Hamby Pension Application Papers Obtained from NARA CERTIFICATE OF DISABILITY FOR DISCHARGE James M. Hamby, 1st Corporal of Captain S.J. Tedder’s Inf. Vols. Company E of the First Tenn. Regiment of the United States was enlisted by Capt. John Ellis of First Regiment of Tenn. Vols. at Camp Dick Robinson Ky on the 20th day of August 1861 to serve 3 years; he was born in Roane County in the State of Tennessee, is fifty years of age, 6 feet 3 inches high, dark complexion, blue eyes, dark hair, and by occupation when enlisted a farmer. During the last twelve months said soldier has been unfit for duty 365 days. The above named soldier has been disabled by a cough and bleeding at the lungs, and a swelling of his legs, general weakness and so on. /s/ General S. Tedder Capt. Commanding Company Station: Murfreesboro, Tenn. Date: February 16, 1863 I certify that I have carefully examined the said James M. Hamby of Captain Tedder’s Company, and find him incapable of performing the duties of a soldier because of old age hormoptysis? anasarca & general debility, which together render him totally unfit for the service. CLAIM FOR INVALID PENSION State of Tennessee County of Roane On this ninth day of November 1865 personally appeared before me, a Clerk of a Court of Record, in the County and State aforesaid James M. Hamby, aged fifty- three years, a resident of Post Oak Springs, County of Roane in the State of Tennessee, who being duly sworn, declares that he is the identical James M. Hamby who enlisted in the service of the United States at Camp Dick Robinson in the State of Kentucky on the twentieth day of August 1867, as a Corporal in Company E commanded by Seagt. John Ellis in the first Regiment of East Tenn. Vol. Infty. in the war of 1861, and was honorably discharged on the twenty- third day of February 1863. That while in the service aforesaid, and in the line of his duty, at London, Kentucky between 20 & 24 day of October 1861 from exposure & fatigue was taken with a hemorrhage of the lungs & typhoid fever. The fever fell into his left leg, which at times becomes so numb that he can hardly use it. He makes this application for a pension, provided by the Act of Congress approved July 14th, 1862; and hereby appointed, Striblen & Simpson, of Washington City, D.C., his lawful attorneys and authorizes them to present and prosecute this claim, and to receive and receipt for any orders or certificates which may be issued in satisfaction thereof. Hamby a Corporal of Captain John Ellis Company E of the First Regiment of East Tenn. Vol. Infty. was enlisted by Capt. John Ellis of the First Regiment of East Tenn. Vol. Infty. at Camp Dick Robinson Ky on the twentieth day of August 1861 to serve three years or the war. He was born in Wilkes County in the State of North Carolina, is 53 years of age, six feet two inches high, dark complexion, black eyes, grey hair, and by occupation when enlisted a farmer. During the last two months prior to said soldier’s discharge, he was unfit for duty sixty days, by reason of an affection of the lungs produced by exposure and fatigue. Said Hamby was one of the strongest & healthiest men in the company before he contracted the above disease & I hereby certify that he is the identical James M. Hamby who served in my company as above stated, although he is not properly described in his discharge, which was contracted while in the service of the United States, and in the line of his duty at London in the State of Kentucky, between 20 & 24 day of October 1861. /s/ John Ellis COMMISSIONED OFFICER’S CERTIFICATE OF DISABILITY Kingston, Tenn., Oct. 12th, 1867 James M. Hamby a Corpl of Captain S.J. Tedder’s Company E of the 1st Regiment of Tenn. Inf. was enlisted by Capt. John Ellis of the 1st Regiment of Tenn. Inf. at Camp Dick Robinson Ky on the twentieth day of August 1861 to serve three years. He was born in Roane County in the State of Tennessee, is fifty years of age, 6 feet 2 inches high, dark complexion, blue eyes, dark hair, and by occupation when enlisted a farmer. During the last months prior to said soldier’s discharge, he was unfit for duty by reason of disease while in the service of the United States, and in the line of duty at Wild Cat in the State of Kentucky, on or about the 1st day of November 1861, and is more fully described as follows: He was placed on picket on a cold rainy night and took cold, which settled in his limbs, causing his ankles to swell. He was never fit for much afterward. He was a healthy man before he entered the service. I do not think he is able to make a living by manual labor, on account of said disease. /s/ H. Crumbliss EXAMINING SURGEON’S CERTIFICATE Kingston, Tenn., Jan. 3d, 1868 I hereby certify that I have carefully examined James M. Hamby, late a Corp. Comp. E 1st Regt. Tenn. Vol. Infty. in the service of the United States, who was discharged at Murfreesboro Tenn., on the 23 day of Feb. 1863, and is an applicant for an invalid pension, by reason of alleged disability resulting from disease. In my opinion the said James M. Hamby [smeared] incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me, it is my belief that the said disability originated in the service aforesaid in the line of duty. The disability is permanent. A more particular description of the applicant’s condition is subjoined: The said Hamby while marching up to Wild Cat Ky preparatory for the fight at that place was dreadfully exposed both night and day which service brought on diphtheria fever which settled in his left thigh & leg producing anasarca and finally caused permanent disability of the same. /s/ Albert Lea OFFICER’S CERTIFICATE OF DISABILITY Post Oak Springs, May 8, 1872 I, James C. Owings 1st Lieut. of Company E, of the First Regiment of East Tennessee Vol. Inft. certify on honor that James M. Hamby was a Corporal in my company, and is, as I am informed, an applicant for an Invalid Pension; that he was discharged Feb. 23, 1863 at Murfreesboro Tennessee on account of general debility. And I further certify that the said James M. Hamby received or contracted his disease while in line of duty, near Wild Cat in the service of Uncle Sam during the fight of that place; and but a short time afterwards returned to London Ky and was sent to hospital. And that the said James M. Hamby, to my knowledge was a sound and able bodied man when he entered the service of the United States. /s/ James C. Owings 1st Lt. Co. E First Regiment E.T.V. Ift. [HANDWRITTEN AFFIDAVIT] State of Tennessee Roane County Before me the undersigned authority personally appeared James M. Hamby a resident of Crossville, P.O. Cumberland Co., Tenn. late Corpl. Co. E, 1st Tenn. Inf. Applicant for invalid pension No. 97,594, whom I certify to be respectable & entitled to credit, who being duly sworn according to law deposes & says that he was once in the General Hospital at London, Ky., but being very ill he was removed to the house of Judge Jones in town & that he has never been in the military or naval service of the U.S. since Feby. 23, 1863, when discharged. OFFICER’S CERTIFICATE OF DISABILITY Kingston, Tenn., November 6th 1873 I, Spencer J. Tedder of Company E, of the 1st Regiment of Tennessee Inft. certify on honor that James M. Hamby was a Corporal in my company, and is, as I am informed, an applicant for an Invalid Pension; that he was discharged at Murfreesboro Tenn. Feb. 23 1863, by reason of disability caused by typhoid pneumonia, and not for the reason stated in his discharge, as I was Captain of the Company at the time. And I further certify that the said Hamby was taken ill with typhoid pneumonia, while in Camp at London, Laurel County, Ky. about latter part of November 1861. The seeds of the disease were contracted at Wild Cat Ky. from exposure while in line of duty being without over-coats, and for several days without tents. He sometimes performed double duty. He was a very stout, strong man. He was a good soldier & always discharged every duty up to his illness at London Ky. Consider the above the true cause of his disability. While on our way to Ky to join the Army Hamby out-marched one third of the command, among a party of 340 men, many of whom were stout & strong men, many of them going through the war. And that the said James M. Hamby when he entered the service was a very stout healthy man as much so as any in the neighborhood, affiant having known him from boyhood never having seen him sick or take a dose of medicine but since leaving the service, claimant has been a confirmed invalid, from said disease, contracted in the service. I have no interest in this claim. /s/ S.J. Tedder Late Capt. Co. E 1st Regiment Tenn. Inf. [HANDWRITTEN AFFIDAVIT] State of Tennessee Cumberland County Personally appeared before me the undersigned authority for Cumberland County Elijah G. Haley a resident of aforesaid County and State who I certify to be a physician in good standing and skilled in his profession and respectable and entitled to credit who being duly sworn according to law deposes and say that I drilled a company of soldiers about the last of July 1861 and James M. Hamby was one of the company and was as I think one of ablest men in that company. I have also been acquainted with James M. Hamby about thirty years and considered his health good up to that time. I did not see Mr. Hamby anymore until 1863 in the month of June. I then found Mr. Hamby in very bad health he was in a dropsical state of health and his lungs were affected and his health is not good at this time and I have every reason to believe that it was exposure that he received while in the United States Army and I have no interest in this claim whatever. /s/ E.G. Haley Sworn to and subscribed before me this 14th day of November 1873. /s/ Fenton J. Brown Justice of the Peace for Cumberland County OFFICER’S CERTIFICATE OF DISABILITY Hebbertsburg, Tenn. Nov. 15th 1873 I, Alfred C. Aytes of Company E, of the 1st Regiment of Tennessee Infantry Vols. certify on honor that James M. Hamby was a Corporal Co. E, and is, as I am informed, an applicant for an Invalid Pension; that he was discharged at Murfreesboro Tenn. about Feb. 23d 1863, by reason of disability caused by exposure to wet and cold. And I further certify that the said Hamby was taken sick with a severe attack of fever while in camp at London Ky. about the last of Nov. 1861 while in line of duty. After a forced march from Camp Dick Robinson to Wildcat the weather turned severely cold and he not being well provided with suitable clothing and blankets took cold which no doubt caused his disease. His lungs became affected and he is a confirmed invalid. The fever also settled in one of his ankles which has made him a cripple for life. And that the said James M. Hamby was among the ablest men we had in the Regt. when he entered the service. In making out his discharge Dr. E.M. Norwood whose villainy and want of sympathy were well known, did him great injustice by fraudulently stating that his disability was from other cause. He seemed to have a feeling of enmity towards him for what cause I never knew. /s/ A.C. Aytes Late Capt. Co. E 1st Regiment Tenn. Inf. Vols. I have not interest in this claim. EXAMINING SURGEON’S CERTIFICATE No. of Application 97,544 State: Tennessee County: Roane Post Office: Kingston November 19th, 1873 I hereby certify that I have carefully examined James M. Hamby, late a Corp. of Co. E 1st Regt. Tenn. Vol. in the service of the United States, who was discharged at Murfreesboro Tenn., on the 23 day of Feb. 1863, and is an applicant for an invalid pension, by reason of alleged disability resulting from disease of lungs & anasarca. In my opinion the said James M. Hamby is two-thirds incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me, it is my belief that the said disability did originate in the service aforesaid in the line of duty. The disability is permanent as to lungs. A more particular description of the applicant’s condition is subjoined: Height, 6 ft 1 in.; weight, 180; complexion, dark; age 60; pulse, 78; respiration, 24. The applicant is suffering at the time edematous swelling of feet and legs. Has cough and difficult respiration dullness on perception over upper portion of left lung breast bone flattened in same region the anasaca is in. My opinion dependent mainly on the disease of lungs. /s/ James W. McPruitt ADJUTANT GENERAL’S OFFICE Washington, D.C. August 25, 1874 Sir: I have the honor to acknowledge the receipt from your Office of application for Pension No. 97,594, and to return it herewith, with such information as is furnished by the files of this Office. It appears from the Rolls on file in this Office that James M. Hamby was enrolled and mustered into service as a Capt on the 1st day of Sept, 1861, at Camp Dick Robinson Ky. in Co. E, 1st Regiment of Tenn. Volunteers, to serve 3 years, or during the war. On the Muster Roll of Co. E, of that Regiment, from enrollment to Oct. 30, 1861, he is reported present. Co. was stationed at Camp Wild Cat Ky Oct. 31, 1861. May & June, July & Aug, 1862 (4 mos. muster) deserted Aug. 12, 1862. Sept. & Oct., Nov. & Dec. 1862 (4 mos. muster) Pvt. absent by leave of Surgeon, M.O. _____ dated Sept. 17, 1864 reports him Corpl. Discharged for disability Feby 23, 1863 at Murfreesboro Tenn. by order of Genl. Rosecrans. No evidence of disability as alleged. /s/ J.P. Whitny [HANDWRITTEN AFFIDAVIT] State of Tennessee Cumberland County I A.C. Aytes of the county and state aforesaid, do solemnly swear that I am personally acquainted with James M. Hamby the claimant in this matter. It seems that the Department requires the names and numbers and localities of the several General Hospitals in which he was treated, in answer to which I would state that he was never treated in any general hospital, but about the latter part of Oct. 1861, was treated first in the Regimental hospital at London Kentucky, and afterwards was received into a private house in the town, that he might be better cared for, where he was treated by a Surgeon, Dr. A. Neat, USA. The said claimant was there treated until some time in Jan. following, when he joined his command as convalescent, and marched to Cumberland Ford, where he relapsed. He was here treated for awhile in camps, and afterwards by Dr. E.G. Haley, whose affidavit has been furnished. Claimant was never in the military or naval service prior to the term from which discharged Feb. 23, 1863. Further, I am not interested in any way interested in this claim. /s/ A.C. Aytes Late Capt. Teskins Deputy Clerk of the County Court of Cumberland County [HANDWRITTEN AFFIDAVIT] State of Tennessee Cumberland County Personally came E.G. Haley before me F.J. Brown an acting justice of the peace for said county and under oath in due form of law that he has been personally acquainted with James M. Hamby for fifty years, and that he considered said Hamby to be a healthy man up to the time he joined the army in the year 1861. Affiant further states that he seen Mr. Hamby no more until June 1862 when Mr. Hamby called on affiant for medical treatment and that he found him in very bad health in a dropsical condition and his lungs in a bad condition and that he still considers his general health very bad. Hamby, claimant, who after first being sworn by me for that purpose, says that he has never served in either the military or naval service of the United States since his discharge from the date of his discharge February 23, 1863. Hamby, late a Corp. Co. E 1st Regt. Tenn. Vols. in the service of the United States, who was discharged at Murfreesboro Tenn., on the 23 day of Feb. 1863, and is an applicant for an invalid pension, by reason of alleged disability resulting from dropsy disease of kidneys & heart. In my opinion the said James M. Hamby is entitled to $12.00 per month incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me, it is my belief that the said disability did originate in the service aforesaid in the line of duty. A more particular description of the applicant’s condition is subjoined: Height, 6 ft 2 in.; weight, 175; complexion, dark; age 62; pulse, 115; respiration, 31. I find disturbance of hearts action blowing sound turbulent pulse tongue thick found pain and weakness over region of kidneys urine high red color pain in voiding frequent in duration to void urine test and ankles swollen dropsical ankles very weak left ankle in particular which sometimes gives way and lets him fall there is a general giving down of the whole system and if you _____ these separate it is more than I can do. /s/ James W. McPruitt SURGEON’S CERTIFICATE State: Tennessee County: Roane Post Office: Kingston Sept. 17, 1877 I hereby certify that I have carefully examined James M. Hamby, who was a Corp. of Co. E 1st Regt. Tenn. Vols. in the war of 1861 and was granted an Invalid Pension under Certificate No. 138,269 to be paid now at the Agency in Knoxville, Tenn. by reason of alleged disability resulting from chronic disease of liver & lungs, which he states to have been received in the line of duty while he was in the military service of the United States. In my opinion the said pensioners disability, from the cause aforesaid continues at $8.00 eight dollars per mo. A more particular description of the Pensioner’s condition is subjoined: Height, 6 ft 2 in.; weight, 180; complexion, fair; age 64; pulse, 95; respiration, 25. I find edema of feet and legs some effusion in abdomen hearts action irregular sounds loud constant cough dysphonic tenderness over region of liver and lungs urine _______ high colored voided with difficulty general debility. /s/ James W. McPruitt GENERAL AFFIDAVIT State of Tennessee County of Cumberland In the matter of increase pension, Cert. No. 138,269 of James M. Hamby, 1st Tenn. Vols. Personally came before me, a Clk of the County Court in a for aforesaid County and State, James M. Hamby, aged 66 years, a citizen of the Town of Crossville, County of Cumberland, State of Tennessee, well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to aforesaid case, as follows: That the location of the disease is in the right leg being dropsy. Also disease of the lungs which renders him totally unable to perform any kind of labor. James M. (his mark) Hamby /s/ J.P. England /s/ J.T. Narramore Sworn to and subscribed before me this day by the above named affiant; and I certify that I read said affidavit to said affiant, and acquainted him with its contents before he executed the same. I further certify that I am in nowise interested in said case, nor am I concerned in its prosecution; and that said affiant is personally known to me; that he is a creditable person and so reputed in the community in which he resides. Dunbar County Clerk EXAMINING SURGEON’S CERTIFICATE No. of Certificate 138,269 State: Tennessee County: Roane Post Office: Rockwood March 14, 1882 It is hereby certified that James M. Hamby, formerly a Corp. of Captain Ellis Tedder & after E Company in the 1st Regiment of Tenn. Vols. in the war of rebellion who is now paid at Knoxville Agency at the rate of eight dollars per month, on account, as he states, of dropsy and general debility while in the line of duty in the military service of the United States, on or about the 10th day of December 1862 at a place called Wild Cat London, in the State of Kentucky is still suffering in consequence of said sickness and disability. The disability originates entirely from the injury or disease on account of which he was originally pensioned, as follows: Height, 6 ft; weight, 180; complexion, pale; age 69; pulse, 88; respiration, 24. This applicant has general dropsy weak ankles and so weak that he can only keep them straight by use of braces. Nerves weak and trembling. Wholly unable to perform any labor. I find his disability, as described above, to be equal to, and entitling him to full pension. /s/ Warren Stewart INCREASE INVALID PENSION Increase Pension Claim No. 138,269 James M. Hamby, Rank 1st Corp. Company E, 1st Reg’t Tenn. Inf. Chattanooga Tenn. State, Crossville, Cumberland Co. Tenn. October 6th, 1886 We hereby certify that in compliance with the requirements of the law we have carefully examined this applicant, who states that he is suffering from the following disability, incurred in the service, viz: Dropsy, hemorrhage of lungs, and general disability and that he receives a pension of fourteen ($14) dollars per month. Pulse rate per minute, 100; respiration, 19; temperature, 98; height, 6 feet; weight, 163 pounds, age, 73 years. He makes the following statement upon which he bases his claim for increase: I think I didn’t get enough at first & besides that I am getting worse. My heart & legs hurt me so that I can hardly get about. I have the gravel. I never passed any blood. My feet & legs are swollen all the time. I have had very severe hemorrhages of the lungs but while in the service & since I left it. I am totally disabled. Upon examination we find the following objective conditions: He is a man of originally powerful frame but now bent & tremulous with age muscular system somewhat wasted. There is very marked edema of the lower extremities. The left ankle is so weak that he needs a steel brace to support it. We find bulging of the 2nd rib of left side & slight pulsation in 1st & 2nd intercostal spaces. We diagnose aortic aneurism with a weak heart left cavity dilated extended dullness apex beat ____ lower than usual & feeble. His lungs are sound. No dullness on percussion no rates no cough no sputum. From the existing condition and the history of this claimant, as stated by himself, it is, in our judgment, probable that the disability was incurred in the service as he claims and that it has not been prolonged or aggravated by vicious habits. He is, in our opinion, entitled to a 2nd grade rating for the disability caused by disease of heart & ____, for that caused by hemorrhage of ________ which aggregates a 2nd grade rating. /s/ H.L.
