Nathan Perdew Clerk *********************** State of Tennessee County of Putnam } On this 29 day of May 1855 AD one thousand Eight hundred and fifty five Personally appeared before me a Justice of the Peace, within and for the County and State aforesaid Moses Byers aged about sixty three years a resident of Putnam County in the State of Tennessee who being duly sworn according to law, declares that he is the identical person who was a private in the company commanded by Captain Samuel Maxwell in the 4th Ridgement of Tennessee Militia commanded by Robert Steel, in the war with Great Britain declared by the United States on the 18th day of June, 1812, for the term of six Month and continued in actual service in said war for Three Months and fifteen days; that he has heretofore made applicaton for County lands under the act of September 28th 1850. And received a land warrnt No ____ for Eighty Acres, which he has since legally disposed of and cannot now return. He makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the Act approved the 3rd day of March 1855. He also declares that he has never applied for nor received under this nor any other Act of Congress any bounty land warrant except the one above mentioned. Cox Clk of the County Court, a court of record in and for the county and State aforesaid, Elisabeth Byers, aged 76 years, a resident of near Gainesboro county of Jackson, State of Tennessee, who being duly sworn according to law, declares that she is the widow of Moses Byers, who served the full period of sixty day in the Military service of the United States in the war of 1812, and who was the identical Moses Byers who was Enrolled in Captain Samuel Maxwells company, _____ regiment, _____ brigade, Jackson division, at Fayetteville, Tenn on the _____ day of _______, 1814, and was honorably discharged at Fayetteville Tennessee on the _____ day of _____, 1814 that her said husband made application for and drew bounty land under former Acts of Congress which application is he be referred to - He was in the Creek Campaign that she was married under the name of Elizabeth Cooke to the said Moses Byers on the 13th day of October, AD 1811, by ______, at Greenville, there being no legal barrier to such marriage; that her said husband died at Jackson County, on the 12th day of January, 1862 and that she has not remarried since his death; that at no time during the late rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercise the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; that she will support the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension rolls of the United States, under the provisions of the act approved February 14, 1871, and hereby constitutes and appoints with full power of substitutions and revocation B. Cooke Sandord Stamps George Henry went out at the same time affiant states that he saw the said they are dead Elizabeth Byers wife of the said Moses Byers decesd frequently whilst her husband Mose Byers was gon to the ware affiant lived with in one mile of Elizabeth Byers who is an applicant for pention for her Husband Moses Byers survices in the war of 1812 affiant states that he was well acuninte with the said Elizabeth Byers the wife of Moses Byers decesed all the time her husband Moses Byers was gon to the ware 1812 and saw her frequently while her husband Moses Byers was gon to the way of 1812 affiant states that he did not see them mared but has known them as husband and wife ever since up to the death of her husband Moses Byers affiant states that Moses Byers and his wife Elizabeth Byers has been Recognized as husband and wife ever since they came to the county wich has been about sixty years ago affiant states that from everything he knows or has ever hird he is fuly satisfied that they were lawfuly husband and wife have know them 60 years and never hird it stated Moses Byers died in Jackson County Tennessee sum two years & or perhaps sum more dont recolect the present date the said Moses Byers and Elizabeth Byers has raised a large and Respectable family and said family heird the estate of said Moses Byers sworn to and subscribed befor me and sertify that I have red over the for going deposition and ???? the same to the witness Elijah Car before assigned by the witness this the 5 day of June 1872 Elijah Carr Wm J.
