Jacobs, November 26th, 1870 Registered November 29th, 1870 Know all men by these presents that I, Thomas H. Jacobs of Maury County, State of Tennessee have this day bargained sold and conveyed and do by these presents Bargain sell and convey unto W. P. Fitzgerald and James D. Stanley for the consideration of five hundred dollars in the following payments to wit, two hundred dollars in cash to be paid on or before the 1st day of January 1871, the remainder of three hundred dollars to be due and payable by the execution of two notes for the sum of one hundred and fifty dollars each due and payable at one and two years from said first day of January 1871 and each bearing legal interest from date, all my right title claim and undivided interest of inheritance by deed of gift from Pleasant Fitzgerald in and to the following described tract of land such undivided interest being the one seventh part thereof, said tract of land is situate in the 19th Civil District of Maury County Tennessee on Carters Creek, and contains in all one hundred and thirty seven and one half acres be the same more or less. Beginning at a Sycamore at the mouth of branch of Carters Creek on the West side of said creek, thence up said branch with its meanders to a stake (an Elm now down called for in McLemore's deed to the Bennet Blackman tract) thence South 38 degrees West 64 poles to a fallen hickory and white Oak sappling, Joseph Rountree's South East corner, thence North 58 1/2 poles to a Boxelder & Black Ash, thence West North West 24 poles to a bunch of five Willows, thence North 135 1/2 poles a stake, McKee's South boundary line, thence East 58 poles with said McKee's line to a stake said McKee'' East corner, thence North 28 poles to Andrew Rountree's line, crossing Carters Creek 11 poles in all 28 poles to a hornbeam sappling, thence South to Carters Creek at 10 poles to a stake thence down said creek with its meanders to the beginning with the following reservations and conditions only vis. I am to reserve and hold possession of the houses and out-houses & buildings thereon during the natural life of Pleasant Fitzgerald including the garden as at present located with free use of firewood etc., and the purchasers said Fitzgerald and Stanley are to bear all loss or incumbrance that may fall on said land by right of Dower if any shall so happen of the widow of said Pleasant Fitzgerald after his death: To have and to hold the same and all its appurtainances therein, with the reservations above named to the said W. P. Fitzgerald and James D. Stanley their heirs and assigns forever. And I hereby covenant and warrant the title to the said bargained premises (with the reservations above excepted) to the said W. P. Fitzgerald & James D. Stanley their heirs and assigns forever from the lawful claim or claims of all and every person whatever. Witness my hand and seal this 26 day of November 1871. Thomas H.
