This file was contributed for use in the USGenWeb Archives by: Bill Fitzgerald wafitz@charter.net ==================================================================== Pleasant Fitzgerald Deed Executed by Thos Rountree 137 1/2 acres Registered March 3rd, 1836 This indenture made this 23 day of October in the year of our Lord one thousand Eight hundred & thirty five between Thos Rountree of Maury County & State of Tennessee of the one part & Pleasant Fitzgerald of the other part & of the county and State aforesaid witnesseth that the said Thos Rountree for and in consideration of the sum of nineteen hundred Dollars to him in hand paid by said Pleasant Fitzgerald the receipt thereof is hereby acknowledged have given granted bargained sold delivered conveyed & confirmed unto the said Pleasant Fitzgerald his heirs & assigns forever a certain tract or parcel of Land situated lying in the County of Maury & State aforesaid on the west side of Carters creek a branch of Duck River & bounded as follows (viz). Beginning at a Sycamore at the mouth of a Branch of Carters creek that empties into said creek on the west side thence up said branch with it's meanders to a stake ( an Elum now down called for in McLemore's deed to Bennett Blackman) Thence South thirty eight degrees west Sixty poles to a fallen Hickory & white oak sapling Joseph Rountree's south east corner thence north fifty eight & a half poles to a box elder & black ash thence west north west twenty four poles to a bunch of five willows thence north one hundred & thirty five & a half poles to a stake McKee South boundary line, Thence East fifty eight poles with said McKee's line to a stake said South East corner-thence North twenty eight poles to Andrew Rountree's line crossing carters creek Eleven poles in all twenty poles to a horn beam sapling thence South to Carters creek at ( ten) poles to a stake thence down said creek with its meanders to the Beginning also to include a small part of land on the west side of the creek beginning on a hackberry on the west of the creek below Launders spring in a bluff of rock running north & south to the creek both ways containing in all by estimation one hundred and thirty seven & a half acres be the same more or less being a part of the same tract of land which was conveyed by John C. McLemore to Bennett Blackman & so on to said Pleasant Fitzgerald to have & to hold the aforesaid land with all & singular rights profits endearments hereditaments appurtanances & to the same belonging as is any wise appertaining to the only proper use & behoof of him the said Pleasant Fitzgerald his heirs & assigns forever of the said Thos Rountree for himself his heirs executors & adminstrators doth covenant & agree with said Pleasant Fitzgerald his heirs & assigns that the recited land & bargained premises he will warrant & defend forever against the right title interest or claims of all & every person whatsoever. Hastings subscribing witnesses to the within named deed who being first sworn depose and say that they are acquainted with Thomas Rountree the bargainer and that he acknowledges the same in those presence to be his act and Deed upon this day it bears date Witness my hand at office this 14th day of March 1836.
