Ballard, Gdn To Power of Attorney Ivery (sic) Ballard Know all men by these presents that I Lewis J. Ballard Guardian for William W. Evans, John Evans and Sarah Evans minor Children of John Evans and Fracis (sic) L. Evans decd all of the County of Greene and state of Illinoise (sic) have constituted and appointed Ivery (sic) Ballard of the same place my true and lawful attorney for me as guardian aforesaid to collect and receive from the Clerk of the Circuit Court of Rutherford County Tennessee or from James Fartherly administrator of the estate of Wile (sic) Ballard (late of Rutherford County) deceased the full and entire amount of money due the said heirs from the estate of the said Wile (sic) Ballard deceased that may be found in the hands of said Clerk or Administrator giving my said Attorney as guardian aforesaid full power to institute and carry on any suit in law or equity necessary for the recovery of any and all money due said heirs as aforesaid and to give releases acquittances (sic) receipts and discharges hereby giving granting and confirming all the acts which the said Avery Ballard may do and perform as my said attorney in the premises by virtue hereof. (Ballard) Evans must be a daughter of Wiley Ballard pp. 355-356 No. 403 Willis Ballard To Power of Attorney Avery Ballard Know all men by these presents that I Willis Ballard of the County of Greene and State of Illinois do constitute and appoint Avery Ballard of the County of Greene and State of Illinois my true and lawful attorney for me and in my name to have receive and collect all such sums of money due owing and coming to me from the estate of my deceased father Wiley Ballard who departed this life in the County of Rutherford and State of Tennessee be the same in the hands of James L Fathera (sic) Administrator of the estate of my said Father or in the hands of any other person or persons whomsoever And for me and in my name to sign and seal all necessary Receipts and other acquittances (sic)or discharges for the same And generally for me and in my name to do all things necessary to be done in the premises hereby ratifying and confirming and by these presents allowing whatsoever my said Attorney shall or may lawfully do in the premises. Ballard’s (born Abt. 1800 in NC according to 1850 Apple Creek, Greene County Illinois Census, Family # 171) is son of Wiley Ballard, but John, Coleman and Avery Howard are sons of Charlotte Ballard Howard, Wiley’s daughter, and therefore are Wiley’s grandchildren. When the child of a deceased person dies in Tennessee, that child’s portion of the estate is inherited by the children of the deceased child. pp. 358 – 359 No. 406 George Morrow and others To Power of Attorney Avery Ballard Know all men by these presents (sic) that we George Morrow and his wife Emeline, Joseph Wise and his wife Francis Ann, Thomas Johnson and his wife Elizabeth Jane, James L. Webb children and heirs at law of Sarah Webb decd whose maiden name was Sarah Ballard and who was the daughter of Wiley Ballard who departed this life in the County of Rutherford in the State of Tennessee the above massed heirs being residents of the County of Greene and State of Illinois and Arden Evans and his wife Mary of the County of Morgan and State of Illinois the said Mary being also daughter and heir at law of said Sarah Webb deceased and William Webb Guardian for William Francis Webb minor heir of Richard Webb deceased who was also son and heir at law of said Sarah Webb do make constitute and appoint Avery Ballard of the County of Greene and State of Illinois our true and lawful attorney for us and in our names to have receive collect sue for and demand of James Fathera Administrator for the estate of Wiley Ballard decd late of the County of Rutherford in the State of Tennessee and to receive and collect of any other person or persons in whose hands the same may be found all sums of money due owing and coming to us from the estate of said Wiley Ballard deceased as Children and heirs at law of said Sarah Webb deceased and for us and in our name and under our hand and seals to sign and deliver all necessary receipts and to do and perform all things necessary in the premises hereby ratifying and by these presents allowing whatsoever our said attorney shall or may lawfully do in the premises.
