This file was contributed for use in the USGenWeb Archives by: Sharon Smith sharon@axs4u.net ==================================================================== ROBERTSON CO, TN WILL BK 13, p. 25-26 1841 James GAMBILL's Last Will and Testament In the name of God Amen I James GAMBILL do make and publish this as my last will and testament and only working and making void all other wills by me at any time made. 1st I direct that my funeral expenses and all my just debts be paid as soon after my death as possible out of any money that I may die possessed of or may first come into the hands of my Executors 2nd I give and bequeath unto my son William GAMBILL four hundred dollars 3rd I give and bequeath unto James M FYKE that married my daughter Elizabeth the negro girl Mahala that she has had possession of for years past and when William gets the above mentioned four hundred dollars, I then consider all my heirs equal up to the present And then after my death I wish all that I may be worth be equally divided amongst the following heirs To Wit William GAMBILL, Sally MOORE, John GAMBILL, Benjamin GAMBILL, James M FYKE and Polly STROTHER and Susan MOORE so as to make the portion of Polly STROTHER and Susan equal to one of the other portions. Lastly I do hereby nominate and appoint Benjamin GAMBILL my Executor In witness whereof I do to this my will set my hand and seal this 10th day of October. Signed sealed and published in our presence and we have subscribed our names hereto in the presence of the testator the 11th day of October 1841 Jno C PATTERSON John SAMUEL his James GAMBILL (seal) mark Robertson Co Court September Term 1846 A paper writing purporting to be the last will and testament of James GAMBILL, deceased, was produced in open court for probate and thereupon came John SAMUEL one of the subscribing witnesses to said paper writing who being first sworn depose and say that he was acquainted with James GAMBILL the Testator in his lifetime and that he acknowledged in his presence said paper writing to be his last will and testament and that he was at that time in his proper mind and that he attested said paper writing at his request the Court therefore ordered said paper writing to be recorded Test, J.E. WINFIELD, Clerk James GAMBILL Letter of Estate State of Tennessee Robertson County Court September Term 1846 To Benjamin GAMBILL a citizen of Robertson County it appearing to the Court that James GAMBILL has dec'd leaving a written will in which you an appointed Executor which has been proved in open Court and be you having of now bond and qualified according to law and it having ben ordered by the Court that_______Testamentary issued to you. These are therefore to authorize and empower you the said Benjamin GAMBILL to enter upon the execution of said will and to take into your possession all the property and to make a perfect inventory thereof and to make due collection of all debts and after paying all just demands against the Testator and setting up the business of said estate according to law you pay over and deliver the property and affects that may remain in your hands, and as all other things according to the possession of the will and the laws of the land, Witness Joseph E WINFIELD Clerk of our said Court at office this 1st Monday in September 1846 J. WINFIELD, Clk Elizabeth GAMBILL Letter of Estate State of Tennessee Robertson County Court September Term 1848 Whereas it appearing to the Court here that Elizabeth GAMBILL is dec'd and having made no will or Testament and application being made by John GAMBILL to have Letters of Administration granted to him on the estate of said Elizabeth GAMBILL deceased he having given bond and security as by law in case as required Whereupon the Court ordered that he have letters accordingly. These are therefore to authorize and empower you the said John GAMBILL to enter upon and singular the goods and chattels rights and credits of the said Elizabeth GAMBILL deceased and the same in your possession take whensoever to be found in this State, and a time and perfect inventory thereof to make and return to our answering County Court an oath, and all the just debts of the intestate pay so far as the said estate will pay amount or___the residue thereof deliver to those who may have a right thereto by law.
