Pitts Will Dec 1, 1842 pg 503) I Joseph B. PITTS do make and publish this as my last will and testament hereby revoking and making void all other wills by me at any time made. First I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any money that I may die possessed of or may first come into the hand of my Executor. Secondly I direct that the tract of land that I heired from the estate of my mother, deceased, be sold to pay my debts after my debt is paid out of this money the remaining part to be converted to the use of my family. Thirdly I will to my beloved wife Jane PITTS during her lifetime or widowhood the tract of land on which I now live, household and kitchen furniture, farming utensils, my waggon and gear, four head of horses (to wit) one black mare & her two colts, one mule, my stock of hogs, cattle & sheep with the priviledges of using my money that may be left to use and benefit of the family but if she should marry I will that she shall have three hundred dollars, that is a hundred dollars horse, saddle & bridle, one hundred dollars in money & one hundred dollars worth of household and kitchen furniture at valuation. Fourthly if my wife should die or marry I wish that the lands & remaining stock shall be sold and the money be equally divided between my five children, further my negroes shall have a half a day in each week to work for themselves but if they shall at any time become unruly and ungovernable by the family and upon due proof these facts I will that my Administrator have the power to advertise and sell in the town of Springfield at twenty days notice and the money applied to the benefit of the estate. Fifthly if there should be sufficient quantity of money left after my debts are paid I will that there should be a shed built on the west side of my house & piazah on the east side and the house finished by plastering. Sixth I will that my two oldest daughters Margaret Y. PITTS & Patsy PITTS that they go one session to a well organized school, also will my son Joseph J. PITTS shall have a thorough knowledge of reading, writing, arithmetic & English grammar. I also will that my two youngest daughters Elvira PITTS & Mary M. PITTS shall have an education equal with the two oldest daughters paid from the estate. I will that my sons Joseph J. PITTS educations shall be paid for before they have an equal on equal division out of the estate. Also my daughters shall be paid for out of the estate before a division. I further will that if my daughters should marry that their mother shall give them such property as can be spared at valuation and account kept of the same. Lastly, I do hereby nominate and appoint Vincent WILLIAMS my Executor. In witness whereof I do to this set my hand and seal this the first day of December 1842. M.B. PITTS was produced in open Court for probate and thereupon came William FUQUA & Bartley P. WILLIS the subscribing witnesses thereto both first sworn depose and say that they were aquainted with J.B. PITTS the testator in his lifetime and that he acknowledged in their presence the same to be his last will and testament and that they attested the same at his request and that he was at that time in his proper mind the Court therefore ordered that the same be recorded.
