Letter from Dept. of Interior, C. W. Leaton Commissioner, dated 4 June 1872 to L. W. Burgo, Athens, McMinn Co., Tenn. “Sir: In pension claim of Nancy Stanfiel, widow of James Stanfiel, under Act of Feby 14th 1871. No 5622, the witnesses H. L. Alexander and Nancy McClelland, who testify to cohabitation of claimant and soldier prior to 1813, are required to fix the earliest date of their knowledge of such cohabitation, and to state their means of knowing, and the facts that enable them to fix such date. Witnesses are also required to State their respective ages... [Reply indicates was written on reverse of above letter. mlj]: “On receiving the within although Claimant had assured me that she had made dilligent search for a record of her marriage without success, I wrote to Surry Co., NC for record and received the enclosed certified copy of marriage Bond and letter of Clerk. And as I esteem said copy better proof of the marriage than the evidence of witnesses I for’d them and do not for’d any thing further from witnesses Allexander and McClelland. Athens, Tenn. Aug. 24, 1872. T. W. Burge, Atty for Claimant.” [Letter] “Dobson, N.C. Aug 9th 1872. Sir I send you a copy of the bond of Stanphiel & Nancy Turner. It has not been the custom to return marriage license into office in this State until the last few years past do not find the marriage bond of Stephen Wood I will make a more thorough search It may be that - I can make a certified statement that will answer as it has not been the custom to record marriage bonds and as ?Stanesmans Army had access to this office on his ? in 65 discharged a part of records belonging to this office Yours Respectfully, J W Martin [HELP – any of you war buffs out there know Whose Army? mlj] State of North Carolina} Surry County } Know all men by these presents that we James Standfield and Thomas Standfield in the State aforesaid are held and firmly bound unto the Governor of the State of North Carolina for the time being in the just and full sum of Five Hundred [Dollars marked through] Pound Current money of the State to be paid to the said Governor or his successor or assignees To the which payment will be and testify to be made and done we bind ourselves our heirs executors and administrators sealed with our seals and dated the 20th day of Feby Anno Dom 1806. The condition of the above obligation is such that whereas the above bondsmen James Standfield hath made application for a License for a marriage to be celebrated between him and Nancy Turner of the County aforesaid ?Now in case it shall not appear hereafter that this is any lawful cause to obstruct the said marriage then the above obligation to be void otherwise to remain in full force and virtue sealed and delivered in the presence of M Armstrong. Alexander and Nancy Mccllend of County and State aforesaid to me well known whom I certify to be respectable and entitled to credit and who being by me first duly sworn according to law say that they are informed and believe that one Nancy Stanfiel widow of James Stanfiel decd. Has made an application to the Hon. Commissioner of Pensions for a pension and that they have been called upon by said Nancy Stanfiel to testafy in reference to the marriage of herself and said James Stanfiel decd. They do now therefore come and say that they are well and intimately knew James and Nancy Stanfiel for about fifty years prior to the death of said James Stanfiel according to the best of their recollection and belief, and they did live and cohabit together during the whole of that time as husband and wife, and that they were so regarded and recognized by all who knew them in the community in which they lived; and further that affiants have never heard the fact of the marriage of said James and Nancy Stanfiel disputed or doubted. And that they have no interest in the pension claim of said Nancy Stanfield. S/S H. S. Alexander S/S Nancy Mcclellend Sworn to by J. R. Aiken, J.P. for Bradley County, TN on 22 May 1872 State of Tennessee } County of McMinn } [Affidavit of Nancy Stanfiel of McMinn Co., TN states she made diligent search for marriage record to James Stanfiel, and that there is no record to be found. States married by a magistrate, who has been dead for many years and she knows of no eye witnesses of the said ceremony now living. Nancy (her X mark) Stanfiel Statement of John F. Slover, United States Commissioner, states he has been informed and believe that Nancy Stanfield in her application made proof of her identity and loyalty by two certain witnesses named S. D. Stanfield and J. G. Hale. He further states Nancy Stanfield and said witnesses S. D. Stanfield are of good character for truth and veracity. Dated 11 March 1872, s/s at office in Athens, Tennessee. John F. Slover, Commissioner State of Tennessee, County of McMinn} Affidavit of Samuel H. Howell and Joseph N. Brown, sworn and state they knew James Stanfill now deceased, for a period of about eight years before his death, and he died in McMinn County, TN on or about 28 December 1863, and that Nancy Stanfiel was wife of James. States lived as neighbor to said Stanfiels during said eight years, heard James Stanfiel say he was in the War of 1812. Affiant Howell states he was present at the buriel of said Stanfiel and assisted in interring him. Signed 8 April 1872. s/s Samuel H. Howell s/s Joseph N. Brown War of 1812 Declaration of a Widow for Pension, State of Tennessee, County of McMinn, dated 24 June 1871: Before me Son Blizard Clerk of McMinn Co., TN appeared Nancy Stanfiel aged 81 years, resident of McMinn Co., Tennessee, states she was widow of James Stanfiel who served in the Military. Volunteered in Capt. Hugh Martin’s Company, Col. Vandyhis Regiment of Tennessee Troops on or about 13 October 1813, honorably discharged at Blountsville, Tenn on or about 24 February 1814; that he was in no battle but did service at Fort Armstrong State of [left blank] and was ordered to Fort Strauther State of [left blank]. Further states she was married under the name of Nancy Turner to James Stanfiel on 27 February 1806 by Hugh Armstrong J.P., County of Surry, NC. States her husband died McMinn County, Tennessee on 28 December 1863, and she has never remarried. Post Office at Athens, County of McMinn, State of Tennessee.
