I Charles Carter Senr. of the County of McMinn and State of Tennessee being weak in body but of sound mind and memory do make and ordain this my last Will and Testament as follows First I give and bequeath to my son Charles Carter one negro man named Ben Davis, one negro girl named Lotty, a horse, saddle, bridle and bed all of which he has now or has had in his possession. Second I give and bequeath to my son Samuel Carter, one negro girl named Mariah, a horse, saddle, bridle and bed all of which is or has been in his possession, and at my death he is to have one negro boy named Elliot. Third I give and bequeath to my son Josiah Carter one negro girl named Elsey, a horse, saddle, bridle and bed, all of which is or has been in his possession and at my death he is to have a negro boy named John also one note of hand that I hold on him for Sixty dollars. Fourth I give and bequeath to my son William Carter one horse, saddle, bridle and bed which is or has been in his possession and whereas I have never given him a negro before this time I give him at my death two negro girls named Clary and July. Fifth I give and bequeath to my daughter Nancy McSpadden a negro woman named Vesia(???) and her children, a horse, saddle and bridle and bed all of which is or has been in her possession at my death she is to have a negro man named Bob and a girl named Mariah. Sixth I give and bequeath to Daniel Lowry and Susannah Lowry his wife one negro boy named Joe Green and one bed which is in their possession and at my death they are to have a negro woman named Dinah and two negro girls named Martha and Jane and whereas I have never given my daughter Susannah Lowry a horse, saddle and bridle as I have the rest it is my will that at my death she and Daniel Lowry should have a certain gray filly called Nance also a saddle worth fifteen dollars. Seventh. It is my will that my negro man Lewis be hired out for six years from my death and that the proceeds of his hire be equally divided among my heirs and at the end of the six years I want him to be free. Eighth It is my will that all the balance of my property both real and personal be sold and that the proceeds thereof be equally divided among my heirs. Ninth and lastly I hereby nominate and appoint Abraham Barb and Daniel Lowry Executors of this my last will and Testament given under my hand and seal this 17th day of July in the year of our Lord 1841. One mulatto man named Lewis aged about twenty five years about six feet high to be free at the end of six years from the death of said Carter. One mulatto man bequeathed to Charles Carter Jun’r aged about 27 years worth $1000.00 One negro man named Bob aged 50 years and one girl named Mariah aged about 14 years worth $800.00 One negro boy named Ellick (?) aged 18 years worth $800 One negro boy named John aged 16 years & a note of hand on Josiah for $62.50 -- $800 One negro woman named Dinah aged 60 years, one girl named Martha aged 9 years one girl Jane aged 7 years all worth $800 One yellow girl named Clary aged 20 years, one black girl named Julia aged 16 years worth $1400 Sworn to in open Court 1st Nov. 1841 T. None of the settlements show location of the heirs.
