Executed by J. P. Fitzgerald Oct. 18, 1897 Filed Oct. 18 1897 at 12;O5 O'ck P.M. & was Registered Oct. 20, 1897 I have this day borrowed from sd. J. R. Malland the sum of One hundred Dollars, for which I have this day executed my note for the purpose of secur-ing & making certain the payment of said note according to the tenor thereof, I John P. Fitzgerald have this day sold to said John R. Malland, the Following described stock, to witt: One Iron Grey mare mule, 7 years old & about fifteen hands high, named Bird, One Bay Mare 7 years old about 15 hands high, spot in forehead & named Mat, One horse colt, two years old next spring, bay with (bald) or blaze face, two white hind feet, named Tom. Now if I fail to pay said note at its maturity as provided therein, said John R. Malland is authorized to take possession of said stock & sell the same, either privately or publicly as he may deem best & apply the proceeds to the payment of said debt, interest & such cost as are or may be incident to the execution of this trust. In the event that a sale should become necessary, said J. R. Malland is directed to sell the Mule first, & will only sell so much of said stock as to pay said debt, interest etc. But in the event I pay said note, interest etc. as provided, then this conveyance is null & void & of no effect. Witness my hand this 18th day of Oct. 1897. J. P. Fitzgerald State of Tennessee Maury County Personally appeared before J. Frank Wiley Clerk of the County Court of said County J. P. Fitzgerald the above Named bargainor with whom I am personally acquainted & who acknowledged that he executed the foregoing Instrument, for the purpose therein contained. Witness my hand at office in Columbia, Tenn. This the 18th day of Oct. A.D. 1897. J. F. Wiley, Clerk (This note written on side of Mtge.) I, J. R. Malland declare that I am the true and lawful holder and owner of the within recorded Instrument and hereby acknowledge satisfaction thereof in full and the discharge of all liens to secure the same.
