At a court of pleas and quarter sepious withers and for the county of 
Rutherford, at the court house in the town of Murfreesborough, on the third 
Monday in November, in the year of our Lord 1828.

Present Logan Henderson, chairman-- John Fletcher, William Vinson, William H 
Davis, John Weatherspoon, Henry D Jamison, Henry Ridley, _____ Noland, Thomas 
Powell, Robert Miller, Isaac J Miller, David Patton, James Sharp, John 
Alexander, David R Gooch, Jack Smith, Jospeh Mason, William W Searcy, Overton W 
Crockett, Isaac Butler, Benjamin Ransom and Samuel Johns, Esquires, Justices--

A paper writing suporting to be the last will and testament of a nuncupative 
will of Eden Donnell deceased, was produced in court by Jesse Alexander, one of 
the subscribing witnesses, for probate – whereupon it was ordered, that George 
Peebles be appointed special guardian for William Carroll Donnell, Isabella 
Columbus Donnell and Eden De Wit Clinton Donnell, minor heirs of Eden Donnell 
deceased, and that a summons issue to said heirs by their said guardian and to 
Eliza Donnell widow of said Eden Donnell deceased, to appear at this court and 
contest the probate of said will if they think proper – George Peebles comes 
into court and acknowledges notice of the above motion and waives the necessity 
of any further notice or summons.
