three hinges of sufficient Strength to support said doors all to be well braced with Strong bolts & grates the foundation to be raised with large rock well laid so high that the brick will in no place be nearer the ground than one foot the whole of the brick to be of first rate quality & lade in lime morter the lower rooms the be nine feet in the clear & the upper rooms eight feet the fier places to be supported by iron arches & the whole work to be done in a workman like manner.
