Hall, 1849 James W. Edwards being sworn deposes Question Cy Court Were you acquainted with the pecuniary condition of Runcy(?) K. Hall at the time of the transfer to him by Edwd. Hall-if so state whether he was able to pay the amt of purchase. Ans I was acquainted with the pecuniary condition of Runcy(?) K. Hall at the time spoken of-he was not able to buy land, I am certain he was not able & did not profess to be able to do so. Before he got the land from his father he told me, his father was indebted to him to mony (sic) he paid(?) for him in the western District while they were waggoning together & if he tried to get the land it would be on _____. I have an execution in favor(?) of Zollicoffer v. Edward Hall to collect as a constable, while I _____. Thos. K. Hall was living in my yard and his father came to see him from the District ___. I found out at night that he was ____ & I told Thomas K. Hall there it must endevor(sic) to make it or I would be both(?), that I disliked to disturb him but must do it ___, I intended to see the old man next morning, but when morning came he was gone & I was _____ that being told I have the ____ he left before day. Being interrogated I state that Runcy K. Hall at the time he got the land knew it was claimed by Hiett. The ____ by debt _______ Sworn to ____ on 15 Sept 1849 Wm P. Martin ____ J W Edwards 1 day____ 75??? Sampson S. Matthews v John W. Clanton & others, 1842, By virtue of the powers vested in me as Clerk to Martin Shaw(?) on this 8th day of February 1843 at my office in Columbia summed(?) to come before me Wright Edwards a witness for the court ____who having been first duly sworn on the Holy Evangels(?) of Almighty God deposes and says to me Question by court 1. Are you acquainted with James D. Matthews, formerly of this county, now of Texas, if so have you seen him since he went to Texas, were you at his house, state what you knew about his circumstances-state when you were at his house in Texas & all you knew on this subject? Answer I am acquainted with James D. Matthews, formerly of this county new of Texas. I was at his house in Texas in the month of Dec 1841 & staid(sic) there about one week, I had a claim against him amounting to between $500 and $600, he gave me good claims ____ in his county which were good & which I took in satisfaction of my debt which debt was created in this county in the year 1840 for property sold to the sd (said) James D. Matthews by me at that time. When in Texas I saw James D. Matthews in possession of three Negroes & I was informed by his ____ & acquaintances that that (sic) he owned stock & land in Texas & was considered solvent. Quest State if James D. Matthews was in the county in the year 1840. How long he remained & if he took property at the time from this county away with him & what was the value of said property. Ans James D. Matthews was in Maury County in December 1840 & remained in Maury county ___least a month & he took away property at that time which I had ___ knowledge of ___ which was estimated at least $1500. Cross Examined Question 1st. You say the estimate of the property which James D. Matthews took with him in December 1840 or Jan 1841 was worth $1500. Do you know what amount of property he had prior to his re turn to Texas or if he had any? Ans I do not know anything on this subject Question 2 Do you know whether the note now in controversy was ever sent (?) to Texas-if so by whom & whether this note was or not in Texas at the time the said James D Matthews was in Tennessee? Ans I do not know anything about the note neither do I know whether or not the note was was (sic) in Texas And further this information was sworn to before me this 8th day of Feb 1843 GM martin ____ J W Edwards (signature) Sampson S. Matthews v John W. Clanton & others, 1842, continued John H. McCanless having been also duly sworn deposes & says to wit Quest State if you are acquainted with James D Matthews, when he resided in Maury county __you____ at his house since he moved to Texas, is so when Ans I was acquainted with James D. Matthews while he lived in Maury County. I have been at his house since he moved to Texas. I was there in the month of November 1841. Quest State what property he had in his possession at the time you were in Texas and all you could about his circumstances while there Ans He had three Negroes ( a Negro woman & two children) he had other property consisting of household furniture, one horse which he took from Maury in 1840, ___ head cows. I made a good deal of arguing about his circumstances from his neighbors in that country. I had heard ___ I left home, that he was broke. The neighbors all told me he was good-that he was good for this contract that stood against him there. That he was good for the contract which McCandless had on him. People there told me that while Matthews was in Tennessee, there were some debts come against him which sold some of his property that this was done by some of his enemies while he was gone to break him down, that Matthews was a candidate for clerk-that after his return they ___ sold any of his property, that he ________ (next page) ____caused objects all that part of the ___answer stating ___any the ___to the ___. Quest state if Matthews was in Maury County in 1840. what month he was here. How long he ____ what property he took away with him at that time, of what it consisted, and what was its value? Answer He was here in November & December 1840 ___ from 4 to 6 weeks he took away with him a waggon (sic) team of four horses. He had from 8 or 10 head of other horses. His waggon (sic) was loaded with apples-a part of the __which he took away ___& ____, which he purchased of F. Zollicoffer ___ to ___ build in Texas for it. Some of the stock I sold him, & was to take ___ in Texas. I went to Texas to see the country. It's close the ___ with Mathews. Mathews satisfied me that he had money to satisfy my contract. Mathews offered to make title to me of ___which he satisfied me at the time ___ to him. But we could not have it summarized because it was in the frontier & was not safe to __ it then he offered me land in the settlements but I preferred to take the other the contract is not just land between us-I saw him the day he started from Maury in 1821 (?-shouldn't it have been 1841?-my question)with the possession above spoken of. Quest How long were you at Mathews in Texas Ans I was there some two or three days Cross Examined Question-do you know where the defendant John W. Clanton of Stovall was when James D. Matthews was in Tennessee in 1840?
