HILL My notes/comments in square brackets, *= unknown character Comments/corrections to dkhil@aol.com TSLA MICROFILM #73, FILE 1 TURNER, Nancy,(Widow of John HILL) Pet. for Dower 27 Mar. 1837 Page 1 To the Circuit Court for the county of Marshall The petition of Nancy HILL widow of John HILL represents that her husband John HILL lately died in the County of Marshall seized of a tract land containing about two hundred and fifty acres lying on Silver Creek in Said county of Marshall being the same land on which said John resided at the time of his death and which is bounded by the land of Gideon HARRIS on the south- David FAWCET on the west, David HARRIS on the east and Alexander FAWCET on the north- Petitioner also represents that said John HILL before his death made his last will and testament which has been regular proved and recorded in the clerks office which will be produced as the Court shall direct of the County Court, for Marshall County wherein he devised Said land subject to the dower right of Petitioner to his children Ava MITCHALL wife of Lessenbury MITCHELE of Shelby county, Stephen HILL and Moses G. HILL and William HILL of Rutherford county Tennessee-Roda FOWLER wife of John FOWLER of Marshall county who are of lawful age and to John HILL, Franklin HILL and Claibourne L. HILL who are minors and have no guardians of Said Marshall county and to Sally and Susan ARNOLD who are minors and residents of the state of Illinois and grand children of said John HILL and petitioner. Petitioner represents that she has had no dower Page 2 assigned to her out of the above tract of land or other land of her said husband. And it further appearing to the court that the Said John HILL died siezed & possessed of the several following tracts of land & [?] of which are as follows--Beginning at an ash Samuel POLK's north West corner, running South 18 poles to a stake, thence West 105 poles to an ash, thence north 162 poles to an ash & cedar; thence East 60 poles to a spanish oak, thence South 104 poles to a sugar tree, thence East 53 poles to two ashes--thence North 16 poles to two spanish oaks-thence East 69 poles to a spanish oak; thence South 60 poles to an ash - thence West 77 poles to the beginning- containing 104 acres--One other, beginning at a sugar tree, the S. E corner of Benjamin MOONEY's 35 acre tract, thence north 66 poles to an elm & hickory, thence East 70 poles to a hickory, thence South 34 poles to a spanish oak in the north boundary line of a twenty acre Entry in the name of HARRIS, thence West with his line 20 poles to a rde oak his corner, thence So. with his line 32 poles to an elm, thence West with MOONY's line to the beginning-- containing 24 acres- One other Beginning at a stake, on the East boundary of a 2000 acre grant No.111- thence north with sd. East boundary 82 poles to two cedars & a small lin**, thence West 58 poles & whulf[?] to a cedar, thence So. 82 poles to a hickory & cedar, thence East 58 1/2 poles to the beginning. containing 30 acres - One other, beginning at a stake in a field 133 3/4 poles South of the north East corner of a tract granted to James PATTEN, & Andrew ERWIN, thence north 2 [degrees] 40' East three poles sthrw[?] tently[?] to an elm, thence north 87 [degrees] 20' West 97 4/10 poles Page 4 to a cedar, thence South 2 [degrees] 40' West 8 poles to another cedar stake, thence East with the South boundary of Said grant 97 4/10 poles to the beginning - containing 3 1/2 acres - One other, beginning at an ash (marked as a corner) running west with PATTEN & ERWIN's South boundary line 136 poles, walnut & red oak - thence South 57 poles to a cedar, thence East 37 poles to a stake, thence South 12[or 15] poles to a walnut & cedar, thence East 108 poles to a dogwood, thence north 76 poles to the beginning, containing 60 acres--. One other, beginning at a stake 20 poles north of the South East corner of the tract on which said HILL lived, thence East 30 poles to an ironwood, thence north 96 poles to a stake, thence West 67 poles 8 links to a small walnut, thence South 60 poles to a stake, thence East 37 poles 8 links to a spanish oak; Thence South to the beginning- containing 32 acres - in all 263 1/2 acres. It is therefore entered by the court that the Sheriff of the County of Marshall proceed to allott to the petitioner her dower interest of one third in Said Several tracts of land accounting to the quantity & quality thereof, in pursuance to the statute in Such case made & provided - and that in assigning her dower, he assign the same to her out of the tract on which the sd. John HILL had his last place of residence, if the petitioner should so desire, So as to wiche do the mansion house &c. and that he make report of his proceedings [?] to the next Term of the court. Page 5 TURNER and his wife Nancy TURNER & vs) Petition for dower Charles HARDISON admr & others of John HILL deceaased Re it remembered that this course coming on for final hearing on the petition, intercorntery[?] order heretofore made and the report of the jury, which report is in the words following viz (here insert the report) and the same not being excepted to, it is ordered that adjudged & decreed that the same be in all things affirmed and that the tract orparul[?] of land described in said report be vested in the said Nancy TURNER during her life - It is further ordered that petitioners pay all cost accruing herein and that execution issue *c. One other, Beginning at an Ash (marked as a Corner) running West with PATTON and ERWINS South boundary line 136 poles (to) Walnut and Red Oak; thence South 57 poles to a Cedar; then Eace 37 poles to a Stake, then South 15 poles to a Walnut and Cedar; thince East 108 poles to a Dogwood; thence North 76 poles to the beginning; containing 60 Acres. One Other, Beginning at a Stake 20 poles North of the South East corner of the tract on which Said HILL lived, then East 30 poles to an Ironwood; thence North 96 poles to a Stake; thence West 67 poles 8 links to a small Walnut; thence South 60 poles to a Stake; thence East 37 poles 8 links to a Spanish Oak; then South to the beginning, Containing 32 Acres: in all 263 1/2 Acres. Page 18 The real estate of The undersigned being unconnected we with the parties either by affinity find to be 253 1/2 acres or consanguinity and entirely 1/3 of which is 84 1/2 acres disinterested having been Summoned which we assign the widow and duly sworn by the Sheriff of for her Dower Marshall County as a Jury to allot H. B. BIGHAM Por. and set off to Nancy TURNER her Dower ------------------ out of the real estate of John Hill her Dec'd husband after having duly considered and fully understood the whole matter do hereby assign to the Said Nancy TURNER for her Dower the following described land with the erections and improvements thereon a tract of land in the county of Marshall on the waters of Silver creek containing 84 1/2 Acres and Bounded as follows Beginning at an ash the South west corner of the original survey and Runs East 108 poles to a beech then North 125 3/4 p to a Buckeye or ash then West 108 poles to a stake in the West line then South 125 3/4 poles to the Beginning containing 84 1/2 acres which in our opinion constitute one third of the real Estate JOhn HILL Dec'd this 19th of Decr. 1837 [signed] J.
