Court Minutes, excerpts 1853-1859] [transcribed by Mark Murphy, 10 Dec 2001] [Vol. 11] [page] 146 Monday, 6th November 1854 State of TenneSsee, County of Maury, Be it remembered that at a court began and held for the county of Maury at the Court house thereof in the town of Columbia on the 6th day of November 1854, that being the first monday in said month, present Elias G. Frierson, Aaron[or Hann] Vestal, & Henry Harris, Justices of the peace and members of the quomm[?], James O. Porter chairman John B. Padgett clerk & Mumford Smith Sheriff, The following among other things before said Court were ordered to be entered of record, ISsued Ordered that Joseph Boaz be appointed overseer of the road leading from Columbia to Campbellsville from the lines of J. Galloway & Mary[or Many] Kercheville to the Giles County line in the place of F.B. Veech and that he have all the hands in the bounds of the former order. ISsued Miles P. Murphy Exparte, In this cause it is ordered that Miles P. Murphy have the priveledge of erecting two good & well constructed gates acroSs the road which divides his farm, said gates to be such as the law directs, and to be kept in good order by said Murphy and to be subject to the order of the court. ISsued Ordered that Joseph Dugger be appointed overseer of the road leading from the Columbia and Campbellsville road through the lands of William McConnell[or McCornell] in Maury County and action[?] to the county line on the top of the ridge and that he have the hands of R.T. Perry, Mr. Becket, G.W. Jones, W.W. McCornel[or McConnel] & John B. McCornel[or McConnel] to work said roads. Jacob H. Hunter overseer of the River road &c this day moved the court for leave to resign his office as such for the reason that the court has not assigned a sufficient number of hands to work said road, and the court being of opiniun that it be right and proper for him to be permitted so to do, it is ordered that the order appointing said J. Hunter overseer of the said Road be set aside and for naught held. no 92. ISsued Jonathan S. Hunt & others Exparte, On motion it is ordered that M.M. Sane[or Sune], James J. Caskey, John Scott, Davis Scott, John B. Ballanfunt[?], J.A. Dugger, S.S. Dugger, J.B. Gooding Deceased one years provision returned their report into court which being fully understood by the court is in all things confirmed and orderd to be recorded. ----- $2059 87/100 Columbia 27 October 1854 Received of John B. Padgett clerk of the County Court for Maury County two thousand and fifty-nine dollars & 87 cents, being the nett amount of Revenue collected by him as such for the year ending 1st September 1854. D.E. Morgan Trustee for Maury County ----- Charles Murphey Deceased The Clerk of the Court this day reported to court all accounts of the estate of Charles Murphy Deceased, Slated with Charles A. Murphy his executor from which it appears that all the special legacies named in the will of said Deceased have been paid and that Eliza S. Sausberry and Frances E. Griffith wife of B.B. Griffith all the residuary legatees named in said will and that they had notice of the time and place of taking said account as the law directs, and that they have been fully paid as appears from said account, and the said account being unexcepted to and fully understood by the Court is in all things confirmed and ordered to be recorded. ----- Sparks S. Kelley Administrator of George W. Fly Deceased vs. The heirs & creditors of George W. Fly Deceased This cause came on for final hearing this 6th November 1854 upon the report of the clerk of this court, and its proceedings heretofore had in the same, from which it appears that the administrator has in his hands the sum of two hundred and twenty dollars for distribution pro sata among the creditors of said Deceased, Said report being unexcepted to and fully understood by the court in all things confirmed, Ordered that the Administrator pay to the creditors as appears from said report the amount which is due each respectively and that upon legal notice being given the clerk of the court that said S. Kelly admr as aforesaid fails or refuses to pay the sum as due him, that he iSsue execution against said S. Kelly for said amount as appears from said account. ----- Poor house settlement Andrew Scott, Treasurer of the poor home for Maury County, The commiSsioners appointed to settle with the various county offices for Maury County this day reported to Court a settlement made with Andrew Scott Treasurer of the Poorhouse, which is as follows, Treasure Dr. For Balance in your hands 20 Jun 1853. 340.75 " Amount allowed & Paid at October 1853. 300. " Amount allowed & Paid at April term 1853. 500 /$1140.75 By Amount Paid James F. Be it remembered that at a quommo[?] county court began and held at the Court house in the town of Columbia in the County of Maury, on the first monday in December A.D. 1854. that being the fourth day of said month, Present Aaron Vestal, Henry Harris and Elias C. Frierson members of the quomum[?] The following among other things was ordered to be entered of record. Admr On motion and it appearing to the satisfaction of the court that Catharine Merce[?] is dead, that she died in said county intestate leaving an estate and the court having appointed William C. Merce administrator of the said Catherine Dec, upon his entering into bond and security in the sum of three hundred dollars- the said William thereupon in open court entered into bond in said sum with Coleman Goad and William C. West his securities who were approved by the Court as sufficient security, and thereupon the said William C. was duly sworn to administer said estate as the law directs. Ordered that letters of administration upon said estate be iSsued to said William C. as the law directs. Bryan Ward next friend and guardian for Andrew J. Murphey et al vs William A. Alexander guardian for Andrew J. Murphey et al Petition to aimmo[?] guardianship to the County of Smith. Be it remembered that this day Bryan Ward provided her in open court a petition praying that the guardianship of Andrew J. Frances K. & John S. Murphy, minor heirs & legatees of Charles Murphy Deceased, be transferred from the County of Maury to the County of Smith in the State of TenneSsee and it appearing to the satisfaction of the Court that the place of the actual residence of said minors is in said County of Smith, and the said Ward having produced here in open court a transcript of his Bond and certificate of the clerk of the County Court of said County of Smith, and it appearing to the satisfaction of the Court that the said Ward is the regularly appointed guardian for said minors in the County of Smith, that said county is the place of the actual residence of said minors, that said Ward is a suitable person, and that the securities to his bond are good for the penalty thereof, and it appearing that the said Alexander, the guardian for said minors in the County of Maury has slated his account as such and that the balance in his hands due said minor was the sum of one hundred and fifty four dollars & 45 cents, and it further appearing that said Alexander already paid that sum over to the said Ward, the guardian for said minors in the County of Smith in the State of TenneSsee, the place of the actual residence of said minors and that the account as slated with said guardian in the County of Maury be in all things confirmed and is ordered to be recorded, Orderd that the said Alexander the guardian in the County of Maury and his securities be released from all further & future liability on their bond for the due performance of said guardian in the County of Maury he having acknowledged the services of the securities to which by law he was entitled. [end of page] [Volume 12] [page] 221 Monday 7th December 1857 ----- Marshall M. Mills Dec. On motion it appearing to the satisfaction fo the Court that Marshall M. Mills, late a citizen of Maury County has died intestate having an Estate It is ordered that letters of administration upon said Estate be iSsued to William J. Mills upon his executing bond with good security in the sum of five hundred Dollars and the said William J. Mills in open court executed Bond in said sum with James A. Mills and Ezra Hardison his securities who were by the court approved and the said Mill was duly sworn administrator said Estate & to discharge his duty as the law directs. Elizabeth C. Murphey. On motion and it appearing to the satisfaction of the Court that S.S. Dugger as the guardian of Elizabeth C. Dugger, who is now the wife of William N. Murphey, has a fund in his hands due said Elizabeth C. which arises from the sale of the Real Estate of Thomas B. Dugger &c, it is ordered that William N. Murphy be appointed guardian of said Elizabeth C. for the purpose of acting as her guardian generally & specially to licence said fund from said Dugger the said fund which is in his hands &c. Upon his executing bond with approved security in the sum of three hundred dollars. And the said William N. Murphy in open court executed said bond in said sum with Miles P. Murphy & William R.H. Mack his securities who were by the court approved and said bond was ordered to be Recorded &c Charles M. Edwards Exparte. This day Charles M. Edwards who was elected to serve as a constable for Maury county in the 16th civil district of said county tendered to the court his bond in the sum of Eight-thousand Dollars with Nathaniel W. Jones, William Noles & Samuel H. Jones his securities who were approved by the court as sufficient securities said bond is in to words & figures following, to wit, State of TenneSsee: Maury County, Know all men by these presents, that we, Charles W. Edwards, William Noles & Nathaniel W. Jones & Samuel H. Jones, are held and firmly bound into the State of TenneSsee in the sum of Eight thousand Dollars, to which payment will and truly to be made. we direct ourselves, our heirs, Executors or Administrators, jointly, and severally, firmly by these present Witness our hands and seals this 7th day of December 1851 The condition of the above obligation is such, That whereas the above bound Charles M. Edwards had been duly and constitutionally elected to serve as a Constable of said County: Now if the said Charles M. Edwards shall will and truly pay and satisfy such persons to whom the same maybe due, all such sum or sums of money as may be by him received by virtue of any process put into his hands for that purpose, and shall in all things belonging to his office, will and truly demean[?] himself during this continuance therein. then this obligation to be said due to remain in full force and effect, Acknowledged in open court by principal and Securities, and by the Court approved } Wm.
