WILL OF JAMES LUSK Written October 31, 1852 Maury Co. Tn. Proven June 4 1852 The first few lines did not copy, Sorry. James Lusk...County of Maury. Knowing that it is appointed for all men to die, do make this my last will and testament and first I will that all my just debts shall be paid and the remainder of my Estate be devided among my heirs in the following manner. 1st I give to my beloved wife Elizabeth the plantation I now live on containing about seventy acres with the dwelling house and Kitchen & all of the bildings belonging to the premisses and all of my stock of every kind the household and Kitchen furniture of every kind and discription except one good feather bed and furnature & one chest, I also give her all my farming tools and tools of every kind and discription. My cart and steers i also give her all of the ready money and cash notes and acountsts (?) all of those things named above I give her for her support during her life. I also give to my beloved wife a Negro woman named Fanney to have and to hold said Negro during her life and to dispose of as she may think best at her death. 2nd I give to my son Samuel Lusk a Negro man named Sikes to have and to hold forever. 3rd I give to my son James Lusk a Negro boy by the name of Peter to have and hold forever. 4th I give to my son John Lusk a Negro woman by the name of Tildy with all of her children she has or may have except the boy Peter given to James, and girl by the name of Louise I also give him one good feather bed and furniture & one chest to have and to hold the Property before mentioned to him during his lifetime and at his death I give said Negro woman and children except the two named and the feather bed and chest to my two sons Samuel & James to be equally devided between them. 5th I give to my two sons Samuel & James Lusk as trustee for my Daughter Sinthey Bingham a peace of land containing about thirty acres be the same more or less being the place she liven on now. I also give them a Negro girl by the name Of Louise to have and to hold the said piece of land and Negro girl as trustees for the benefit of my Daughter Sinthey Bingham. I will that the said trustees Samuel & James Lusk convey the right of the said Negro girl Louise to my Grandson James Bingham and the increase of said give to he equally devided between the under named Grand children to me, James Bingham, John Bingham, Elexander Bingham & Margaret Bingham and the piece of land left to them for the benefit Daughter during her life. I will that it be equally devided between all of the children of my Daughter Senthey 6th I give to the children of my Daughter Ann Heart two hundred dollars to be equally devided among them and as to the children of my son Elias Lusk I have given to them their part of my estate already, and finally in the remaing (remaining) left of my Estate at the death of my wife Elizabeth I give and bequeath to my two sons Samuel & James Lusk the Plantation I now live on to be equally divided between them. I also will that after the death of my wife the property that I left her for her support with the cash and cash notes after paying to the children of Ann Heart the two hundred dollars left to them, the remainder to be equally devided between Samuel Lusk. James Lusk, John Lusk & Sinthey Bengham. Lastly I do hereby nominate & appoint Samuel Lusk & James Lusk my Executors. In witness where of I have unto set my hand & seal this the 31st day of October 1852.
