Executed by Fitz- gerald & Stanley, March 6th 1871 Registered March 21st 1871______ This Indenture Witnesseth; That whereas on the 26th day of November 1870, we W. P. Fitzgerald and J. D. Stanley bought of Thomas H. Jacobs, for the sum of five Hundred dollars in three payments, to wit; two hundred dollars in cash to be paid on the 1st day of January 1871, one note for one hundred and fifty dollars due one year from said 1st of Jany 1871, and one other note for one hundred and fifty dollars due two years from said 1st of Jany 1871, each note bearing interest from date, his undivided one seventh interest in and to a certain tract or parcel of land containing one hundred and thirty seven and one half acres, for the boundaries of which tract or parcel of land reference is hereby made to the Deed from said Jacobs to us, which Deed is dated 26th of November 1870, and said registered in Register's Office of Maury County, Tennessee, in Book T, Volume 2nd pages 339 & 340, And whereas said payment of two hundred dollars due Jany 1st 1870 was not paid. Now therefore in consideration of the premises and the further consideration of the delivery to us of our two said notes for $150 each, we, the said Fitzgerald & Stanley do by these presents, bargain, sell, release & quit claim to the said Jacobs, all title, claim & interest that we may have acquired in & to said one seventh undivided interest in said tract of land, by virtue of said purchase. To have and to hold the same to the said T. H. Jacobs, his heirs & assigns forever, but without any recourse, liability, or warranty, whatsoever, upon us, in regard to the title of same.
