Moye ermoye2@hotmail.com January 6, 2010, 8:10 pm Source: Maury County, Tennessee, Will Book X, Page 79 Written: June 1, 1832 I Stephen Brooks of the State of Tennessee Maury County knowing the uncertainty of life and the certainty of death being weak in body but possessing a sound disposing mind make and ordain this my last will and testament. 1st I resign my body to the grave to be desently intered and give my soul to god who gave it to me 2nd I will all my just debts to be paid 3rd I will and desire that my beloved wife Mary Brooks have and possess during her life all of my negroes to wit Anthony Hanner Caswell Susan and Dilly Ann. 4th At the death of my wife Mary Brooks it is my wish and desire that the above named negroes be sold at public sale in one lot that they not be separated and the proceeds thereof be equally divided amongst our children to wit Elijah Hunter Elisha Hunter Thomas Brooks Milly T. Mahon Catharine B. Jackson Joseph Brooks Mahala L. Odell John B. Brooks and Mery H. Lacy having disposed of her share to Thomas Mahon it is my will and desire that the said Thomas Mahon have two equal shares the division to be made on the following principles to wit, after giving Elijah and Elisha Hunter their equal share of the amount of the above named negroes all of my children Thomas Brooks Milly T. Mahon Catharine B. Jackson Joseph Brooks Mahala L. Odell Mary H. Lacy and John B. Brooks all of them [of them appears to be struck out] and each of them under a true and correct account of all that they or any of them may have received of my Estate heretofore and of all the money I have paid for them or any of them and add the several sums thus rendered to the sum that remains of the sale of the negroes after Elijah and Elisha Hunters equal shares have been taken therefrom. 5th It is my will and desire that Polly H. Lacy receive out of the personal property if there should be enough and if not to be taken out of the amount of the estate the sum of twenty five dollars to compensate for her care and attention she has paid to the raising the negro children. 6th It is my will and desire after the property is disposed of as above named and the various sums accounted for and all being added together that it be equally divided amongst the above named children to wit Thomas Brooks Milly T. Mahon Catharine B. Jackson Joseph Brooks Mahala L. Odell and John Brooks Thomas Mahon having two shares one in right of his wife Milly and one by purchase from William Lacy the husband of Mary H. Lacy. 8th [sic] I hereby nomenate and appoint Thomas Mahon my Executor and my wiffe Mary my Executrix to carry into effect this my last will and testament.
