Polk being of sound and disposing mind & memory and being desirous of disposing of my worldly property of all Kinds do make & publish this to be my last will & testament. In the first place I will and bequeath to my mother Jane Polk the sum of five thousand dollars in mony to be made up by Execrs. herein after named out of the amount due to me by my Guardian with (am of) whom I have not had a settlement of my Estate since I arrived at the age of twenty one and all other monies that are due to me or my bosom[?] due to me on note Which I now hold after my first debts are paid. If This should not be sufficient to make up the full sum of five thousand dollars then so much of my unappropriated property as will be necessary to make out the full sum of five thousand dollars must be disposed of by my Executors for that purpose. If there should not be sufficient unappropriated property to make out the sum of five thousand dollars then my other heirs & dowers[?] except the minor children of my Brother Marshal T. Polk must constitute equal that is Jas. K. Polk one half & my brother William H. Polk one half. Secondly I will an[sic] bequeath to my brother James K. Polk my interest in the House & lot and all appurtise and as which is situated in the town of Columbia & which is at this time occupied by my mother who has a lifetime estate in said house & lot also my negro blacksmith named Harry & negro man named Pompey & negro man Ben. Thirdly I will & bequeath to my Brother Wm. H. Polk my plantation on the north side of duck river containing at three hundred & fifty acres more or leSs including the Junim[?] stand known as the Mt. Vine[?] place also my negro girl Dolly & her child named Elias and my negro girl named May. Fourthly I will & bequeath to my deceased brother Marshal son Marshal T. the sum of three thousand dollars north of my western District land to be valued at them out of said land by two disinterested persons so soon as practicable. Such persons to be appointed by my Execr. Also my negro boy named Bob until this provision that all the property above mentioned remains under the control of my brother Jas. K. Polk for the benefit of the said Marshal T. Polk until he the said Marshal T. arrives at twenty one year of age. Fifthly I will & bequeath to my said decd. brothers daughter Eunice[?] the sum of three thousand dollars north of my Western district lands to be valued to her out of said lands by two disinterested persons to be appointed by my Executor as soon as practicable with the provision that the said property be an Remain under the control of my brother Jas. K. Polk 394 until she should Marry or arrive at the age of twenty one. It is my further wish & desire that if my Western district land when valued as aforesaid do not make up the sum of three thousand dollars in Value to each, the said Marshal T. & Eunice[?] the Imis[?] the sum to be equally divided between them. Sixthly If after the above legain[?] are satisfied & my just debts are paid then should be any surplus as any property belonging to be equally divided between my mother Jane Polk my brother James K. Polk and my brother Wm. H. Polk. Lastly I appoint my brother Jas. K. Polk & Wm. H.
