Lillard and James M. Flemming, citiezens of Rutherford County. It appearing to the Court that James Rankin has died leaving a written will in which you are appointed Executor which has been duly proved in open court and you having given bond and qualified according to law and it having been ordered by the said court that Letters of Testamentary issue to you. These are therefore to empower you the said Wm. B. Lillard and James M. Flemming to enter upon the execution of said will and take into your possession all the property and to return to this court in Ninety Days a perfect inventory thereof and make due collection of all debts and after the last demands against the testator and settling up the business of said estate according to law you will pay over and deliver the property and affects that may remain in your hands and to do all the other things that may be required according to the provisions of said will and the laws of the land.
