WALKER 28 May 1840 Page 1 To Honorable Thomas MAURY[MANEY?] Judge &C Your Petitioner Andrew LAIRD of Marshall County Tennessee would respecfully represent to your Honor that in the month of March last one William WALKER died intestate in the County and state aforsaid and that at the May term of the County Court of Said County your petitioner was duly appointed administrator of his goods & chattles rights & credits. Your peititoner has proceeded to sell the personal property belonging to said estate with the exception of a negro girl named Sally aged about 13 years. The property which your petiton sold and which is all that has come to the knowledge of petitioner as belonging to said estate brough but $ 31. and sfiew[?] the out standing debts against the estate which has already come to the knowledge of petitioner amounts to more than $200-- In consideration of the previous your petetioner prays your Honor to order Said Negro girl Sally to be sold upon such terms and conditions as to your Honor may Seem meet and proper in order that the proceeds may be applied as far as necessary to the payment of the debts of the estate and as in duty bound will ever pray &C [Signed] Andrew LAIRD Administrator of William WALKER Deced Subscribed & sworn to in Open Court May 28. 1840 [signed] D McGANEY clk Page 2 Andrew LAIRD Adm. of William WALKER Decd Ex parte) Petition for sale of Negro Be it remembered that this cause coming on to be heard before the Hon. Edmund DELLAHUNTY judge &C upon an interlocutory decree made at the last term of this Court and upon the report of the administratior made in pursuance thereof which report is in the words and figure following to wit: "Pursuant to an interlocutory decree made in this cause at the May term of the circuit Court held for the county of Marshall I proceeded to sell at public sale the Negro gell Sally as named in Said decree having adairtised[should be advertised?] the same as Required. and sell her to Borzelea G. RAINEY for the sum of five hundred and eighty two dollars, that being the highest and best bid I could obtain for her and took his notes with Jeffrey BECK as his security due the 25th day of December next all of which is respectfully submitted this 6th day of July 1840. Andrew LAIRD admr of William WALKER decd Which report being read and heard and not excepted to is in all things confirmed and it is ordered adjudged and decreed by the Court that the title to said negro gerl Sally be divested out of Said Administrator and all other persons and vested in the Said Barzellea G. Be it remembered that this cause coming on to be heard at the May term of the Circuit Court of Marshall County, upon the petition and affidavit of petitioners: And it appearing to the Satisfaction of the Court, that there is not other personal effects belonging to the estate of the said William WALKER deceased sufficient to pay the debts outstanding against it. It is therefore ordered adjudged and Decreed by the Court, that said Negro girl Sally mentioned in the petition, be Sold as aforesaid at public Sale, On a credit until the 25th of December 1840 to the highest bidder, after having advertised the time and place of Sale at least 20 day at the Court house and four other the most public places in Marshall County. The purchaser to give bond and Security for the purchase money before the possession is delivered; and that he report to the next term of this Court.
