Know all men by these presents that I Pleasant Fitzgerald of the County and State aforesaid for the natural love and affection I bear and have for my children hereinafter Mentioned do hereby give grant and confirm and convey unto them the tract or parcel of land on which I now reside in the State of Tennessee Maury County, 19th civil district of said county on Carters creek and the same I purchased of Thomas Rountree containing one hundred and thirty seven and a half acres be the same more or less and bounded as follows. Beginning at a Sycamore at the mouth of a branch of Carters on the West side of said creek thence up said branch with its meanders to a stake (an Elm now down called for in McLemores deed to Bennett Blackman) Thence South 38 degrees West 64 poles to a fallen hickory & white oak sapling Joseph Rountrees South East corner thence North 58 1/2 poles to a Boxelder & Black Ash thence West North West twenty four poles to a bunch of five willows Thence North 135 1/2 poles to a stake McKee's South boundary line, thence East 58 poles with said McKee's line to a stake said Mckee's East corner thence North 28 poles to Andrew Rountree's line crossing Carters creek 11 poles in all 28 poles to a Hornbeam sapling thence South to Carters creek at 10 poles to a stake thence down said creek with its meanders to the beginning. The said tract or parcel of land as above mentioned to be equally divided as to quantity as follows. To David S. Fitzgerald my son I give the one seventh part of the whole tract so as to include the house where he now resides on the said tract of land herein conveyed for the benefit of his wife Martha Ann and their children for their support and mantainance and not subject to the debt or liability of the said David S. Fitzgerald. To Beverly A. Fitzgerald the one seventh part of the whole tract. To Frances E. Fitzgerald wife of Garrett Fitzgerald and the children of her body the one seventh part of the whole tract to be laid off to her where she now resides so as to include the house and out houses and the same is given to her free from the debts liabilities and control of her present or any future husband she may hereafter have. To my grand daughter Margaret Ann Dodson a child of Wm. & Parthence Dodson, I give the one seventh part of said tract of land free from the debt contract or control of any husband she may hereafter have and should she die without issue the said one seventh part of said land is to revert back to me or my heirs as herein mentioned. To Daniel E. Fitzgerald my son I give the one seventh part of said tract of land. To Margaret E. P. Jacobs wife of Thomas H. Jacobs the one seventh part of said tract of land is to include my family residence and the out houses and it is expressly understood that myself and wife Nancy are to live in the house with the family of the said Thomas H. & Margaret E. P. Jacobs and they are to support and maintain both myself and wife free from any charge, we are to clothe ourselves only and if either myself or wife should see proper to leave the house and premises of the said Jacobs & wife we are not to have any pay or support at any other place, but if we remain they are to give to myself & wife a decent support during our natural lives and to treat us kindly and affectionate and to secure the same attention from the said homas H. Jacobs wife as is due from children to their parents. To my grand daughter, Fanny Fitzgerald a daughter of Geo. W. Fitzgerald I give the one seventh part of said tract or parcel of land but should she die without issue the same to revert back to me or my heirs herein mentioned and this share is free from the debts contracts or liabilities of any husband she may have. To have and to hold the above mentioned described tract of land unto the said David S., Beverly A., Frances E. wife of Garrett Fitzgerald, Margaret Ann Dodson, Fanny Fitzgerald, Daniel E. Fitzgerald, Margaret E. P. Jacobs wife of Thomas Jacobs their heirs and assigns forever with the instructions as before mentioned, I further covenant to and with said parties that the said parties that the same is unincumbered and that I have a good right to convey the same. Mcmeen State of Tennessee Maury County Personally appeared before me John B. Padgett clerk of the County Court of Maury County, Joseph Satterfield and W. B. McMeen subscribing witnesses to the foregoing deed, with whom I am personally acquainted and who acknowledged that being duly sworn, depose and say that they are acquainted with Pleasant Fitzgerald and that he acknowledged in their presence that he executed the foregoing deed and for the purposes therein contained.
