Cooley, Tennessee Confederate Pension # 4433A. P.M. Cooley who is an applicant for pension under the Tennessee Pension law, claims to have been a member of Company H, 3rd Regiment, Confederate Cavalry, under Col. G. Sandusky, C.S.A. and to have been released from prison at Fort Delaware in June 1865. Signed George B. Guild President of Tennessee Board of Pension Examiners. War Department, Dated December 23, 1904. It is shown by the records that Philip Cooley served as a private of Company H, 3rd Regiment of Calvary, C.S. A. He enlisted May 5, 1862, at Camp Lowry, Tennessee, and is reported on the muster roll of the company for March-June 1864, dated June 29, 1864, as a prisoner of war since June 29, 1863. The records of prisoners of war show that he was captured June 29, 1863, near Tullahoma, Tennessee, and sent to Camp Chase, Ohio, July 7, 1863, where he was received on the following day. He was transferred July 14, 1863, to Fort Delaware, and his name appears on a roll of prisoners of war released at that fort on taking the oath of allegiance, June 10 and 11, 1865. State of Tennessee, County of Meigs. Personally came before me Sm. Heird, a notary public in and for said county and state of Tennessee legally authorized to administer oaths: J.M. Huff who says on oath that he served in Co. H, 3rd Regt. confederated army and says he knew P.M. Cooley in said co. and regt. and that said Cooley remained in said co. until the Battle of Murfreesboro, then and there I lost sight of Cooley and never saw him any more during the rebelian though we served together as stated above and I have no intrest in said case nor concerned in its prasicution. J. M. Huff, the above subscribed and sworn to before me this December 8th 1904 and certify that said affiant is intitled no credit and I have no interest in said cause this December 8th, 1904. Sm. Trew of Meigs County, Tenn who says on his oath that he served in Co H 3rd confedrate Regt War of 1861 and say he was persanly acquainted with P.M. Cooley of same company and regt. as above and says he served in said co with P.M. Cooley from the time of my commencement in said co untill Murfreesbarra Battle in Dec 1862 where I then lost sight of Cooley and I never saw him any more though I know Cooley went into the Battle and I never saw him any more and I have no intrest in this clame. The above subscribed and sworn to before me this Dec 8th 1904 and I have no intrest in said claim nor concerned in its prosscition and I further state said Trew is a respectable witness and intitled credit as such. Jany 10, 1905 Dear Sir: Enclosed find certificate to be filed with pension application of PM Cooley # 4433. He has been making efforts to prove that he contracted his disease while in prison. He found one old soldier who was in prison with him, but not of his company, and the soldier not having seen him since he left prison would not state that Mr Cooley was the idenical Cooley who was in prison. Mr. Cooley states that he does not know whether he can make the proof or not. Yours truly, Joe Minton Written on official paper of the Circuit Court Clerk, Sequatchie County, Tennessee. I, T.L. Stewart, Trustee of Sequatchie County, State of Tennessee, do hereby certify that there is no property, either real or personal assessed to either P.M. Cooley or his wife. Nor has there been for the past 8 years to my own knowledge in this county. Witness my hand this 10th day of January 1905. T. L. Stewart, Trustee. Copy of Envelope, postmarked 3 pm Dec 30 1912 at Dunlap, Tennessee, addressed to Frank A. Moses, Special Examiner Capitol Annex Nashville, Tenn. Handwritten on side, P.M. Cooley died Oct 5, 1912. Application Data: Phillip M. Cooley appeared on 13 August 1902 to fill out application. Disabilities listed: Chronic dysintery producing general debility and swelling of the feet and legs and which produces a dropsical tendency from which he is totally disabled from performing manual labor with justice to himself. He states that he was "taken sick at Fort Delaware, Delaware, while in prison" and such sickness disables him as "my bowels trouble me all the time, getting worse every time I attempt to do any work". He states that he was born "Roane County, Tenn, in the year 1840". When asked when he enlisted and to name who he served under: "In the fall of 1861. In Col Whorton's Command. I was serving under Col. Granvile Sandusky; and Capt. Wm. Moore, when I was captured between Manchester Tenn and Tullahoma Tenn. I was in prison at Fort Delaware from ? 1863 to June 1865. Soon after I was sent to prison I was affected with dysintery which has troubled me ever since. I am unable to perform manual labor, for when I try to work, I get hot and my bowels get worse. Said disability is permanent. The war had closed when I got out of prison." He did not remember the name of the surgeon who attended him. He stated he got out of the army because "I was captured". When asked if he took the oath of allegiance to the United States Government, he stated, "I did not". " I am married, my wife and one son at home, also 4 sons with familys. Wife 63, sons 36, 33, 31, 27 and 21. Are not some of your children able to support you? "No, all but one have familys of their own. It is all they can do to support themselves and familys. I have no business and do not earn anything." The value of real and personal estate: "One horse, value about $35, household goods, value about $30." He stated that his wife had no estate and that he has derived support thus far from "my children have supported us." He stated that he did not use intoxicants to any extent and that he had been an actual resident of the state of Tennessee all his life. His attorney was listed as Joe Minton, Dunlap, Tennessee.
