Bethshares March 1858 No. 339 Jas. C. Fathera To Deed Jesse Bethshares I, James C. Fathera by virtue of the power and authority to me given in and by the last will and testament of Willie Ballard deceased and for and in consideration of the sum of Seventeen hundred & fifty three dollars to me paid by Jesse Bethshares the receipt whereof is hereby acknowledged have this day bargained and sold and do hereby transfer and convey to so said Jess Bethshares and his heirs forever two tracts or parcels of land lying in the County of Rutherford and State of Tennessee and bounded as follows, The first tract contains by estimation one hundred acres, it being part of a one thousand acre tract granted by the State of North Carolina to Armstrong, Beginning at an Ash standing on a Branch Eighty poles East of the Southwest corner of the original survey (a Black Oak) thence East with the old line (crossing Cripple Creek) 142 poles to a Cedar, thence north 90 poles to a Hickory, thence west crossing Cripple Creek 212 poles to a small Cedar. Thence South 39+ - 15” East to the beginning, it being the same tract conveyed by Alex McCulloch to Willie Ballard by deed bearing date 20th day of September 1820. Another tract containing by estimation eleven and one fourth acres more or less Beginning at a Cedar the Southeast corner of the afore described tract of one hundred acres, Thence East 20 poles to a Cedar Thence north 90 poles to a Cedar (crossing the road from Murfreesboro to Readyville) Thence west 20 poles, Thence South to the beginning. To have and to hold said lands (except is dower interest of Tabitha Ballard, widow of Willie Ballard decd which is not intended to be conveyed to said Jesse Bethshares and his heirs forever. I covenant with the said Jesse Bethshares that as the executor of Willie Ballard decd I have a good right to convey the above described land, and I further covenant and agree as executor of said Ballard to warrant and defend the title to said lands against the careful claims of all persons whatever, but I convey as executor only and am not personally bound per title.
